RESOLUTION NO. 2024-43
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PATTERSON,
ADOPTING THE REVISED CITY COUNCIL ELECTION DISTRICTS TO INCLUDE
ANNEXED TERRITORIES
WHEREAS, on April 5, 2022, the City Council adopted Ordinance No. 860 adjusting the boundaries of City Council Election Districts to comply with the United States Constitution, California Constitution and the federal Voting Rights Act; and, WHEREAS, On July 26, 2023, Stanislaus Local Agency Formation Commission (LAFCO) approved the City’s annexation proposal, subject to certain terms and conditions. The required protest proceeding was held on September 20, 2023. The protest hearing failed to yield the necessary level of support to confirm the City’s annexation proposal. The annexation was then subject to a special election of the registered voters in the Master Plan area, which was held by mail ballot on April 9, 2024 with the election results in favor of confirming the reorganization proposal; and,
WHEREAS, the Stanislaus County Local Agency Formation Commission (LAFCO) subsequently approved the annexation of the Zacharias-Baldwin Master Plan Reorganization to the City of Patterson; and,
WHEREAS, pursuant to California Elections Code 21623(a), “if the boundaries of a city expand by the addition of new territory, including through annexation of unincorporated territory or consolidation with another city, the council shall add that new territory to the nearest existing council district without changing the boundaries of other council district boundaries”; and WHEREAS, City staff reviewed the City’s current boundaries and recommends the annexed Zacharias-Baldwin territory be absorbed by the nearest existing council district, District A.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Patterson, as follows to wit:
Section 1. That the City Council hereby approves the revised City Council Election Boundaries Map, attached hereto as Exhibit “A” to this resolution, as the official District Map for City Council elections in the City of Patterson.
Section 2. City staff is hereby authorized and directed to work with the Stanislaus County Elections Office/Registrar of Voters (ROV) who shall prepare election ballots consistent with the attached map to conduct any additional acts necessary to permit implementation of these adopted council districts for the election to be held November 5, 2024.
Section 3. The City Council Districts specified in Exhibit A shall remain in effect until modified.
Section 4. This Resolution and its Exhibit shall be published and available on the City website for as long as the City Council Districts approved by this resolution are in effect.
