RE: Rogers Road over Delta Mendota Canal Bridge Replacement Project Federal Project No. BRLS-5244(032)
AMENDMENT NO. 3 REQUEST
At the initiation of this project, it was broken up into two different phases defined as:
• Phase I – Preliminary Engineering and Environmental Clearance • Phase II – Final PS&E, Construction Support, Right of Way and Permitting During the delivery of the Phase I work, the project team developed a Caltrans Exhibit 6D – HBP Scope/Cost/Schedule Change Request in June of 2021 which identified additional funding that would be necessary for the various phases of the project including PE (Preliminary Engineering), R/W (Right of Way), and CON (Construction). This was approved by Caltrans HBP Program.

Following the completion of the Phase I work and securing Environmental Clearance, the Project Team was ready to move forward into Phase II, except that the previously identified and secured funding for Phase II was not available until FFY ‘22/’23, the current federal fiscal year. As a result, negotiations of the Phase II work had to wait until the funding and the approval of the Request for Authorization for the Right of Way Phase was complete.

In January 2023, the City was notified by Caltrans that a portion of the currently approved funding would lapse if not spent and invoiced by May of 2023. The project team worked with the City to put together Task Budget Reallocation No. 2 and Amendment No. 2 in order to advance tasks from Phase II that could expend these expiring budgets. This work was completed and the expiring funds were expended in time for reimbursement from Caltrans.

Now that the advanced work has been completed, the reallocated budgets from reallocation No. 2 will need to be restored along with the associated scope of work.

Since the previous June 2021 Exhibit 6D, the project team identified additional services and effort required for the project not previously included in the contract scope and budget. This results in an increase to the HBP programming amounts identified in June 2021. In February 2023, Consor was preparing the RFA for R/W and additional PE for the City’s review. At that time, it was discussed that Consor could initiate another Exhibit 6D for the City to submit to receive the necessary additional PE funds (which would take at least a year to approve) or Consor could look to shift appropriate right of way eligible tasks to the right of way phase since there was adequate right of way support funds already authorized for the project. The City concurred with this approach and Caltrans authorized the additional PE funding as well as the R/W funds on April 26, 2023. Consor has been working with subconsultants to identify all of the remaining scope of work items and pulling together the attached “Cost to Complete” scope of work and cost proposal.

The attached scope and cost proposal accomplishes the following:
• Addresses the escalated costs for the Phase II work which was budgeted to be completed in 2020. Because of delays in project approvals and available funding by Caltrans the overall schedule has been delayed. • Identifies additional scope of work and services from the contract Phase II scope of work, which includes the total number of affected parcels, level of effort for impacted utilities, the requirement for temporary waterline, among other task adjustments and additions.
• Restores task budget and scope identified in Amendment No. 1, Task Budget Reallocation No.1 and Task Budget Reallocation No. 2 as identified in those contract adjustments. Aligns right of way task budgets with authorized HBP funding
• Defines remaining PE tasks, scope of work and associated budgets for the cost to complete for the PE & R/W Phases as listed below
• Adjusts Phase II task numbering for remaining scope of work, such that identified task can be separated from the monthly invoices, to assist the City with reimbursement requests to Caltrans The following attached documents include: Amendment No. 3 Assumptions and Detailed Scope of Work and the Amendment No. 3 Cost Proposal. The total effort identified in Amendment 3 is Four Hundred Thirty-Three Thousand Six Hundred Dollars ($433,600). This would be broken down into the following Caltrans Programming Phases:
• PE – Preliminary Engineering Phase – $185,721
 Associated Tasks – 1, 3, 6, 7 & 11
• R/W – Right of Way Phase Support Costs – $247,879
 Associated Tasks – 2, 8, 9 & 10
The tasks outlined in the scope of work will identify which tasks should be charged to which programming phases and will be broken down on the monthly invoices submitted to the City. There would be $332,121 remaining in authorized right of way funding for acquisitions and City support costs.

We are very sensitive to budgetary constraints facing public agencies and have always attempted to present the most efficient solution to the City on this project. Consor has presented this amendment request utilizing our 2017 Indirect Cost Rate (ICR) which was audited by Caltrans, even though our current ICR is higher.

If you have any questions, comments or require any additional information on this proposed amendment, please contact me at (916) 368-9181.

Respectfully Submitted,

Amendment No. 3 Assumptions and Detailed Scope of Work
Amendment No. 3 Cost Proposal
AMENDMENT NO. 3 – ADDITIONAL SCOPE OF WORK ASSUMPTIONS
ADDED SCOPE-OF-WORK ASSUMPTIONS - These are updates to the original Scope-of-Work assumptions and anticipated level of efforts:
• The original contract was based upon a 3-year delivery of the project starting in November 2017. The original contract always anticipated a Phase II, which could include Final PS&E, Construction Support, Right of Way and Permitting. This amendment includes escalated costs as well as additional efforts for completion of work yet to be done. This is reflected in additional efforts for all remaining tasks to be completed. It is anticipated that the remaining scope of services including the additional tasks and Final PS&E will be completed no later than December 2025. • The executed Task Budget Reallocation No. 2 of January 2023 documents additional services in the PE phase that would have been included in Phase II, but were accomplished by removing previously approved partial Phase 1 tasks.

This amendment not only restores those previously contracted funds that had been reallocated but also addresses escalation moving forward to completion for the following tasks:
o Task 1: Project Management
o Task 2: Subconsultant Task – Topographic Survey and Mapping) o Task 3: Subconsultant Task – Geotechnical Services
o Task 6: Subconsultant Task – Environmental Clearance and Permitting o Task 7: Subconsultant Task – PS&E
o Task 90: Subconsultant Task – Other Direct Costs
• Based on the currently approved project there will be temporary construction easements for 3 parcels and permanent acquisitions for 4 parcels. It is assumed that the parcel to the Northeast of the project at APN (021-085-027) currently owned by “Majestic Brisa” will be dedicated to The City and will not require an appraisal or plat and legal by the project team. In addition, there will be anticipated efforts for up to 2 separate field visits to perform right-of-way staking in support of the appraisals and acquisitions phase.
• Construction Support Services will be added as future amendment once the CON funds have been identified and these services would be billed against the Construction Funding Phase.

City will provide ongoing feedback to AR/WS as to authorization for settlements.

Task 8.4: Title Reports
AR/WS can provide up to 4 preliminary title reports through a subconsultant. The title reports will identify the current ownership and contain title exceptions, including easements and other encumbrances of record.

Task 8.0 Deliverables
 Coordination and negotiations with Property Owners as Necessary  Coordination with City Right of Way Staff
 Up to 4 Preliminary Title Reports
TASK 9.0 – Utility Coordination
Task 9.1 - Utility Coordination
Consor will continue to coordinate with utility owners to complete determination of liability and relocation design. As needed, Consor will meet with utility owners in the field to discuss conflicts and possible relocation or protection in place. It is assumed that coordination with four (4) utility owners will be required: Turlock Irrigation District (Electric), PG&E (Gas), Frontier (Telecom), and City of Patterson (Water). One field meeting for utility coordination is included in this scope of work.

A “C” letter will be used to finalize the request for relocation and serves as a notice to the owner that they must relocate. Our team will work closely with the utilities to drive the schedule for utility relocations in coordination with the overall project schedule.

We anticipate that there will be relocations required for the underground water lines, valves and pumps in the immediate vicinity of and attached to the bridge. It is also anticipated that all relocations will be coordinated with the bridge construction, requiring inclusion in the PS&E. Consor has assumed the following:
 Utility owners will provide any easement or right of way needs to Consor prior to drafting the right of way engineering plat maps and legal descriptions. If significant changes to the plat maps and legal descriptions are required for utilities after the County has provided their initial comments on the documents, this may require additional budget.  Relocation of the utilities will be performed prior to the contractor mobilizing to the site.  A separate mobilization for field staking for utilities is not included.

Task 9.2 - Coordination with SLDMWA/USBR
This task includes continuation of the coordination with SLDMWA and USBR from Phase I to incorporate design requirements for work near and over the canal, and to obtain the permit for construction. We have budgeted hours for this task to include inperson meetings and conference calls.

Task 9.3 – Utility Agreement, ROI, NTO
Consor will prepare an ROI and assist with developing a Utility Agreement based on the assumption that the waterline relocation is eligible for HBP funding. It is assumed that all other utilities will provide their own relocation design and liability for relocation is the responsibility of the utility owner.

TASK 10.0 – Water Line Relocation
This task includes relocation of two (2) existing 16-inch potable water lines that are mounted on the east side of the existing bridge. Our effort is based on the assumption that only one of the pipelines is currently in service and must be maintained throughout construction.

The PS&E contract documents will provide for a temporary relocation for the one potable water line that must remain in service. The temporary pipeline will cross the canal downstream of the vehicular bridge. The existing active pipeline will remain in service on the bridge until the temporary pipeline is constructed. When the temporary pipeline is completed, the existing pipelines mounted on the bridge will be isolated and shut down. The temporary pipeline will then be connected to the existing active pipeline between the isolation valves on the north and the south side of the canal. The temporary pipeline will then be disinfected, filled, and the system will be back in service with no more than two days of shutdown time.

A permanent location for the pipelines will be designed for the new bridge and will be constructed and ready for service when the bridge is completed. The new permanent location of the pipelines will be designed to hang under the new bridge and accommodate widening of the bridge in the future without a need for a future additional temporary relocation.

Task 10.1 - Prepare PS&E for Temporary Relocation of Potable Water Lines Consor will design a temporary pipeline alignment, including new valves, on each side of the bridge up to the canal, but it will be the responsibility of the contractor to design, and submit for approval, the canal crossing which will consist of a pipeline secured on a prefabricated structure, similar to a Bailey Bridge. A conceptual design and pipeline alignment will be prepared and included in the 65% plans.

The pipeline alignment will cross the canal at a location far enough downstream from the bridge to be out of the way of construction. The design of the pipelines will require current standard design methodologies with respect to structural support, seismic events, piping materials and appurtenances. The temporary potable water pipeline will be specified as ductile iron pipe with retrained mechanical joints.

Structural calculations for the temporary bridge, pipeline, supports, and landings for the bridge at the top of the levee on each side of the canal will be submitted to Consor by the contractor for review by our bridge engineers. The water pipeline design will be submitted to the water design team for review and approval, including review and approval from the client.

When the design concept of the pipeline alignment and new valves has been approved, plans, technical specifications, and an Engineer’s Opinion of Probable Construction Costs will be prepared and incorporated into the bridge design documents.

Construction drawings will be prepared using AutoCAD/AutoCAD Civil 3D and will be incorporated into the bridge design plans.

The project specifications will be prepared using MS Word and formatted to Caltrans standards. The specifications will be incorporated into the bridge design specifications.

An Opinion of Probable Construction Cost (OPCC) for the temporary relocation of the water lines will be prepared for incorporation into the overall bridge project.

Review submittals will be presented to the bridge design team at a conceptual design level (35%) for agreement on adequate clearances for bridge and roadway construction. Submittals will also take place at 65% design and 95% design completion for bridge team and City review. Comments from the 65% and 95% submittals to the City will be incorporated into the subsequent submittals. A final PS&E for temporary waterline relocation will be prepared upon receiving 95% comments from the client.

Task 10.2- Prepare PS&E for Permanent Relocation of Potable Water Lines (under bridge) Consor will design a permanent relocation of the potable water lines that will be supported under the new bridge. The pipelines’ alignment will generally follow the existing alignment and will be planned to accommodate a future widening of the bridge without the need for a temporary relocation when the bridge widening occurs. Preliminary design sketches assume that the pipelines will have room to be installed parallel to each other between bridge girders and will pass through the abutments on each side of the bridge. The pipelines will be hung low enough from the deck to accommodate the combination air/vacuum valves (CAVs) installed at the top of the pipelines on each side of the canal. Access to maintain the CAVs will be limited due to the size of the girders and staff may have only 1-1/2 to 2 feet clearance to crawl under the girder. Once under, there should be approximately 6 to 9 ft height and about 6 to 8 ft width between girders.

The design of the pipelines will incorporate current standard design methodologies with respect to structural support, seismic events, piping materials and appurtenances. The potable water pipelines will be designed and constructed utilizing ductile iron pipe with restrained mechanical joints.

When the pipeline design concept has been approved by the bridge designers and the City (35% plans), plans, technical specifications, and an OPCC will be prepared and incorporated into the bridge design documents.

Construction drawings will be prepared using AutoCAD/AutoCAD Civil 3D and will be incorporated into the bridge design plans.

The project specifications will be prepared using MS Word and formatted to Caltrans standards. The specifications will be incorporated into the bridge design specifications.

Provisions including design and construction details will be included to attach and additional potable water sleeve on the opposite side of the bridge. At a future date an additional potable waterline could be pushed through this connection and the appropriate connections and valves could be designed and constructed in the future by someone else. These details will only cover the sleeve and connection to the bridge.

An OPCC for the relocation of the water lines will be prepared for incorporation into the overall bridge project.

Review submittals will be presented to the bridge design team and the City at 65% design and 95% design completion.

Comments from the 65% and 95% submittals to the City will be incorporated into the subsequent submittals. A final set of documents will be prepared upon receipt of 95% comments from the City.

Task 10 Deliverables
 Conceptual design of temporary location for one pipeline on a structural support over the canal during bridge construction.
 Plan sheets, technical specifications, and OPPC at 65% and 95% submittals. (Temporary conceptual design for one pipeline, full design for two permanent potable water lines)  Plan sheet, technical specifications and design of potable water sleeve.  Final PS&E documents, stamped and signed, in electronic format.

TASK 11.0 – Bidding Assistance
This task was previously identified as Task 9. The individuals that were directly involved in the design will be available during the bid period to interpret the plans and specifications, prepare addenda if needed, and provide general consultation to the City to obtain bids.
