2 3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PATTERSON, 4 APPROVING THE STATE DEPARTMENT OF TRANSPORTATION (CALTRANS) 5 PROGRAM SUPPLEMENTAL AGREEMENT NO. F039 SPERRY AVENUE BIKE & 6 PEDESTRIANS IMPROVEMENTS: BETWEEN AMERICAN EAGLE AVENUE AND 7 BALDWIN ROAD PROJECT, FEDERAL PROJECT NUMBER CML-5244(044), AND 8 AUTHORIZING THE CITY MANAGER TO EXECUTE THE AGREEMENT AND ALL 9 FUTURE DOCUMENTS FOR THIS PROJECT ON THE CITY’S BEHALF 10 WHEREAS, the City of Patterson has been approved to receive $109,000. of funding 11 through the Congestion Mitigation and Air Quality Improvement Program (CMAQ) for Sperry 12 Avenue Bike & Pedestrian Improvements Project.
13 WHEREAS, this new Class I Bike Path is part of a continuous effort to increase pedestrian 14 safety and reduce emissions within the City of Patterson; and 15 WHEREAS, in order to receive funds from Caltrans, the City Council must authorize an 16 official to execute a Program Supplemental Agreement. This agreement sets forth the 17 requirements for use of the Federal funds. Caltrans requires that this type of agreement be 18 executed for each project by the agency receiving the funds; and 19 WHEREAS, once the agreement is signed, Caltrans will issue an “Authorization to 20 Proceed” which allows the City to proceed with the work for the project. 21 WHEREAS, this item does not carry any fiscal impacts with it. The total federal 22 funding for the project is currently $109,000. Each phase of work will be brought before the 23 Council at a later date with a clear financial breakdown and request for contract approval. 24 NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Patterson 25 does hereby:
26 1. Approve the State Department of Transportation (Caltrans) Program Supplemental 27 Agreement No. F039 for Sperry Avenue Bike and Pedestrian Improvements; between 28 Sperry Avenue from American Eagle to Baldwin Road Project. Authorizes the City 29 Manager to execute the agreement, conduct all negotiations, execute and submit all 30 documents including, but not limited to applications, agreements, reports, insurance, 31 payment requests and so on, which may be necessary for the completion of the 2 1 aforementioned project on behalf of the City.
