2 3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PATTERSON 4 REJECTING ALL BIDS RECEIVED ON MARCH 1, 2024, FOR THE STREET 5 SWEEPING SERVICES REQUEST FOR PROPOSALS, AND DIRECTING STAFF TO 6 CONDUCT ADDITIONAL EVALUATION FOR THE CITY TO PROVIDE STREET 7 SWEEPING SERVICES THROUGHOUT THE CITY USING ITS OWN RESOURCES 8 9 WHEREAS, The City contracts commercial and residential street sweeping services with 10 Sweeping Corp of America from Milpitas, CA, through June 30, 2028. The contract does not 11 require the contractor to pay prevailing wages; and
12 13 WHEREAS, a Department of Industrial Relations determination was established in October 14 2021, that street sweeping maintenance services constitute public work and are therefore subject to 15 prevailing wage requirements; and
16 17 WHEREAS, according to the City Attorney’s Office, the City’s existing non-prevailing 18 wage contract subjects the City to legal risk. City Manager and Director of Public Works directed 19 Staff to solicit Request for Proposal for Street Sweeping Services that includes a prevailing wager 20 requirement. The Request for Proposal document was reviewed by the City Attorney’s Office, 21 issued in January 2024, and due on March 1, 2024; and 22 23 WHEREAS, City received 2 proposals. The first was from the City’s existing street 24 sweeping contractor, Sweeping Corp of America, and the second from the City’s Public Works 25 Department; and
26 27 WHEREAS, staff recommend that the City Council decline the proposals and authorize 28 staff to conduct further evaluation for the City to provide City-wide street sweeping services with its 29 own force. Staff evaluation of costs associated with labor and materials and the adjustments to the 30 budget would require the item to be brought to Council for consideration at a later date. In the 31 meantime, the City will continue to contract sweeping services with Sweeping Corp of America 32 33 NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Patterson 34 rejects all bids received on March 1, 2024, for the Street Sweeping Services Request for Proposals, 35 and authorizes Staff to conduct additional evaluation for the City to provide street sweeping 36 services throughout the City using its own resources; and 37 38 BE IT FURTHER RESOLVED that the City Manager, or their designee, is hereby 39 authorized and empowered to execute in the name of the City of Patterson all grant documents, 40 including but not limited to, applications, agreements, amendments and requests for payment, 41 necessary to secure grant funds and implement the approved grant project; and 42 43 The foregoing resolution was introduced at a regular meeting of the City Council of the City of Patterson, held on the 7
