CITY COUNCIL

AGENDA REPORT
TO: Mayor Clauzel and Members of the City Council
FROM: Fernando Ulloa, City Manager
BY: Nubia Goldstein, City Attorney
MEETING DATE: June 30, 2026
ITEM NO: 5.1
SUBJECT: Discussion and action to select a method to fill a City Council vacancy due to the resignation of Councilmember Jessica Romero, and potential action on an immediate appointment to fill the vacancy.

RECOMMENDATION
It is recommended that the City Council fill the vacancy created by Councilmember Jessica Romero’s resignation by appointment. If the City Council elects to proceed by appointment, it may establish an application and selection process or make an immediate appointment of an eligible Individual.

BACKGROUND
Councilmember Jessica Romero informed City Staff that she resigned from the office of District B of the City Council, effective June 16, 2026. Upon Councilmember Romero’s resignation, her seat as District B Councilmember is vacant. The District B Councilmember seat is up for election in November 2026.

DISCUSSION
Pursuant to California law, when a City Council seat becomes vacant, the City Council must either appoint an individual to serve on the City Council or call a special election, within sixty (60) days of the vacancy.1 For Councilmember Romero’s resignation date of June 16, 2026, the deadline to fill the vacancy by appointment or a call for a special election is August 15, 2026.

In this case, the City Council is unable to call a special election to fill the District B vacancy due to the statutory timing requirements and the proximity of the next regular election for that seat. A special election must be held on the next established election date that is at least 114 days after 1 Gov. Code, § 36512.

5.1 Packet Pg. 3
the call of the special election.3
Given that timing, the special election would occur at the same general election at which the District B Councilmember seat is already scheduled to be filled.

Because the seat is already scheduled to appear on the November 3, 2026 ballot, the County has advised that the City cannot qualify for a separate special election.

City staff recommends that the City Council fill the District B Councilmember vacancy by appointment because a special election is not available.

If the City Council chooses to fill the vacancy by appointment, the appointed councilmember will serve for the remainder of Councilmember Romero’s term, which expires in November 2026.4 Applicants must be eligible to serve as the District B City Councilmember. To be eligible, an applicant must be at least eighteen (18) years old, reside in District B, and otherwise be qualified to hold office.5
If the City Council desires to fill the vacancy by appointment, the Council may make an immediate appointment or, alternatively, establish an application process. The Council make also elect to an alternative process of its own choosing to fill the vacancy by appointment.

If directed, City staff will prepare an application and solicit applications from interested persons in July 2026 as directed by the City Council.

FISCAL IMPACT
If the City Council calls a special election to fill the vacancy, the City must bear the cost of the special election. The costs associated with the appointment will be staff time and costs of publication of the notice of the vacancy.
3 Id.
4 Since the vacancy occurred in the second half of Councilmember Romero’s term, the appointed councilmember serves the remained or Councilmember Romero’s term. (Gov. Code, § 36512) 5 Gov. Code, § 36502
