Change Order No. 1
The changes to the plans and specification to be approved by Change Order No. 1 include the following 5 items:

Item Description Reason
1 Additional Framing
($7,327)
Unforeseen existing wall thickness require
increased width for new urinal-plumbing.
2 Phasing Change ($27,360) Construction phasing implemented for coordination of ongoing public services.
3 Door’s height revision
($3,360)
Doors and frames change to be of matching
heights and types.
4 Floridate Wall Tile
($16,404)
Different wall tile specified due to unforeseen
unavailability of original type.
5 Door Credit and Additional
Flooring ($643)
Two doors removed from the contract and vinyl
flooring quantities adjusted.

For the five (5) items above, a time extension of 31 working days is added to the contract. An additional 83 non-compensatory working days are added to account for administrative delays due to unforeseeable procurement issues. The revised last day of work as authorized by this change order will be July 17, 2023.

Conclusion:

Staff recommends authorization of Change Order No. 1 to be issued by the Director of Public Works to Empire Design & Build LLC in the amount of $55,094 for a new total not-to-exceed construction contract amount of $651,994.

To: Mayor and City Council
From: City Manager
Meeting Date: March 14, 2023
Subject: APPROVE EXCHANGE AND ASSIGNMENT AGREEMENT

WITH LOS ANGELES COUNTY METROPOLITAN

TRANSPORTATION AUTHORITY
Recommendation:

1. Approve Exchange and Assignment of Federal Surface Transportation ProgramLocal (STP-L) and Highway Infrastructure Program (HIP) Funds with Los Angeles County Metropolitan Transportation Authority (Metro) in the amount of $1,077,759 as part of Metro’s STP-L Exchange Program from federal funds to state funds;

2. Authorize the City Manager to execute the Exchange Agreement in a form approved by the City Attorney;

3. Accept exchanging STP-L and HIP funds in the amount of $1,077,759 from Metro’s STP-L Exchange Program and increase the fiscal year (FY) 2022-23 budget for Revenue Account No. 699.00.0000-45776.50066 (State Funds) by the net change amount of $37,036; and

4. Approve an appropriation of the net change amount of $37,036 from Metro’s STP-L Exchange Program funds and amend the fiscal year (FY) 2022-23 budget for Expense Account No. 699.70.7300-54500.50066 (Contracted Services) by the same amount.

Fiscal Impact:

The City of Pico Rivera was eligible and requested to convert STP-L and HIP federal funds as part of the STP-L Exchange Program offered by Metro. The City had a total of $803,547 in STP-L and $296,207 in HIP funds that were available to be part of the Metro exchange for a 2% processing fee.

As part of the Five-Year Capital Improvement Program, the City had already anticipated this exchange last year when cities with less than 200,000 in population were offered this one-time exchange opportunity. The amount of $1,077,759 is $37,036 more than the budgeted amount of $1,040,723. Staff requests the City Council’s approval to 8 CITY COUNCIL AGENDA REPORT – MEETING OF MARCH 14, 2023

APPROVE EXCHANGE AND ASSIGNMENT AGREEMENT WITH LOS ANGELES

COUNTY METROPOLITAN TRANSPORTATION AUTHORITY

Page 2 of 2 ends

amend both the revenue and expenditure accounts for CIP No. 50066 by $37,036 to the FY 2022-23 Adopted Budget. There is no impact to the General Fund.

Discussion:

In 2021, Metro Board of Directors approved and programmed $47.5 million in HIP federal funds as the only federal COVID-19 response and relief funding made available to highway infrastructure activities. HIP federal funds were allocated to all 88 cities in Los Angeles County by their relative share of the total county population. The City of Pico Rivera received $296,207. This Metro Board action also included approval of the opportunity for agencies to exchange their HIP federal funding allocations for state only funds provided through Metro’s existing STP-L Exchange Program.

In 2022, the City submitted a request to be part of the STP-L Program Exchange with a small processing fee of 2%. At that time, the City had $803,547 in accumulated STP-L federal funds. The combined amount for these two (2) federal funds, minus the processing fee, allows the City to convert $1,077,759 to state only funds. This allows the City to use the funds on an infrastructure project without requiring a federal local match or through the federal authorization process expediting the use of the state funds.

In anticipation of the exchange, last fiscal year (FY) 2022-23, Public Works staff allocated the $1million state funds to CIP 50066 – Residential Resurfacing Program – Overlay and Reconstruction Project. The amount approved was $37,036 more than what was anticipated. Therefore, $1,077,759 will be available to be part of the City’s Residential Resurfacing Program for FY 2023-24.

Conclusion:

Staff recommends approval of the Exchange Agreement and Assignment of STP-L and HIP funds with Metro in the amount of $1,077,759 to fund construction of CIP 50066 – Residential Resurfacing Program – Overlay and Reconstruction Project.

Background:

Pursuant to Section 65400 of the California Government Code, each jurisdiction must prepare an Annual Progress Report (APR) on the jurisdiction’s status and progress in implementing its housing element using forms and definitions adopted by the California Department of Housing and Community Development. Each jurisdiction’s APR must be submitted to HCD and OPR by April 1st of each year covering the previous calendar year.

On September 27, 2022, the City Council adopted the Sixth Cycle 2021-2029 Housing Element and authorized the City Manager and/or the Community and Economic Development Director to make amendments to the Sixth Cycle Housing Element to address HCD’s comments. On February 2, 2023, the Community and Economic Development Director resubmitted the Housing Element to HCD for review and certification.

For the 2021-2029 Housing Element planning period, Southern California Association of Governments (SCAG) assigned the City with a requirement of 1,024 dwelling units. 10 CITY COUNCIL AGENDA REPORT – MEETING OF MARCH 14, 2023 HOUSING ELEMENT ANNUAL PROGRESS REPORT FOR THE 2022 REPORTING PERIOD

Grant Programs that offers homeowners the opportunity
to apply for loans and small grants to complete
improvement projects on their properties. The Loan
Program provides 0% simple interest, deferred payment
loans to seniors, persons with a disability, and families of low and moderate income that own and occupy their
homes and need financial assistance to make repairs
and improvements. The Grant Program provides a

Reviewed Annually
Housing Rehabilitation Grant Program – The City partners with Habitat for Humanity of Greater Los Angeles to carry out home rehabilitation projects for low to moderateincome homeowners to help sustain affordable housing in Pico Rivera. In the program year 2021-22, Habitat for Humanity approved 4 applications. One project was completed and the remaining three projects were carried over to the current fiscal year 2022-23. Additionally, the City is looking to reboot its HOME Investment Partnership Program to provide 0% interest loans and assist low-income homeowners with repair, rehabilitation, or reconstruction of owner-occupied units. The City continues to work with the State of California Housing and Community Development Department in finalizing internal controls and procedures.

Neighborhood Improvement Program
The City’s enforcement of existing property
maintenance codes is a primary means to preserve
housing and the quality of neighborhoods. The City’s
Neighborhood Improvement Officers enforce violations
on private property, such as zoning violations, building code violations, and public nuisances. This program is
designed to identify properties with violations and bring such properties up to City code requirements and to
clean up unsightly and unsafe properties. Under this
program, City personnel will refer property owners cited for Code violations to housing rehabilitation assistance programs as a means to prevent further deterioration of residential properties.

Reviewed Annually
The City conducts inspections on a complaint basis through the City’s Neighborhood Improvement Division. In 2022 the City opened 778 cases based on complaints and was able to complete/close 767 cases.

Monitor and Preserve Affordable
Housing
The City will maintain a list of affordable units
throughout the City including affordability
information to ensure landlords are compliant with
deed restrictions and to preserve affordable units.

The Housing Division will continue to pursue
partnership opportunities with non-profits to
preserve and expand affordable housing in the
City. The City will continue to comply with noticing
requirements and coordinate with qualified entities
to preserve at-risk units.

Reviewed Annually The City continues to pursue collaborations as opportunities become available.

Replacement Housing
The City may have existing non-vacant sites that
contain vacant or demolished residential units that were occupied by lower income households or households
subject to affordability requirements within the last five years. The City will implement a replacement housing
program to ensure the replacement of any units lost
subject to the requirements of Government Code
section 65915, subdivision (c)(3) on sites identified in the site inventory when any new development
(residential, mixed-use or residential) occurs on a site that is identified in the inventory meeting the following conditions:

Currently has residential uses or within the past five
years has had residential uses that have been vacated
or demolished, and
Was subject to a recorded covenant, ordinance, or law
that restricts rents to levels affordable to persons and families of low or very-low income, or
Subject to any other form of rent or price control through a public entity’s valid exercise of its police power, or Occupied by low and very low-income households.

The replacement
requirement will be
implemented upon adoption
of the Housing Element and
applied as applications on
identified sites are received
and processed, and local
policy shall be adopted
within one year of adoption
of the Housing Element.

Currently the City does not have existing non-vacant sites that contain vacant or demolished residential units that were occupied by lower income households or households subject to affordability requirements within the last five years. The City will work towards adopting policy for receiving and processing application on identified sites.

Energy Efficient Design
The City will review ordinances and recommend
changes where necessary to encourage energy efficient
housing design and practices that are consistent with
State regulations.

Reviewed Annually
The City provides information on their website and will continue to periodically update their literature regarding energy conservation, including solar power, energy efficient insulation, and subsidies available from utility companies, and encourage homeowners and landlords to incorporate these features into construction and remodeling projects.

On November 2022 the City adopted the 2022 California Building Codes including the California Energy Code.

Developer Consultation
The City will continue to promote and encourage early
consultation with developers to assist in expanding
housing opportunities in order to streamline the process involved in development of affordable housing.
