RESOLUTION NO. 2025-19
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PATTERSON,
APPROVING THE ABANDONMENT OF THE UNUSED STORM DRAIN EASEMENT LOCATED WITHIN APN 021-085-036
WHEREAS, the Storm Drain Easement to be vacated was originally granted to the City of Patterson and recorded by Stanislaus County Recorder’s office on September 2, 2010, Document No. 2010-0078741. The City Council of Patterson has considered the abandonment of this storm drain utility easement located within APN 021-085-036 on the Southeast corner of the basin to 539.70 feet West of the southerly line;
WHEREAS, the storm drain facilities are needed as part of the Westridge Business Park and were installed in separate easement and dedicated to the City of Patterson. The storm drain easement considered for abandonment was not being used; therefore, not needed for the conveyance of utilities, does not constitute a gift or conveyance of property in any way unethical or unlawful, and does not violate the provisions of the California Land Surveyors Act or any other statute; and
WHEREAS, a Public Meeting was held May 20, 2025 to receive public comments.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Patterson, California, hereby approves the abandonment of the unused Storm Drain Easement within the parcel recorded as APN 021-085-036 as described in Exhibit “A” (Legal Description of Storm Drain Easement to be Vacated by the City of Patterson) and depicted on Exhibit “B” (Storm Drain Easement Vacation, City of Patterson), attached hereto.
The foregoing resolution was introduced at a regular meeting of the City Council of the City of Patterson held on the 20th day of May 2025, by ______________, who moved its adoption, which motion was duly seconded by __________________, and it was upon roll call carried and the resolution adopted by the following roll call vote:
