6.5 Packet Pg. 17
Minutes Acceptance: Minutes of Feb 27, 2024 7:00 PM (Consent Calendar) City Council Agenda Report
TO: Mayor Clauzel and Members of the City Council
FROM: Ken Irwin, City Manager
BY: Marie Guillory Jones, Director of Human Resources
MEETING DATE: March 5, 2024
ITEM NO: 6.6
SUBJECT: Approve the Job Description and Salary Range for Code Enforcement Supervisor, and the Salary Range for Assistant City Manager and Deputy Director of Engineering.

RECOMMENDATION
Motion to Approve the job description and salary range for Code Enforcement Supervisor, and the salary range for Assistant City Manager and Deputy Director of Engineering.

BACKGROUND
The Code Enforcement Unit reports directly to the City Manager and is a part of the Administration Department. Code Enforcement is responsible for the investigation, compliance and enforcement of property maintenance, zoning, ordinances, and abatement regulations. This includes land use, municipal and building codes, abandoned vehicles, and graffiti abatement. The Code Enforcement Unit initially consisted of only a Senior Code Enforcement Officer. This position later began to provide lead direction over a Graffiti Abatement Technician. Now, the unit consists of a Senior Code Enforcement Officer, a Code Enforcement Officer I, a Graffiti Abatement Technician, and a clerical support person contracted through a staffing agency. As a result of this continued growth, the Code Enforcement unit requires a direct supervisor over the team, rather than having each of these individuals report to the City Manager.

The City Council previously approved job descriptions for Assistant City Manager and Deputy Director of Engineering during a regular meeting held on December 5, 2023. Now it is necessary to add the respective salary ranges to the salary schedules.

ANALYSIS

6.6 Packet Pg. 18
As the City of Patterson continues to grow and develop, so does the need to ensure regulatory compliance throughout the City. The Code Enforcement Unit requires a dedicated supervisor to provide day-to-day administration and supervision to Code Enforcement and Graffiti Abatement staff, including training, managing the work, performance, and schedules. With the projected residential and business development, this position will allow the Code Enforcement Unit to operate more efficiently, allow for proper planning, coordination, and execution of the work, and provide increased service levels to Patterson’s residents.

6.6 Packet Pg. 19

FISCAL IMPACT
Proposed Salary Range(s):

Any potential FY2023-24 fiscal impacts for the Code Enforcement Supervisor and Deputy Director of Engineering positions for April through June, is projected to be less than $5,000.

There is no current year fiscal impact for the Assistant City Manager associated with this action.

Appropriations for this position were included in the Fiscal Year 2023-24 Mid-Year Budget, approved by Council on February 20, 2024.

The annual fiscal impact for all classifications will be included in the FY2024-25 budget development process and brought before the Council at a later date.

SUBJECT: Approve Resolution No. 2024-12 Proclaiming Arbor Week during March 7-14, 2024, in the City of Patterson.

RECOMMENDATION
Motion to Approve Resolution No. 2024-12 proclaiming Arbor Week during March 7-14, 2024, in the City of Patterson.

BACKGROUND
The City of Patterson and many other communities in California are working together to promote and support the importance of California Arbor Week. The City of Patterson understands the importance of trees and its goal is to preserve as many trees as possible to obtain the benefits they supply such as reduced energy costs, increased property values, aesthetics, and clean air.

The City of Patterson also obtained its Tree City USA status in 2016 through the Arbor Day Foundation with the assistance of the Cal-Fire Grant funds secured by the City. This is a nationwide movement that provides the framework necessary for communities to manage and expand their urban forest. This is achieved by meeting four (4) core standards of sound Urban Forestry Management; maintaining a tree department; having a community tree ordinance; and spending at least $2 per capita on Urban Forestry and celebrating Arbor Day.

Currently, the city has an Urban Forestry Division and Parks Division whose primary responsibility is to maintain and preserve over 13,066 street and park trees. However, it is important that the city expands its efforts to the community through education and public outreach.

ANALYSIS

6.7 Packet Pg. 27
Every year during March 7-14, Californians celebrate Arbor Week by planting and maintaining trees within their communities. California Arbor Week helps unite the community and helps educate on the value trees provide to building successful, healthy cities, and neighborhoods.

Every year, the city holds various events for the students who attend the after-school programs at various elementary schools. Food, activity stations, prizes, free giveaways, and educational tree plantings are held.

This year, the Public Works Department partnered up with the Recreation Department and the Patterson Joint Unified School District to organize this year’s Arbor Day event. The event was hosted at Grayson Elementary School this year on March 4, 2024, from 9:00 a.m. to 10:30 a.m.

The elementary school (K-6) students were to learn about the importance of trees and planted six new trees at their school. The Urban Forestry team helped with the tree planting role and taught them about the importance of keeping the community’s trees healthy and maintained. They also displayed city equipment used by the Urban Forestry (i.e., chipper, boom truck, etc.) team so they can learn how trees are maintained.

In addition to the above event, Grayson Elementary school students participated in a Poster Contest as a class where each classroom was able to design a poster themed around Arbor Day and trees, see attached. The contest ran from February 22 - 29, 2024. The winning class received recognition and a pizza party. The winning poster would also be displayed during the Arbor Week period on the City’s website and social media.

FISCAL IMPACT
Funds for this event will be obtained from our Urban Forestry budget. Budget will cover the purchase of trees, prizes, water, and education & outreach materials needed for the event.

SUBJECT: Approve the proposal from NCM Engineering, Corp for the I-5/Sperry Avenue Traffic Interchange: Located between the Westley and Crows Landing Interchanges, authorize staff to enter into a negotiated Consultant Agreement with a not to exceed cost of $1,593,652.45 for the Phase 2 design and authorize the Finance Department to make the necessary budget amendments.

RECOMMENDATION
Motion to Approve the proposal from NCM Engineering, Corp for the I-5/Sperry Avenue Traffic Interchange: Located between the Westley and Crows Landing Interchanges, authorize staff to enter into a negotiated Consultant Agreement with a not to exceed cost of $1,593,652.45 for the Phase 2 design and authorize the Finance Department to make the necessary budget amendments.

BACKGROUND
Interstate 5 (I-5) is a four-lane freeway near the City of Patterson. According to the 2012 traffic counts obtained from the Caltrans website, I-5 carries between 37,000 to 41,000 vehicles per day in the vicinity of Sperry Avenue. For regional travel within western Stanislaus County, I-5 is a major north-south freeway to the west of the City of Patterson limits. I-5 connects to Interstate 580 (I-580), approximately 13 miles to the north of the City of Patterson. I-5 and I-580 provide access to regional employment centers in Pleasanton, San Ramon, and the San Francisco Bay Area. Under Existing Conditions, the interchange of I-5/Sperry Avenue is configured as a tight diamond with a narrow undercrossing for Sperry Avenue and a steep drop in grade next to the northbound on-ramp. All ramps are one lane in width. The existing ramp intersections are stopcontrolled at the off-ramps. The northbound on-ramp operates at a Level Of Service (LOS) ‘F’ during the A.M peak hours and a LOS ‘E’ during the P.M. peak hours. The southbound off6.8 Packet Pg. 33
ramp operates at a LOS ‘C’ during the A.M. peak hours and a LOS ‘F’ during the P.M. peak hours.

The project involves converting the I-5 Southbound (SB) and I-5 Northbound (NB) on/off ramps at Sperry Avenue to signal control with split phasing sequence. The geometry proposed involves modifying the I-5 SB ramps intersection to include an exclusive left and a shared left, through and right lane at the southbound off ramp, an exclusive left lane and a shared left and through lane at the westbound approach and two through lanes with a shared right turn lane at the eastbound approach. At the I-5 NB Ramps intersection, the lane geometry modification involved providing a shared left and through lane and two exclusive right turn lanes at the northbound off ramp, two through lanes and an exclusive right turn lane with a right turn channelized island at the westbound approach and a shared left and through lane and exclusive through lane at the eastbound approach.

Sperry Avenue will be modified to a four-lane roadway (east-west bound) requiring the existing 2-lane bridge over the California Aqueduct to be widened to four-lanes by adding an additional lane on either side of the existing bridge. The outer abutments to accommodate the proposed two additional bridge lanes are existing.

ANALYSIS
A Request For Proposals (RFP) for Engineering and Design Services was prepared and advertised.

Two proposals and estimated fees (based on hourly rates) were submitted by the following firms:

SUBJECT: Approve the proposal from TJKM Transportation Consultants for the 2023 Citywide Traffic Speed Survey and authorize staff to enter into a negotiated Consultant Agreement with a not to exceed cost of $23,040, and authorize the Finance Department to make the necessary budget amendments.

RECOMMENDATION
Motion to Approve the proposal from TJKM Transportation Consultants for the 2023 Citywide Traffic Speed Survey and authorize staff to enter into a negotiated Consultant Agreement with a not to exceed cost of $23,040, and authorize the Finance Department to make the necessary budget amendments.

BACKGROUND
The City of Patterson needs to conduct traffic surveys to update the speed limits citywide. In compliance with California Vehicle Code (CVC) Section 40802, state and local agencies should conduct engineering studies at least once every five, seven or ten years to reevaluate nonstatutory speed limits on segments of their roadways that have undergone significant changes since the last review, such as the addition or elimination of parking or driveways, changes in the number of travel lanes, changes in the configuration of bicycle lanes, changes in traffic control signal coordination, or significant changes in traffic volumes. The effective period of the City of Patterson’s engineering and traffic survey is outdated. A new Citywide engineering and traffic survey needs to be conducted and certified as soon as possible.

Section 2B.13, Speed Limit Sign (R2-1), of California MUTCD 2014 Edition outlines the requirements and procedures to conduct an engineering traffic speed survey.

ANALYSIS
A Request For Proposals (RFP) was prepared and advertised in the Patterson Irrigator, listed on our City website and was distributed through our online posting site CIPList.com. 13 engineering firms received/downloaded the RFP and supporting documentation. 3 exchanges, plan-wells, associations, or other firms received/downloaded the RFP and supporting documentation.
3 proposals and estimated fees (based on hourly rates) were submitted by the following firms:

TJKM Transportation Consultants
Minagar & Associates, Inc.

Parametrix

The proposals received were evaluated as detailed in the RFP. The proposals were screened by a selection committee and rated on understanding of the Project (35%, scored on a 1-10 scale), responsiveness to the RFP (35%, scored on a 1-10 scale) and rates relative to services provided (30%, scored on a 1-10 scale).

Using the Quality Based Selection (QBS) method, the proposals were evaluated in three categories as stated above. All proposals were very clear and concise and showed good understanding of the project, while also meeting the requirements set forth in the RFP. Staff also considered each firm’s hourly rates.

Although all three firms who submitted proposals are capable of completing this project, based on the information listed, staff recommends TJKM Transportation Consultants for the design of this project. QBS methods allow us to negotiate a contract with the highest-ranking firm so that both sides agree on exactly what work is to be completed in order to fulfill the terms relative to scope, schedule, and budget.

FISCAL IMPACT
Staff negotiated with TJKM Transportation Consultants to an agreeable scope and fee of $23,040. Staff recommends awarding the design to TJKM Transportation Consultants for this amount and authorizing the budget amendment to include our standard 10% contingency. $23,040 TJKM Transportation Consultants

BACKGROUND
This project consisted of a new, LEED Certified, 3,270 square foot, ground-up one-story wood framed Administration Building with a laboratory, offices, restrooms, lockers, parking (covered and uncovered), security gates and fencing, and landscaping. The design was completed in July 2020 and was subsequently advertised for construction. This project was first advertised for construction in the summer of 2020. The bids were taken to City Council and rejected based on the cost of the project. The City readvertised for a second time in March 2021. Unfortunately, the two bids received were deemed as non-responsive by the State due to the bid proposal paperwork that was submitted. These bids were also taken to City Council and subsequently rejected.

This Project was advertised for a third time in December 2021 and awarded to Bobo Construction, Inc., on March 15th of 2022.
