RESOLUTION 2024-20
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PATTERSON
APPROVING TWO AGREEMENTS RELATING TO THE
IVY ROSE AREA OF THE ZACHARIAS MASTER PLAN:
(1) A WATER/SEWER CONNECTION AND SOUND WALL AGREEMENT WITH PROPERTY OWNERS IN THE IVY ROSE AREA; AND (2) AN AGREEMENT WITH
DEVELOPERS OF THE ZACHARIAS MASTER PLAN FOR CONSTRUCTION OF
PUBLIC IMPROVEMENTS
WHEREAS, on August 16, 2022, the Patterson City Council (“City Council”) authorized City staff to file a proposal with the Stanislaus Local Agency Formation Commission to annex approximately 1,375 acres located outside of City limits, known as the “Zacharias-Baldwin Ranch Master Plan Reorganization;” and
WHEREAS, the “Zacharias-Baldwin Ranch Master Plan Reorganization,” commonly known as the Zacharias-Baldwin Ranch Master Plan project (“Master Plan”), is subject to a mail ballot election to be held on April 9, 2024; and
WHEREAS, the “Zacharias Area” of the Master Plan is located north of existing City limits, generally bounded by Zacharias Road to the north, Ward Avenue to the west, and Rogers Road to the east; and
WHEREAS, the Zacharias Area is divided into five (5) development areas; and WHEREAS, the “Ivy Rose Area” is located in the eastern portion of the Zacharias Area adjacent to Ward Avenue and State Route 33. The Ivy Rose Area contains existing residences and agricultural lands; and
WHEREAS, the other four (4) development areas are controlled by the four (4) major developers of the Master Plan (collectively, the “Developers”); and WHEREAS, parcels located within City limits are required to connect to the City water and sewer systems, in accordance with City ordinances, policies, and standards; and WHEREAS, City staff has conducted outreach and met with property owners in the Ivy Rose Area to discuss terms and conditions for connection to the City water and sewer systems and also construction of a sound wall, upon annexation of the Master Plan area into City limits; and WHEREAS, the Developers have agreed to construct certain public improvements for the benefit of the Ivy Rose Area; and
WHEREAS, the purpose of this Resolution is to approve and authorize execution of the following two (2) agreements: (1) the “Zacharias Project Agreement for the Ivy Rose Area” with the Developers of the Master Plan, attached and incorporated hereto as Exhibit A (“Developer Agreement”), and (2) a “Water/Sewer Connection and Sound Wall Agreement” with property {CW136990.3}
owners in the Ivy Rose Area, attached and incorporated hereto as Exhibit B (“Property Owner Agreement”); and
WHEREAS, under the Developer Agreement, the Developers of the Master Plan have agreed to install certain public improvements for the benefit of the Ivy Rose Area, including water lines, sewer lines, and a sound wall; and
WHEREAS, the Property Owner Agreement is a form agreement, to be executed with each property owner in the Ivy Rose Area who is interested in executing the Property Owner Agreement; and
WHEREAS, the Property Owner Agreement is contingent on the Developers and the City executing the Developer Agreement; and
WHEREAS, City staff finds that both agreements are in the interest of orderly development and public health and safety, by integrating property owners in the Ivy Rose Area into the City and providing a framework for future connection to the City water and sewer systems.
NOW, THEREFORE, BE IT RESOLVED by the City of Patterson City Council as follows:
1. The City Council hereby finds that the Developer Agreement and the Property Owner Agreement advance the vision, goals, and buildout of the Master Plan, and further finds that the agreements will advance orderly development of the Master Plan by providing terms and conditions to integrate property owners in the Ivy Rose Area into the City of Patterson.
2. The City Council hereby approves and authorizes the City Manager to execute the Developer Agreement, attached and incorporated hereto as Exhibit A. Any further modifications to the Developer Agreement shall be subject to approval by the City Attorney.
3. The City Council hereby approves and authorizes the City Manager to execute the Property Owner Agreement, attached and incorporated hereto as Exhibit B. Any further modifications to the Property Owner Agreement with individual property owners in the Ivy Rose Area shall be subject to approval by the City Attorney.
