City Council Agenda Report
TO: Mayor Clauzel and Members of the City Council
FROM: Ken Irwn, City Manager
BY: Fernando Ulloa, City Engineer
MEETING DATE: August 20, 2024
ITEM NO: 6.7
SUBJECT: Reject all bids for the Ward Avenue Overlay Ph II Project and direct staff to readvertise at a later date.

RECOMMENDATION
Motion to Reject all bids for the Ward Avenue Overlay Ph II Project and direct staff to readvertise at a later date.

BACKGROUND
The City has been approved to receive $539,351 of federal funding through the Surface Transportation Block Grant Program (STBGP) for the Ward Avenue Overlay Project. The purpose of the grant is to repair and rehabilitate segments on Ward Avenue, from Las Palmas Avenue to N. 9th Street in Patterson. Ward Avenue is one of the City’s busiest streets and serves the surrounding residential neighborhoods as a main roadway to their destinations. There are several schools located in the vicinity causing heavier traffic volumes in the mornings and afternoons. There are residential homes that back up to this portion of Ward Avenue with downtown being just east of the project area.

This project consists of providing a 2-inch overlay on Ward Avenue from West Las Palmas to North 9th Street. Prior to overlaying, badly damaged pavement areas will be excavated and reconstructed with aggregate base and asphalt concrete. The existing road will be cold planed where tying into the existing road sections and along existing gutter sections prior to the overlay.

Upon completion of the overlay, existing manhole and valve covers will be raised and thermoplastic striping and pavement markings applied.

City Staff is also including the construction of a portion of the Non-Potable Phase 1 Project. This portion of project will install approximately 300 linear feet of 6” non-potable water line to connect the landscaping of the Hammon Senior Center. In recent years, the City of Patterson has been expanding its non-potable water system. This system is designed to provide lower quality water that does not meet state and federal requirements for drinking and direct it to landscape uses. This portion of the Non-Potable Phase 1 project will be moving forward with the overlay project to coordinate the placement of the pipe with the new pavement design. This is an effort to comply with the City Street moratorium guidelines as detailed in City Ordinance No. 840.

ANALYSIS
The design of the Ward Avenue Ph II Project and portion of the Non-Potable Phase 1 Project was completed in the summer of 2024. This project was advertised for construction on the CIP List, the City’s website, and the Patterson Irrigator. Unfortunately, the City only received one bid for this project. As this project utilizes federal funds, the construction project must be completed by contracts awarded to the lowest responsible bidder of a competitive bid process pursuant to 23 CFR 635.104. The single bid received does not constitute a competitive bid. Caltrans only allows local agencies to proceed with a non-competitive bid process under strict guidelines. City Staff reviewed these guidelines as detailed in the Local Area Procedures Manual and determined that to be compliant with federal guidelines the single bid will need to be rejected with the project rebid in the fall.

The one bid received by the City is as follows:

Consolidated Engineering Inc. $580,050.45

FISCAL IMPACT
There is no Fiscal Impact at this time.
