RESOLUTION NO. 2024-59
A RESOLUTION OF THE CITY OF PATTERSON CITY COUNCIL
APPROVING DEVELOPMENT IMPACT FEES AND NEXUS STUDIES FOR CITY HALL, THE CITY’S CORPORATION YARD, RECREATION FACILITIES,
PARKS, AND TRANSPORTATION IMPROVEMENTS
WHEREAS, Government Code Section 66000 et seq., known as the “Mitigation Fee Act” or “AB 1600,” authorizes local agencies to collect fees to mitigate the impacts of new development for public facilities and improvements, as amended in 2022 by Assembly Bill 602 (codified at Government Code § 66016.5); and
WHEREAS, the City of Patterson (“City”) charges development impact fees in accordance with the Mitigation Fee Act and Chapter 3.64 of the Patterson Municipal Code; and WHEREAS, the City requires dedication of parkland or payment of fees in-lieu thereof, pursuant to Government Code § 66477 (known as the “Quimby Act”) and Chapter 16.44 of the Patterson Municipal Code; and
WHEREAS, the City’s existing development impact fees for City Hall, its Corporation Yard, Recreation Facilities, Parks, and Transportation Improvements are outdated and have not been subject to a comprehensive review and update since 2006 (Resolution No. 2006-19); and WHEREAS, the City has experienced considerable growth since the existing development impact fees and corresponding nexus studies were last adopted, as reflected by the continued buildout of the City of Patterson General Plan, the West Patterson Business Park Master Plan (adopted 2003), the Villages Master Plan (adopted 2006), the West Patterson Business Park Expansion Master Plan (adopted 2012), and the Zacharias & Baldwin Ranch Master Plan (adopted 2022); and
WHEREAS, the purpose of the proposed development impact fee updates is to prevent new development from adversely impacting levels of service provided by the City’s public facilities, and to require new development to contribute its fair share to the cost of public facilities and improvements needed to offset the impacts of new development; and WHEREAS, Willdan Financial Services, Inc. has prepared the nexus study for updates to the development impact fees for City Hall, Corporation Yard, Recreation Facilities, and Parks, attached and incorporated hereto as Exhibit A (“Willdan Study”). The Willdan Study also contains the Quimby Act parkland fee to charge to subdivisions, in accordance with Chapter 16.44 of the Patterson Municipal Code; and
WHEREAS, the Advanced Mobility Group, Inc. has prepared the nexus study for the update to the development impact fee for transportation facilities and improvements, known as the City’s “Regional Traffic Impact Fee,” attached and incorporated hereto as Exhibit B; and WHEREAS, in accordance with Government Code § 66001, based on the methodologies and findings contained in the nexus studies, the City Council finds that the fees are (i) for the purpose of offsetting the impacts of new development to maintain adequate levels of service, (ii) the public facilities toward which the fees will be used are identified in the nexus studies and such other plans or documents referenced therein, (iii) there is a reasonable relationship between the {CW142280.1}
fees and the types of development projects on which the fee imposed, and (iv) there is a reasonable relationship between the fees and the need for the public facilities toward which the fees will be used; and
WHEREAS, in the form and manner required by law, notice of the proposed development impact fees has been provided for this public hearing, and all nexus studies have been made available for review in advance of the public hearing; and WHEREAS, the City Council desires to encourage construction of new development projects in the City and to promote economic development; and WHEREAS, the City Council finds that the development impact fee schedules, as described in the nexus studies, are based on a fair and equitable methodology for providing adequate public facilities commensurate with projected levels of new development in the City.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Patterson as follows:
1. The findings set forth in the recitals and the attached nexus studies are hereby incorporated and made part of this Resolution.
2. The City Council hereby approves the nexus study for City Hall Facilities, Corporation Yard Facilities, Recreation Facilities, and Parks, attached hereto as Exhibit A. 4.
