SUBJECT: Approve the contract amendment from Consor North America, Inc. (formerly Quincy Engineering) for $433,600.00 for the Rogers Road Delta Mendota Canal Bridge Rehabilitation Project and authorize staff to enter into a negotiated Consultant Agreement with a total not to exceed cost of $433,600.00 for Phase II.
RECOMMENDATION
Motion to Approve the contract amendment from Consor North America, Inc. (formerly Quincy Engineering) for $433,600.00 for the Rogers Road Delta Mendota Canal Bridge Rehabilitation Project and authorize staff to enter into a negotiated Consultant Agreement with a total not to exceed cost of $433,600.00 for Phase II.
BACKGROUND
The Rogers Road Bridge over the Delta Mendota Canal was built in 1949. The bridge is located
0.5 Miles north of the intersection of Rogers Road and Sperry Avenue. The City solicited proposals from qualified consultants for Professional Engineering Services for the Rogers Road Delta Mendota Canal Bridge Rehabilitation Project. The panel determined that Quincy Engineering was the most qualified firm to complete this project. In May 2019, Quincy Engineering, Inc. was acquired and became a wholly owned subsidiary of Consor North America, Inc.
Phase I of this contract was awarded April 4, 2017, which includes Preliminary Engineering, Environmental Clearance and Permitting, Geotechnical Studies, Topographic Survey and Mapping. The total amount for Phase I, including the amendments, is $616,307.56. Unforeseen issues occurred resulting in an increase in costs for Phase I, as detailed in the subsequent amendments. During the design process, the ownership of the bridge was not documented per Caltrans requirements, resulting in Caltrans requesting documentation from the City of Patterson showing ownership of the bridge. City staff worked with the San Luis & Delta-Mendota Water Authority and the Bureau of Reclamation to acquire all necessary documentation of ownership.
In addition, after a field visit with Caltrans, additional Environmental Technical Studies were required by Caltrans that the City did not anticipate.
Following the completion of Phase I work and securing the necessary environmental clearance, the project team is now ready to move forward into Phase II. However, the timing of Phase II was dependent on the availability of funds through the Federal Highway Bridge Program (HBP), since this project is being funded as part of the HBP. The Rogers Road Delta Mendota Canal Bridge has 88.53% Federal Cost Participation, with the City responsible for the remaining
11.47% of costs. The process of requesting additional Engineering Services funds is common for Federally Funded Bridge Projects. The City was notified in April 2023 that additional funds are now available for this project and is proceeding to Phase II.
ANALYSIS
Phase II of this project includes a final Plans, Specifications and Estimates (PS&E) package and any required right of way or utility work. The right of way work includes identifying the total number of affected parcels, level of effort for impacted utilities, the requirement for temporary waterline, among other task adjustments and additions. This project will be out to bid for construction at the conclusion of Phase II, contingent on available funding through HBP.
Staff recommends approving this contract amendment to complete a final PS&E package, including any necessary right of way or utility work. The full scope of work and cost breakdown for this amendment can be found in the attached document.
FISCAL IMPACT
Consor’s cost proposal for Phase II is $433,600.00.
Staff negotiated with Consor for an agreeable scope of work and fee of $433,600.00 for the Phase II contract amendment. Staff recommends awarding the design to Consor for the Phase II amendment amount and authorizing the budget as detailed below. $433,600.00 Consor - Phase II: Final PS&E, Construction support, right of way and permitting. $433,600.00 Total Phase II
