Re: Patterson Irrigation District Comments on VOP Olive Avenue - Vesting Tentative Map
To Whom It May Concern:

This letter is sent on behalf of Patterson Irrigation District (PID) in response to your April 5, 2025, request for written comments on the application for a vesting tentative subdivision map submitted by BMC Enterprise LLC for the VOP Olive Avenue subdivision (Project). PID has reviewed the vesting tentative subdivision map for the Project and provides the following comments.

More broadly, the Draft Environmental Impact Report prepared for the Villages of Patterson Development Plan Project (DEIR), of which the Project is a component, contemplates that the entirety of PID's Laterals 3 North and 4 North will be piped underground and placed in culverts. To date, no section of Lateral 4 North has been relocated as required by the DEIR and no relocation is contemplated by this Project.

Specifically, the DEIR includes the following relevant provisions:
> "The Patterson Irrigation District Laterals 3 North and 4 North currently run uncovered through the project site. They would be piped underground in irrigation easements along a portion of N. 1st Street and Olive Avenue and the proposed Haynes Way and Fishman Avenue, respectively, through the project site.

They would continue to serve agricultural operations to the north and east of the project site." (DEIR, pg. II.17)

• "The portions of the Patterson Irrigation District's (PID) Laterals 3 North and 4 North that serve agricultural operations on the project site would be placed in culverts within 25-foot-wide irrigation easements. The Lateral 3 North culvert would be placed in an easement under the Haynes Way right-of-way and the Lateral 4 North culvert would be placed in an easement under the Garcia Way right-of-way and the Fishman Avenue right-of-way." (DEIR, pg. III.C.14) As situated, PID's Lateral 4 North runs through the Project area as an earth-lined above- ground water conveyance system with several turnouts that service nearby lands. As a result, Lateral 4 North will need to be relocated in order to accommodate both the Project and PID.

PID intends to design the alignment of the relocated Lateral 4 North to follow the roads proposed in the Villages of Patterson Master Plan area, including temporary facilities needed for the various phases of development. PID will require the following as a condition of such relocation with respect to each phase of development of the Villages of Patterson Master Plan area:
• Developer shall inter into a letter of agreement with the Patterson District for the deposit for the review of plans, establishment of agreements with the developer and the city, and the engineering required for the development of the pipeline alignment of the project
• Relocation of any existing PID facilities must be accompanied by new easements recorded with Stanislaus County prior to PID approving any said relocation. • The relevant developer shall enter into a Perpetual Agreement for Annual Sediment Clean-Up with PID and the City, as the relocated laterals will require cleaning from time to time. This agreement must be executed prior to PID approving relocation of any of its laterals.
• The relevant developer must enter into an Agreement to Relocate Irrigation Facilities and Establish Public Utility Easement with PID, that will require, among other things: (1) reimbursement to PID for any and all cots for plan review and agreement development, (2) relocation of PID's facilities at no cost to PID, and (3) 25-foot-wide easement areas. This agreement must be executed prior to PID approving relocation of any of its laterals.

PID looks forward to working with the developers of the Villages of Patterson Master Plan area and City to ensure that District facilities remain safe, functional, and reliable. Please contact the District office with further questions or comments.
