ITEM NO: 10.1
SUBJECT: Adopt Resolution No. 2024-64 to Approve the Subdivision Improvement Agreement with Self-Help Enterprises and to accept the Final Map for Phase 3 of the Stonegate Shire Project.
RECOMMENDATION
Motion to Adopt Resolution No. 2024-64 to Approve the Subdivision Improvement Agreement with Self-Help Enterprises and to accept the Final Map for Phase 3 of the Stonegate Shire Project.
BACKGROUND & ANALYSIS
The Stonegate Shire Project consists of three (3) phases and a total of two hundred fifty-six (256) dwelling units, located within the Villages of Patterson Master Development Plan (“VOP Development Plan”). Self-Help Enterprises (“Self-Help”) has previously obtained subdivision and design review approvals for Phases 1 and 2 of the Stonegate Shire Project. Phase 1 involved 41 new single-family dwelling units, and Phase 2 involved 138 new multi-family units. The Stonegate Shire units carry out the affordable housing obligations of the VOP Development Plan and the Villages Development Agreement. The units developed will be restricted to qualifying households.
Phase 3 will involve development of 77 lots in the southwestern quadrant of the VOP Development Plan. This Resolution would approve the Subdivision Improvement Agreement and accept the Final Map for Phase 3 of the Stonegate Shire Project, creating 77 new lots in the Self-Help development area.
Divisions of land are subject to the requirements and procedures of the Subdivision Map Act and the City’s subdivision ordinance relating to the filing, approval, and recordation of subdivision maps (the “Subdivision Laws”). The City approved the Tentative Map for Stonegate Shire Project in 2006 in conjunction with other entitlements relating to the VOP Development Plan.
Pursuant to project’s conditions of approval, Self-Help is required to install certain public improvements to support development of the subdivision, including but not limited to: streets, alleys, water mains, sanitary sewers, storm drain systems, sidewalks, bike paths, and other rightsof-way for public use (the “Improvements”).
Under the Subdivision Laws, Self-Help must either install the Improvements prior to the City’s acceptance and recording of the Final Map, or alternatively, execute a Subdivision Improvement Agreement. A Subdivision Improvement Agreement allows a Self-Help to install public improvements after approval and recordation of a final map and also establishes the security device to guarantee completion of the Improvements. Self-Help is entering into the attached Subdivision Improvement Agreement with the City to guarantee completion of the necessary Improvements and to record the Phase 3 Final Map for the Stonegate Shire Project.
The Subdivision Improvement Agreement establishes Self-Help’s Improvement obligations and ensures completion of the Improvements. Adoption of this Resolution approves the attached Subdivision Improvement Agreement, accepts the Phase 3 Final Map for the Stonegate Shire Project, and would allow Self-Help to proceed with construction of the Improvements.
FISCAL IMPACT
There is no budget impact to the City. This action will pave the way for construction of new residential units and related public improvements for Phase 3 of the Stonegate Shire Project.
ALTERNATIVE ACTIONS
The City Council’s options regarding the Resolution include:
. Adopt Resolution No. 2024-64;
2. Continue the item to a later meeting of the City Council and provide direction to staff for any changes; or
3. Reject Resolution No. 2024-64.
