A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PATTERSON
SETTING A PUBLIC HEARING FOR THE PROPOSED RATE INCREASE
ASSOCIATED WITH SOLID WASTE COLLECTION SERVICES, CITY PROGRAMS & MAINTENANCE, AND STATE OF CALIFORNIA RECYCLING MANDATES, AND ALSO AUTHORIZING THE PROPOSITION 218 NOTICE PROCEEDINGS WHEREAS, solid waste service in the City of Patterson is provided in accordance with Chapters 6.12, 6.13, 6.14, and 6.15 of the Patterson Municipal Code; and WHEREAS, by previous resolution the City Council has set rates, fees, and charges for solid waste management services and related programs and maintenance; and WHEREAS, based on all documents, studies, reports, and testimony associated with this matter, the City Council is proposing increases to the rates, fees, and charges for solid waste management services and related programs and maintenance; and WHEREAS, increases to solid waste rates are subject to Proposition 218 (Article XIII D of the California Constitution) and Government Code § 53750 et seq.; and WHEREAS, the City Council has retained Bartle Wells Associates for assisting with the City’s Solid Waste Rate Study and mailing of notices to property owners and ratepayers pursuant to the requirements of Proposition 218; and
WHEREAS, the purpose of this Resolution is to set the public hearing for the proposed rate increase, as provided in the corresponding rate study and directed by the City Council, and to further to authorize the distribution of all notices as required by law.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF PATTERSON CITY COUNCIL AS FOLLOWS:
Section 1. Calling a Public Hearing. Pursuant to Section 6 of Article XIID of the California Constitution, a public hearing is hereby called on JUNE 17, 2025 AT 7:00 P.M at the City Council Chambers (Patterson City Hall, 1 Plaza, Patterson, CA 95363) for the proposal to increase rates, fees, and charges for solid waste management services and related programs and maintenance.
Section 2. Notice and Conduct of Public Hearing. The public hearing on the proposal to increase rates, fees, and charges for solid waste service consists of a mailed notice distributed to the property owners and ratepayers of record in the City’s service area, as of Stanislaus County’s last equalized assessment roll and the City’s latest ratepayer database. Each eligible property owner and ratepayer of record has the right to submit a written protest in opposition to the proposed rates, fees, and charges and may do so by mail or in person to the City Clerk not later than the conclusion of the public hearing. At the public hearing, the City Council shall consider all protests against the proposed rates, fees, and charges. If written protests against the proposed fee or charge are 4902-0403-4611, v. 1
presented by the majority of owners of the identified parcels, the City Council shall not impose the rate increase.
Section 3. Authorization to City Clerk. The City Clerk is hereby authorized and directed to give notice of the public hearing in all forms and methods as required by law.
The foregoing resolution of the City Council of the City of Patterson was passed by the City Council at a regular meeting held on the 15th day of April, 2025, by ______________, who moved its adoption, which motion was duly seconded by _______________, and the resolution adopted by the following roll call vote:
