SUBJECT: Approve Resolution No. 2025-53, Authorizing the City Manager to accept the Dedication of Right-of-Way (ROW) for public use for Parcel # 048- 047-028.
RECOMMENDATION
Motion to Approve Resolution No. 2025-53, Authorizing the City Manager to accept the Dedication of Right-of-Way (ROW) for public use for Parcel # 048-047-028.
BACKGROUND
Due to an error in the previously approved Lot Line Adjustment Certificate of Compliance, filed for record January 11, 2019 as Document No. 2019-001537, the applicant for parcel # 048-047- 028 is now dedicating the required frontage right-of-way in fee and title. The previously approved legal description did not address the right of way to the centerline of the road. The right of way dedication is shown on the attached Exhibit A, and Exhibit B.
ANALYSIS
The applicant is dedicating this right of way to remedy a previous error. This does not constitute a gift or conveyance of property in any way unethical or unlawful and does not violate the provisions of the California Land Surveyors Act or any other statute.
FISCAL IMPACT
No fiscal impact is associated with this approval.
