CITY COUNCIL

AGENDA REPORT
TO: Mayor Clauzel and Members of the City Council
FROM: Fernando Ulloa, City Manager
BY: Nubia Goldstein, City Attorney
MEETING DATE: August 13, 2026
ITEM NO: 5.1
SUBJECT: Consider Adopting Resolution No. 2026-55 Appointing the Candidate with the Highest Interview Score to Fill the Vacant District B City Council Seat.

RECOMMENDATION
It is recommended that the City Council adopt Resolution No. 2026-55 appointing the eligible candidate with the highest interview score to fill the vacant District B City Council seat.

BACKGROUND
Councilmember Jessica Romero informed City Staff that she resigned from the office of District B of the City Council, effective June 16, 2026. Upon Councilmember Romero’s resignation, her seat as District B Councilmember is vacant. The District B Councilmember seat is up for election in November 2026.

At its June 30, 2026, special meeting, the City Council determined to fill the vacancy by appointment and directed staff to solicit and accept applications from interested District B residents, and to return with the applications for Council interviews and consideration of an appointment.

On August 3, 2026, the City Council held a special meeting to interview and consider the appointment of an eligible candidate to fill the vacant District B City Council seat. No candidate received a majority vote at that meeting. To address the lack of a majority, the City Council directed staff to proceed with an appointment process based solely on the candidates’ interview scores.

DISCUSSION
A. Notice of Application.

Staff reopened the application period from August 4 through August 7, 2026. Notice of the

5.1 Packet Pg. 4
reopened application period was published on the City’s website and social media accounts, and hard copies were posted on the bulletin boards at City Hall and the Patterson Branch Library.

B. Applications Received.

Both original candidates reapplied for the appointment. Staff received an additional application, but it was withdrawn. At the close of the reopened application period, staff had applications from the following candidates:

1. Tito Valdespino

2. Chinyere Nnodim Jack
Redacted versions of the applications received are provided as Attachment 2.

C. Eligibility
To be eligible for appointment, an applicant must be at least eighteen (18) years of age, be a registered voter residing in District B, and otherwise be qualified to hold office. Staff has confirmed the District B residency and voter registration status of each applicant with the County Elections Office.

D. Interview and Selection Process
During the first round of interviews, the City Council scored applicants based on their interview responses. Those scores were intended only as a guide for the City Council’s decision, not as an automatic determination of who would be appointed.

In reopening the application period, the City Council established a process to help facilitate a majority-vote appointment: the candidate from the reopened application period with the highest cumulative interview score would be brought forward to consider for appointment.

The Council directed staff that candidates who reapplied for the appointment had the choice of using the score from their original interview or reinterviewing. Both candidates decided to use their original interview scores. Each candidate was asked the same interview questions and evaluated using the same scoring scale.

At the meeting, the City Clerk will announce each candidate's cumulative interview score. The City Council will then consider appointing the candidate with the highest cumulative score to fill the vacant District B City Council seat.

If the Council makes an appointment, it will be effective immediately, and the appointee will take the oath of office at the meeting.

Under Government Code section 36512(b), the Council has 60 days from the commencement of the vacancy to fill the vacancy by appointment. That period ends August 15, 2026.

FISCAL IMPACT
Filling the vacancy by appointment results in costs associated with staff time required to administer the appointment process.
