A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF PATTERSON APPROVING THE REGIONAL TRANSPORTATION
IMPACT FEE REPORT AND ADOPTING TRANSPORTATION DEVELOPMENT
IMPACT FEES
WHEREAS, Government Code Section 66000 et seq., known as the Mitigation Fee Act (AB 1600), authorizes local agencies to collect fees to mitigate the impacts of new development for infrastructure improvements; and
WHEREAS, the City Council of the City of Patterson has adopted ordinance No. 608 and resolutions establishing and revising Development Impact Fees required to be paid at the time a building permit is issued for new development, based on the San Francisco Bay Area’s Construction Cost Index (CCI); and
WHEREAS, the City Council of the City of Patterson desires to encourage the construction of new development in the City of Patterson and to promote economic development; and WHEREAS, the City of Patterson Regional Transportation Impact Fee study was prepared pursuant to applicable state laws, the 2010 General Plan and General Plan EIR, and relevant master plans; and
WHEREAS, the impact fee program is not considered a project and is therefore exempt from review under CEQA Guidelines section 15378(b)(4).
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Patterson as follows:
1. The City Council of the City of Patterson hereby approves updated transportation impact fees effective after the adoption of this resolution, per State Law, Effective October 18, 2023, as described on exhibit A attached hereto and annual CCI annual increases based on the San Francisco Bay Area CCI, effective every January 1st.
2. That the City Manager, or his/her designee, is hereby authorized to execute all documents necessary to implement and secure payment.
