RESOLUTION NO. 2025-51
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PATTERSON,
APPROVING THE ABANDONMENT OF EXCESS RIGHT-OF-WAY
LOCATED WITHIN APN 047-031-051
WHEREAS, 59.5 feet of Right-of-Way was originally granted to the City of Patterson in Book 56 of Parcel Maps, Page 96 and recorded by Stanislaus County Recorder’s office on April 16, 2014, Document No. 2014-0023413. During the development of the Sycamore Ranch Subdivision, it was determined that the Right-of-Way along Olive Avenue exceeded the necessary width for public use;
WHEREAS, the City Council of Patterson has considered the abandonment of 16.5 feet of the Right-of-Way located on the Northeasterly corner of Lot 74 on Olive Avenue to the property owners of APN # 047-031-051. The portion of the Right-of-Way proposed for abandonment has been deemed excess, is not required for current or future public use, and its relinquishment does not constitute an unlawful or unethical gift of property, nor does it violate the California Land Surveyors Act or any other applicable statute;
WHEREAS, a Public Meeting was held July 15, 2025 to receive public comments.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Patterson, California, hereby approves the abandonment of 16.5 feet of the Right-of-Way on the Northerneaserly corner of Lot 74 to the property owners of APN # 047-031-051, as described in Exhibit “A” (Legal Description of Vacation of Portion of Olive Avenue) and depicted on Exhibit “B” (Right of Way Vacation), attached hereto.
The foregoing resolution was introduced at a regular meeting of the City Council of the City of Patterson held on the 15th day of July 2025, by ______________, who moved its adoption, which motion was duly seconded by __________________, and it was upon roll call carried and the resolution adopted by the following roll call vote:
