8. Public Hearing
8.1. Planning Department - Adopt Resolution No. 2025-17, of the City Council of the City of Patterson, Approving Vesting Tentative Subdivision Maps “A” and “B”, and the associated Conditions of Approval, over 95.08 Acres of Land, consisting of 506 Lots, one High-Density Parcel, and Multiple Remainder Parcels for Public Dedication, Also Known as the Keystone Ranch Development Area.
Deputy City Attorney White reviewed his report and presentation.
Matt Francois, Land Use Attorney with Rutan & Tucker, LLP representing Keystone Ranch, LLC - Expressed appreciation to Council and staff. Supported project approval but objected to conditions making it economically infeasible, particularly the requirement to complete the City Park Pond recharge facility prior to permits. Argued this violates the Housing Crisis Act, constitutes a regulatory taking, and contradicts prior city planning documents. Cited legal risks, excessive costs, and inconsistencies in water usage data. Requested Council revise conditions per his submitted letter to avoid potential litigation.
At 9:33 p.m. Mayor Clauzel opened the Public Hearing
Milt Trieweiler, Stanislaus County Resident - Speaker expressed sadness over the project’s outcome, citing harm to local students, loss of farmland, and outside interests driving development for Bay Area residents rather than the local community.
Angela Bodas, Patterson Resident - Speaker supported the city and opposed new housing, citing overcrowded schools, traffic concerns, and poor planning. Urged delay in development until infrastructure improves.
At 9:40 p.m. there being no further comments, Mayor Clauzel closed the Public Hearing.
Staff responded to statements made by Keystone representatives.
City Council discussed the following:
• Developer fees and mitigation: Keystone will pay required development fees but is disputing the City’s impact fee schedule in separate litigation. • Sewer infrastructure: Concerns over reliance on a temporary sewer line; long-term plan involves connection to the North Trunk Line.
• Recharge basin requirement: Objection to condition requiring full construction of a City of Patterson Page 5 Updated 4/9/2025 4:40 PM
$20 million basin before building permits can be issued; developer argues this contradicts original phasing plans.
• Water supply and groundwater limits: Staff noted state-mandated reductions in groundwater use; new development must offset water use through recharge. • Environmental review (CEQA): Developer claimed no new impacts; staff argued updated conditions and regulations require additional review. • Equity and legal risk: Developer raised concerns about unfair cost burden and potential legal exposure to the City.
• Affordable housing: Developer prefers paying in-lieu fees over constructing affordable units; no formal proposal submitted.
At 11:00 p.m. Councilmember Mora motioned to recess the public hearing to reconvene to closed session. The motion was seconded by Mayor Pro Tem Roque and unanimously approved by a 5-0 roll call vote.
At 11:29 p.m. Mayor Clauzel called the meeting back to order.
Mayor Clauzel motioned to deny Resolution No. 2025-17 of the City Council of the City of Patterson, rejecting vesting tentative map subdivisions A and B and associated conditions of approval based on the following findings:
• The 2024 Groundwater Sustainability Plan (GSP) and its Pumping Reduction Plan represent changed conditions and new information, requiring a Supplemental Environmental Impact Report (EIR) under CEQA Guidelines Section 15162. • The applicant has declined to adopt mitigation measures to address the project’s environmental impacts.
• Under the 2024 Groundwater Sustainability Plan (GSP), the city cannot increase its lower aquifer groundwater pumping to supply the Zacharias master plan due to the pumping reduction requirements of the 2024 Groundwater Sustainability Plan (GSP), the applicant has declined to provide surface water supplies in sufficient quantities to offset the increased water demands of the vesting tentative map. • The city finds that the updated requirements of the 2024 Groundwater Sustainability Plan, including the pumping reduction requirements applicable to the city, constitute change circumstances and new information pursuant to CEQA Guidelines Section 15162.
• Further, the project proponent has stated that today's hearing that they are not willing to agree to mitigation measures that would reduce significant effects arising from the updated GSP requirements pursuant to Government Code Section 66473.7, the city is prohibited from approving a tentative map for development, which is unable to provide a will serve letter agreeing to supply water to the development. • Accordingly, pursuant to CEQA Guidelines Section 15162 (b), the city is required to prepare a supplemental EIR.
The motion was seconded by Mayor Pro Tem Roque and unanimously approved by a 5-0 roll call vote.
