RESOLUTION NO. 2024-50
A RESOLUTION OF THE PATTERSON CITY COUNCIL
TO APPROVE AND AUTHORIZE EXECUTION OF A PURCHASE AND SALE AGREEMENT FOR APN 047-026-026, APPROXIMATELY 18 ACRES
TO SERVE AS THE FUTURE SPORTS COMPLEX
FOR THE VILLAGES OF PATTERSON MASTER PLAN
WHEREAS, on December 12, 2006, the City Council (“City Council”) of the City of Patterson (“City”) adopted Resolution 2006-122 approving a Combined Preliminary and Final Development Plan (“Villages Master Plan”) and other entitlements for the project known as the Villages of Patterson Project (“Villages Project”); and WHEREAS, on December 19, 2006, City adopted Ordinance No. 681, which approved a Development Agreement that applies to properties within the VOP Development Plan. On October 15, 2018, the City approved an Operating Memorandum memorializing certain revisions to facilitate and update the 2006 Development Agreement (collectively, the “Development Agreement”); and
WHEREAS, since 2006, the original major developer sold various parcels within the Villages Project to other developers, with such developers (known as “stakeholders”) assuming certain obligations of the original major developer pursuant to the Development Agreement; and WHEREAS, Phase 1 of the Villages Project includes all lands in the Villages Master Plan south of Olive Avenue; and
WHEREAS, Development in Phase 1 continues advancing, with four (4) stakeholders having developed different sites within Phase 1; and
WHEREAS, the Villages Master Plan contemplates development of a 40-acre detention basin and sports complex at the northeast corner of Sycamore Avenue and Olive Avenue (referred to herein as the “sports complex”); and
WHEREAS, in 2003, the City acquired the first half of the sports complex (APN 047-026- 025), a parcel of approximately 19.3 acres. This parcel serves as a storm drainage basin as part of the City’s drainage system, and also for existing development in the Villages Project; and WHEREAS, the City desires to acquire the remaining land necessary for development of the sports complex, to accommodate new residents and continued buildout of the Villages Project; and

WHEREAS, City staff has negotiated terms with the property owner for acquisition of APN 047-026-026 (the “Property”), a parcel of approximately 18 acres at the corner of Sycamore Avenue and Olive Avenue. The proposed purchase price is $1,186,900; and WHEREAS, City staff recommends that the City Council approve and authorize execution of the attached Purchase and Sale Agreement for the Property attached hereto as Exhibit A (“Purchase Agreement”); and
WHEREAS, the Villages Project was originally analyzed in the Villages of Patterson Environmental Impact Report (SCH No. 2006032043) (“Villages EIR”). The proposed acquisition makes no changes to the Villages Master Plan or Villages EIR, and no further environmental assessment is required for approval of the proposed Purchase Agreement.
NOW, THEREFORE, BE IT RESOLVED that the Patterson City Council hereby approves the attached Purchase Agreement for the Property, authorizes the City Manager to execute the Purchase Agreement subject to any minor revisions approved by the City Attorney, and authorizes the City Manager or his or her designee to perform all acts necessary and incidental to carry out the transaction contemplated herein.
