FROM: Fernando Ulloa, City Manager
BY: Mike Willett, Public Works Director
MEETING DATE: June 17, 2025
ITEM NO: 6.9
SUBJECT: Adopt Resolution No. 2025-40 Approving the Measure L Master Funding Agreement between the City of Patterson and Stanislaus Council of Government (StanCOG) for Fiscal Years 2025-2030 and Authorize the City Manager or his Designee to Execute the Agreement.

RECOMMENDATION
Motion to Adopt Resolution No. 2025-40 Approving the Measure L Master Funding Agreement between the City of Patterson and Stanislaus Council of Government (StanCOG) for Fiscal Years 2025-2030 and Authorize the City Manager or his Designee to Execute the Agreement.

BACKGROUND
On November 8, 2016, the voters of Stanislaus County approved Measure L, thereby authorizing the Stanislaus Council of Governments (StanCOG), acting as the Stanislaus County Transportation Authority, to administer the proceeds from the one-half cent transaction and use tax (“Measure L”).

The approved measure provides funding for local street and road improvements, street and signalization, pedestrian, bicyclist, and driver safety improvements. The duration of the Measure L sales tax will be 25 years from the initial year of collection, which began April 1, 2017, with the tax to expire on March 31, 2042, and the City of Patterson is a recipient of Measure L Funds.

ANALYSIS
The Measure L Master Funding Agreement delineates the requirements of the Measure L funds that are allocated to the jurisdictions within Stanislaus County for local streets and roads, traffic management and bike and pedestrian improvements, (collectively referred to as “Local Control Funds”) and Transit Provider funds for Transit Services, as authorized by the Measure L Expenditure Plan.

Each of the member agencies of StanCOG (Stanislaus County and the cities of Ceres, Hughson, Modesto, Newman, Oakdale, Patterson, Riverbank, Turlock, and Waterford) will be required to enter into the Measure L Master Funding Agreement prior to receiving Measure L fund disbursements.

Attached for Council review and approval is the Measure L Master Funding Agreement. The term of the Measure L Master Funding Agreement is five (5) years from July 1, 2025, through June 30, 2030. The new agreement is similar to the expiring agreement with the exception of a new element in Section 5.A. StanCOG Duties and Obligations that addresses language that the Policy Board added to the agreement.
"5. StanCOG shall provide a report, at least quarterly, to standing committees and Board of Directors of the 1% for the Public Awareness and Outreach Program which shall include an accounting of Measure L revenues and expenditures."

FISCAL IMPACT
None at this time. All revenues received by the city as part of Measure L are allocated among the categories specified under Measure L. All projects are included in the City’s Capital Improvement Plan and reviewed and approved as part of the budget process.
