CITY COUNCIL

AGENDA REPORT
TO: Mayor Clauzel and Members of the City Council
FROM: Fernando Ulloa, City Manager
BY: Nubia Goldstein, City Attorney
MEETING DATE: August 3, 2026
ITEM NO: 5.1
SUBJECT: Discuss Candidate Interviews and Consider Approving Resolution No. 2026- 51 to Appoint an Eligible Candidate to Fill the Vacant District B City Council Seat.

RECOMMENDATION
Discuss Candidate Interviews and Consider Approving Resolution No. 2026-51 to Appoint an Eligible Candidate to Fill the Vacant District B City Council Seat.

BACKGROUND
Councilmember Jessica Romero informed City Staff that she resigned from the office of District B of the City Council, effective June 16, 2026. Upon Councilmember Romero’s resignation, her seat as District B Councilmember is vacant. The District B Councilmember seat is up for election in November 2026.

At its June 30, 2026, special meeting, the City Council determined to fill the vacancy by appointment and directed staff to solicit and accept applications from interested District B residents, and to return with the applications for Council interviews and consideration of an appointment.

DISCUSSION
A. Notice of Application.

The City Clerk posted a Notice of Intention to Appoint to the City’s website on July 1, 2026, together with the application materials. Staff published the vacancy announcement on social media and the Patterson Irrigator. Hard copies of the Notice were posted on the Bulletin Board at City Hall, and the Bulletin Board of the Patterson Branch Library. Outreach specifically identified the District B residency requirement.

B. Applications Received.

The application period opened on July 1, 2026, and closed on July 28, 2026, at 5:00 p.m. At the close of the application period, staff received complete applications from the following candidates:

1. Tito Valdespino

2. Chinyere Nnodim Jack
Redacted versions of the applications received are provided as Attachment 2.

C. Eligibility
To be eligible for appointment, an applicant must be at least eighteen (18) years of age, be a registered voter residing in District B, and otherwise be qualified to hold office. Staff has confirmed the District B residency and voter registration status of each applicant with the County Elections Office.

D. Interview and Selection Process
Candidates were individually interviewed by City Councilmembers in a two-two-one format prior to this meeting to comply with the Brown Act. A standardized list of questions was circulated to the City Council and used consistently for all candidates.

At this meeting, the Council may discuss the candidates and their interview rankings in open session. The candidates have been asked to attend and answer any follow-up questions.

Following deliberations, the Council may, by majority vote, adopt a resolution appointing the selected candidate to the District B City Council seat.

If the Council appoints a candidate, the appointment will be effective upon the appointee taking the oath of office, which is anticipated to occur at the next regular City Council meeting on August 18, 2026 or at this meeting if the Council so directs.

The Council retains discretion not to make an appointment from the current applicant pool.

Given that a special election is not available and that the statutory deadline is August 15, 2026, the Council should be aware that declining to appoint at this meeting leaves limited time to conduct any further process. Should the Council wish to consider additional candidates, staff recommends that the Council set a date certain for a special meeting in advance of the deadline.

FISCAL IMPACT
Filling the vacancy by appointment results in costs associated with staff time required to administer the appointment process.
