The Other Taxes category, which includes Franchise Tax, Property Transfer Tax, and Rubbish Franchise Fee, is coming in lower by $72,000 or 6%, compared to this same period last year due to the Property Transfer Tax directly tied to property sales. Home sales have slowed as the interest rates have risen throughout 2023. Despite this, Other Taxes are expected to meet budget expectations primarily due to the Franchise Tax expected to increase later in the fiscal year.

Charges for Services, which include Parks and Recreation revenues, increased by $29,000 or 7%, compared to this period in FY 2022-23, largely due to the Parks and Recreation programs and services, with the most notable increases in Camps, Trips and Tours, and Contract Programs. Charges for Services revenue are anticipated to come in higher than the amended budget.

All Other Revenues, which include Fines and Forfeitures, Use of Money, Cost Reimbursement, and Intergovernmental Revenue, are coming in higher by $425 thousand or 13%, compared to this same period last year, primarily due to the Use of Money and Fines and Forfeitures’ categories. The Use of Money increase is due to enhanced returns on our investment portfolio which includes interest income. While our investments have shown positive results up to the third quarter of FY 2023-24, we must remain cautious as we approach June 30, 2024. Our investment portfolio account faces various risks, including market volatility and fluctuations that could significantly impact the value of our assets. Additionally, changes in regulations pertaining to municipal investments or accounting standards may affect valuation and reporting requirements, potentially posing a risk to our investments by year-end. The increase in Fines and Forfeitures is attributed to Other Court Fines, primarily from collections related to parking citations. All Other Revenues are expected to exceed the amended budget.

Operating Transfers In is coming in higher by $51 thousand or 5%, compared to this same period last year primarily due to the increase in the Highway Users’ Tax received from Los Angeles County based on fuel sales and allocation determined by the City’s population.

Overall, General Fund revenues are projected to end the year at approximately $95 thousand or 0.2% higher than the amended budget for a total FY 2023-24 revenue projection of approximately $60,229,620. This is attributed to increased revenues in Sales Tax, Property Tax, and Use of Money, as discussed above. Table 1 on the following page shows revenues by category.

Expenditures
General Fund expenditures through the nine (9) month point (third quarter) total $37.69 million, or 58% of the $64.83 million amended budget. Most departments had increases from the prior year, primarily in Salaries and Benefits by $473,600 due to Cost-of-Living Adjustment (COLA), merit increase, and filling vacancies in various City departments.

On September 13, 2022, the City Council approved two (2) Memorandum of Understanding (MOU) between the City of Pico Rivera and two (2) Full-time employee bargaining groups, Professional and Confidential Employee Association (CEA) and Service Employees’ International Union 721 (SEIU). On March 28, 2023, the City approved an MOU between the City and SEIU Directors Unit. The approved MOUs included an annual COLA salary increase of 4% in July 2021, 3% in July 2022, and an additional 3% in July 2023. FY 2023-24 is the third and final year of the MOU. The anticipated COLA increase for FY 2023-24 is approximately $271,195 to salaries and additional employer costs.

The Maintenance and Operations costs in the General Fund departments increased by $1.80 million compared to this same period last year, mainly due to departments moving forward with projects, Contracted Services increases, and additional expenditures from the rise of programs/services being offered, as described below. Overall, costs in total are on track to come in within budgeted amounts.

Discussion of Departments with significant variances from the prior year are as follows:

• Administration third-quarter expenditures are $106,231 or 6% lower compared to the same period last year, primarily due to a vacant position in the City Clerk division. The vacant position will remain unfilled this year, resulting in budgetary CITY COUNCIL AGENDA REPORT – MEETING OF MAY 14, 2024

savings within this department, and is expected to come in slightly below budget expectations by the end of the fiscal year. Staff will return to the City Council with a recommendation on the future funding of this position. • Public Safety Los Angeles County Sheriff’s Department (LASD) is tracking slightly higher than last year by $573,000 or 6%, primarily due to contract increases and the enhancement to public safety infrastructure through the purchase of the ShotSpotter Gunshot Location Services program. It is expected to come in within budget by the end of the year.
• Administrative Services is lower by $47,700 or 2%, compared to last fiscal year due to the Information Technology (IT) division’s efforts on initiatives and projects related to the IT Assessment, such as 3Di, NextGen 311, Laserfiche, and Virtual City Halls completed in FY 2022-23. The Salaries and Benefits costs are tracking higher due to COLA increases and filling vacant positions. It is expected to come in below budget expectations by year-end.
• Community and Economic Development overall is tracking higher by $187,000 or 6%. The Salaries and Benefits category is higher due to COLA and filing vacant positions this fiscal year. The Maintenance and Operations category is tracking higher compared to the same period last year, primarily due to an increase in Economic Development and Building and Safety Services for ongoing projects such as Permitting Software, Mobile Home Ordinance, Land Use Plan, and Façade Enhancements. This category is expected to continue working on programs and projects into the next fiscal year and is expected to come in under budget expectations by the end of the fiscal year.
• Non-Departmental is coming in higher by $134,000 or 2% compared to this same period last year primarily due to an annual contract rate increase including the increase of $138,000 in contributions towards the City’s Unfunded Actuarial Liability (UAL) obligations for FY 2023-24 compared to the last fiscal year. Other notable increases are due to the General Liability increase of $121,000 and the Animal Control contract with Southeast Area Animal Control Authority (SEAACA) increase of $182,000. It is expected to meet budget expectations by the end of the year.
• Human Resources expenditures are higher by $130,000 or 28% in the Salaries and Benefits category due to the filing of the vacant Director position in late 2022.

The Maintenance and Operations expenditures are slightly higher compared to last fiscal year due to an increase in investigative and legal services. It is expected to come in within budget expectations by the end of the fiscal year. • Parks and Recreation has increased expenditures by $698,000 or 17% to last fiscal year due to more programs/services being offered and the rising costs of Special Events. The increases compared in Salaries and Benefits are primarily due to the filing of two (2) Manager positions, COLA increases, and hourly salaries for staff working on the additional programs/services. The Maintenance and Operations increases are primarily due to additional costs for Senior Services and Special Events such as Community Sports Organization's opening day events, and the Easter event. In addition, the Equipment Replacement increase is due to the purchase of new computer equipment for the Marketing and Promotions division. Although as compared to last year, the Parks and CITY COUNCIL AGENDA REPORT – MEETING OF MAY 14, 2024

Recreation Department expenditures have increased, they are expected to come in under budget by the end of the fiscal year.
• Public Works is tracking higher by $1.15 million or 17% compared to this same period last fiscal year, primarily due to COLA and merit increases, filling vacant positions, increases in hourly salaries, and overtime costs. The Maintenance and Operations costs increase is attributed to rising costs for utilities, supplies, and services such as Contracted Services and Professional Services for street sweeping, tree trimming services, landscaping maintenance, graffiti abatement services, Heating, Ventilation, and Air Condition (HVAC) services, Janitorial services, Fleet Maintenance and repairs, and the project management consulting services. It is expected to come in within budget by the end of the fiscal year. • Operating Transfers Out includes the $1.065 million Sales Tax Pledge from the General Fund to the Successor Agency (Fund 851). It is an obligation that the City has pledged under the 2021 Tax Allocation Refunding Bonds (TARBs). • Non-Operating Transfers Out is lower compared to this same period last fiscal year due to the $2.9 million for the Community and Economic Development Strategic projects and General Fund Capital Improvement Projects (CIP) in the prior year.

General Fund Summary
At the end of the third quarter, expenditures exceed revenues due to the remainder of Sales Tax, Property Tax, and All Other Revenue being received by year-end, while expenditures are generally consistent with annual projections. The third-quarter report is developed using nine (9) months of actual (unaudited) activity for FY 2023-24.

Administrative Services staff conducted a comparison of the third quarter of FY 2021-22 to the third quarter of FY 2023-24. Table 3 shows higher revenues and lower expenditures in FY 2023-24 compared to the same period last year, primarily due to the Operating revenue coming in higher and non-operating transfers that are considered one-time revenues or expenditures that did not occur this year.

General Fund Year-End Estimates:

The General Fund Year-End Revenues are trending higher than anticipated, primarily due to improved revenues received to date from Sales Tax and other categories as previously discussed. The estimates below project a $26,000 operating surplus.

Other Funds Budget Adjustment (Enclosure 1):

In reviewing the City’s Other Funds, staff identified the need for additional funding in FY 2023-24 to Proposition A (F205) in the amount of $24,000 for Bus Shelter Maintenance Services provided by Nationwide Environmental Services. These services include cleaning litter and debris on the City’s main arterials and commercial streets where bus stops are located. This increase reflects an approximate rate increase of 10% compared to last fiscal year, staff is recommending a budget adjustment of $24,000 for Fund 205 in expenditures as outlined in Enclosure 1.

Position (Personnel) Adjustments (Enclosure 2):

To support City operations, adjusting personnel positions as efficiently and effectively as possible is essential to meet the objectives and goals of Departments. Under certain circumstances, the need to modify positions may arise. The change allows the City to achieve optimal service levels.

To carry out the strategies in the City Council priorities and guiding principles, the following positions are recommended for reclassification:

Community and Economic Development (CED) (2 Positions):
• Reclassify Housing Manager to Housing Coordinator – As a result of staff turnover and difficulty in recruiting, the Housing Manager position has remained vacant. Based on operational needs, CED proposed reclassifying the Housing Manager to a Housing Coordinator who can oversee the daily activities and duties of the Section 8 Division. Reclassification would result in the Housing Manager position being eliminated and the FY 2023-24 Adopted FTE list formally adopted to reflect this change.
• Reclassify Senior Planner to Building Inspector – CED has experienced difficulties in recruiting qualified candidates for the Senior Planner position. To sustain the operational needs of the department, there is a need for additional building inspection services. Reclassification would result in the Senior Planner position being eliminated and the FY 2023-24 Adopted FTE list formally adopted to reflect this change.

The personnel adjustments enable the City to achieve optimal service levels with budgetary savings, as both positions are reclassified to lower-level positions. The budgetary savings of approximately $37,800 will be realized in the Housing – Section 8 Fund (F291) for the Housing Coordinator position and $16,200 in the General Fund (F100) for the Building Inspector position. These reclassifications for the two (2) positions within the Community and Economic Development Department would not increase the FTE position control. Table 4 below summarizes the staffing recommendations listed above.

Water Operations Enterprise Fund
The Water Operations Enterprise Fund accounts for the operation and maintenance of the City’s water treatment, water transmission, and distribution system. The FY 2023- 24 Water Fund revenues include the implementation of the annual water rate increase that the City Council adopted on April 27, 2021. FY 2023-24 expenses include two (2) Capital Improvement Projects: one for the Water Treatment System and another for the Advanced Metering Infrastructure (AMI) Replacement. Staff expect to meet the budget by the end of the year.

Pico Rivera Innovative Municipal Energy (PRIME) Fund
The PRIME Fund includes revenues and expenses for the purchase and sale of “greener” energy for consumers. FY 2023-24 Third Quarter revenues are tracking higher than expenses by approximately $8.1 million, primarily due to the implementation of the rate increases approved by the City Council in February 2023. These rate CITY COUNCIL AGENDA REPORT – MEETING OF MAY 14, 2024

adjustments have generated sufficient revenue to sustain PRIME’s operations and maintenance, as well as to fulfill approved reserves in accordance with PRIME’s adopted policies. Moreover, they enable the procurement of future energy at competitive prices. Lower expenses are the result of an extended colder winter in consecutive years, reducing the demand for higher-cost energy. Staff anticipates exceeding budget projections and meeting the necessary reserve targets by year-end.

Golf Course Fund
The Pico Rivera Golf Course experienced a slight increase in golf play, in particular Green Fees, Driving Range Fees, and Golf Course Concessions. The Golf Course expenses have increased due to the rising costs for building and ground maintenance materials and services, along with the increase in contract management fees.

Additionally, in FY 2023-24, the City procured some new equipment to ensure smooth operation of the fully open Golf Course. Staff will continue to monitor and reevaluate for the rest of the fiscal year.

Sports Arena Fund
The Sports Arena has resumed operations to pre-pandemic levels for rentals and events, increasing revenues and expenses as more events were held in the outdoor venue. Staff will continue to monitor and reevaluate for the rest of the fiscal year.

Conclusion:

This Third Quarter Budget Review Report presents an overview of the City’s operating revenues and expenditures for the quarter ending March 31, 2024, compared to the previous year. A detailed report of revenues and expenditures for the GF is included in Enclosure 1. Additionally, staff has also included a detailed report on revenues and expenses for Enterprise Funds for the same period (Enclosure 2). Departments continue to work to reduce impacts on the GF while monitoring and evaluating opportunities to enhance revenues and reduce expenditures. The Annual Comprehensive Financial Report, Fiscal Year Ending June 30, 2024, and FY 2023-24 General Fund Year-End Results will provide an update on General Fund and Special Fund activities that provide an audited financial summary for the City of Pico Rivera.

Staff recommends receiving and filing the Third Quarter Budget Report ending March 31, 2024, approving the Other Funds Budget Adjustment (Enclosure 1), and the Position (Personnel) Adjustments to the FTE position control (Enclosure 2).

Subject: PRESSURE RELIEF SUSTAINING VALVE STATION ON
DUNLAP CROSSING ROAD, CIP NO. 21361 – AWARD OF

CONTRACT
Recommendation:

1. Award a construction contract for an amount not-to-exceed $268,063 to American Pipeline Services and authorize the Executive Director to execute the contract in a form approved by the General Counsel;

2. Authorize the Executive Director or designee to process change orders, as needed, in an amount not-to-exceed $26,806 (approximately 10% of the total contract amount) for construction contingency; and

3. Approve the Notice of Exemption (NOE) for the subject project and authorize the City Clerk to file the NOE with the County Recorder, in accordance with the California Environmental Quality Act (CEQA).

Fiscal Impact:

The fiscal year (FY) 2023-24 Adopted Budget includes appropriations in the Water Authority Funds under Account No. 550.70.7340.54500.21361 in the amount of $600,000. The total project cost is estimated at $340,000 for design and construction.

No additional funding is necessary at this time and there is no fiscal impact to the General Fund.

Background:

In September 2021, the City of Pico Rivera (City) completed an update to the Water Master Plan which evaluated the performance and condition of the existing distribution system, identified any system deficiencies, recommended projects necessary to meet future water demands and regulations, and provided a blueprint for the future operation of the system.

PRESSURE RELIEF SUSTAINING VALVE STATION ON DUNLAP CROSSING ROAD, CIP NO. 21361 – AWARD OF CONTRACT

Page 2 of 3 ends

The hydraulic modeling conducted during the Water Master Plan revealed that there is an area in the northeastern section of the City’s water distribution system where the pressure falls below the standard levels for both average and peak daily demand conditions.

Discussion:

The City’s water system is currently made up of a single pressure zone. The Water Master Plan suggests dividing the water system into two (2) pressure zones, one for the north and one for the south. This proposed zone separation will aid to isolate the northeastern section of the system that is experiencing low pressures. Dividing the pressure zone in the City requires the installation of a pressure reducing valve station on Dunlap Crossing Road, west of Calico Avenue. With the proposed improvements, the northeastern section of the system can expect to see improved pressure to meet current and future water supply demands. This improvement has been identified as part of the Capital Improvement Plan of the Water Master Plan.

On March 1, 2024, the Notice Inviting Bids (NIB) was advertised in the Los Cerritos Newspaper and was posted on Planet Bids through the City’s website. On April 2, 2024, five (5) bids were received.

The following summarizes the bids received:

Construction Company Bid Amount
American Pipeline Services $268,062.50
GCI Construction, Inc. $331,346.00
Ferreira Construction $408,200.00
Dominguez General Engineering $423,625.00
Houalla Enterprises, Ltd. $434,430.00
Staff completed the analysis of the bids and determined American Pipeline Services to be the apparent lowest and responsible bidder. Staff has verified American Pipeline Services’ references and found their past performance on jobs of similar size and scope to be satisfactory. American Pipeline Services has performed work for the City of Gilroy, County of Los Angeles, California Department of General Services and Caltrans.

Their bid proposal, bonds, contractor’s license, and insurance documents are in order.

The anticipated schedule for the Project is as follows:
• Award Construction.…………………. May 2024
• Start Construction ...…………………. November 2024
• Complete Construction …………...… February 2025
WATER AUTHORITY AGENDA REPORT – MEETING OF MAY 14, 2024

Page 3 of 3 ends

Due to peak water consumption demand during the summer and early fall months, construction is anticipated to begin in November 2024 when less water is consumed.

The delayed start date will ensure that the consumption demands are met in the event of a fire flow occurrence during construction.

The total estimated project budget is summarized as follows:

Project Expenditures Amount
Design $45,131
Construction $268,063
Contingency (10%) $26,806
Total Estimated Project Cost $340,000
Project Funding Amount
Water (Fund 550) FY 2023-24 $600,000
Total Project Budget $600,000
Construction management and inspection services will be provided by Engineering Division and Water Division staff from the Department of Public Works.

Environmental Analysis:

The project has been reviewed for environmental compliance. Pursuant to the California Environmental Quality Act (CEQA) guidelines, the Project is categorically exempt under Section 15302 Class 1(b) for existing facilities (Enclosure 2).

Conclusion:

Staff recommends awarding a construction contract to American Pipeline Services for an amount not-to-exceed $268,063, authorize the Executive Director or designee to process change orders, as needed, in an amount not-to-exceed $26,806 in contingency (approximately 10% of the total contract amount) to complete the project, and authorize the City Clerk to file the NOE with the County Recorder, in accordance with the CEQA for the Project.
