2 3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PATTERSON UPDATING THE CITY’S USER 4 FEE SCHEDULE AS IDENTIFIED IN THE CITY-WIDE COMPREHENSIVE USER FEE STUDY DATED 5 SEPTEMBER 2019
6 7 The City Council of the City of Patterson (hereafter referred to as the “City Council”) does 8 resolve as follows:
9 10 WHEREAS, the City of Patterson, “City” provides various services to the public, the cost 11 of which are generally paid by the City, unless for certain services, the City recovers the cost in 12 whole or in part from the person requesting the service by charging a user fee; and 13 14 WHEREAS, the City of Patterson Municipal Code and other applicable laws also allow 15 the City Council to amend these fees from time to time by resolution to reflect the changing 16 and actual costs of this process; and
17 18 WHEREAS, in accordance with Government Code section 66018, the notice was 19 published at least (10) days prior to the public hearing on December 17,2024, in a newspaper of 20 general circulation within the City, which is published at least once a week; and 21 22 WHEREAS, the City Council desires to adopt the changes to the schedule of user fees to 23 recover costs necessary to provide the service for which the user fees are proposed to be 24 rendered.
25 26 NOW, THEREFORE BE IT RESOLVED, DETERMINED, AND ORDERED BY THE CITY 27 COUNCIL FOR THE CITY OF PATTERSON, AS FOLLOWS:
28 29 1. Authorize the new User Fees and also increases to previously approved User Fees based 30 on CPI as set forth in the Comprehensive User Fee Study dated September 2019 31 attached hereto, and made a part hereof are hereby adopted and shall remain in effect 32 until amended by Resolution of the City Council.
33 34 2. The revenues raised by payment of the user fees established by this Resolution shall be 35 used to fund the reasonable cost of providing the services of which the fees are 36 charged.
37 38 3. On July 1st of each year, the City Manager, or his or her designee, shall annually update 39 the user fees set forth in the attached schedule based on the San Francisco Bay Area 40 Consumer Price Index (CPI) for the previous year. The updated fees shall be rounded to 41 the nearest $1 as appropriate. The annual update shall be subject to City Council’s 42 approval prior to implementation. Upon City Council’s approval, the updated fees shall 43 become effective the following January 1st. City Council hereby directs the City {CW107356.1}
44 Manager to submit an updated user fee study to the City Council at least every five (5) 45 years following adoption of this Resolution.
46 47 4. The user fees set forth in the schedule of user fees and established by this Resolution 48 shall become effective February 15, 2025, which is 60 days after adoption as required. 49 50 The foregoing resolution was passed by the City Council at a regular meeting held on the 51 17th day of December 2024, and the resolution adopted by the following roll call vote:
