RECOMMENDATION
Motion Adopt Resolution No. 2024-26, A Resolution of the City Council of the City of Patterson, Declaring the Results of the Special Mail Ballot Election Held Tuesday, April 9, 2024, to Confirm the Zacharias-Baldwin Master Plan Reorganization to the City of Patterson.
BACKGROUND
In August 2022, the City Council adopted the Zacharias and Baldwin Ranch Master Plan (“Master Plan”). The Master Plan provides a comprehensive development plan for approximately 1,296 acres located north of City limits and an additional 66 acres located south of City limits. In November 2022, the City filed a proposal with the Stanislaus County Local Agency Formation Commission (“Stanislaus LAFCO”) to annex the areas outlined in the Master Plan.
On July 26, 2023, Stanislaus LAFCO approved the City’s annexation proposal, subject to certain terms and conditions. The required protest proceeding was held on September 20, 2023. The protest hearing failed to yield the necessary level of support to confirm the City’s annexation proposal. The annexation was then subject to a special election of the registered voters in the Master Plan area, which was held by mail ballot on April 9, 2024.
The City and Stanislaus County Registrar of Voters (“Registrar Office”) conducted the Special Mail Ballot Election in compliance with laws governing municipal elections related to annexations. The County Registrar designated the measure to confirm the reorganization proposal as Measure O. There were forty-one (41) registered voters in the affected territory eligible to vote on Measure O. A majority of the votes cast at the election would determine whether the City would proceed to annex the affected territory.
The County Registrar has completed its canvass of the election results, which were in favor of confirming the reorganization proposal. The City has received the County Registrar’s statement of the votes and certification of the election results. Upon adoption of the Resolution, the City Clerk will forward the Resolution to the LAFCO Executive Officer to complete the remaining items prior to formal reorganization of the affected territory to the City of Patterson.
ELECTION RESULTS
Measure O, the measure to confirm the Zacharias-Baldwin Master Plan Reorganization to the City of Patterson, has met the required majority voter approval with 65.52% of the vote in favor of the measure. The Registrar Office received twenty-nine (29) ballots in total, with nineteen (19) votes in favor and ten (10) votes against. Measure O passes with a majority of the votes cast in favor of confirming the reorganization proposal.
FISCAL IMPACT
Total estimated cost for the Special Mail Ballot Election is $18,550 to reimburse the County Registrar Office for providing election services.
