MEETING DATE: April 2, 2024
ITEM NO: 5.5
SUBJECT: Adopt Resolution No. 2024-18 implementing a Surplus Personal Property Policy addressing the disposal of City-owned personal property that is no longer needed or usable by the holding department in possession of the property.

RECOMMENDATION
Motion to Adopt Resolution No. 2024-18 implementing a Surplus Personal Property Policy addressing the disposal of City-owned personal property that is no longer needed or usable by the holding department in possession of the property.

BACKGROUND
The City of Patterson (“City”) does not currently have a policy in place addressing donations or other disposal of City-owned personal property. This policy will be limited to the disposal of personal property (ex: equipment, tangible items, furniture, etc.). The disposal of real property owned by the City is governed by the Surplus Lands Act.

ANALYSIS
Sections 37350 and 37351 of the Government Code permit cities to dispose of City-owned personal property for the city’s benefit. Cities have discretion to adopt policies and procedures for the disposal of City-owned personal property, within the parameters of the California Constitution’s prohibition on gifting public funds or things of value. A Surplus Personal Property Policy provides guidance for the disposal of City-owned personal property and ensures that surplus personal property is disposed of in a manner that provides maximum benefit to the City.

FISCAL IMPACT
The only anticipated cost to the City is staff time to facilitate the personal property disposal process outlined in the Surplus Personal Property Policy. The personal property disposal process is financially advantageous for the City because it maximizes revenue from otherwise idle personal property.

POLICY ALTERNATIVES:

The City Council’s options are:

1. Adopt the Resolution without any changes;

2. Adopt the Resolution with changes and revisions; or

3. Reject the Resolution entirely.
