Subject: RESOLUTION ADOPTING PROJECTS FOR ROAD
REPAIR AND ACCOUNTABILITY ACT OF 2017 (FISCAL
YEAR 2024-25)
Recommendation:
1. Approve a resolution adopting project(s) for fiscal year (FY) 2024-25 funded by Senate Bill 1 (SB1): The Road Repair and Accountability Act of 2017.
Fiscal Impact:
The projected amount the City of Pico Rivera (City) will receive from SB1 - Road Repair and Accountability Act of 2017 for FY 2024-25 is projected at $1,590,565. The State requires that the City Council approve a resolution appropriating such funds for road resurfacing project(s) and eligible construction work by submitting the approved resolution by or before July 1, 2024.
It is recommended that next year’s funding allocation for SB1 (Fund 202) for FY 2024- 25 in the estimated amount of $1,590,565 be allocated and relisted to Residential Resurfacing Program – Overlay and Reconstruction Project FY 2023-24, CIP No. 50106 in the amount of $1,390,565. The remaining balance of $200,000 would be allocated to Public Works operational needs, such as engineering staff time overseeing the road resurfacing projects, in accordance with SB1 guidelines.
Discussion:
On April 28, 2017, Governor Jerry Brown signed Senate Bill (SB) 1 - Road Repair and Accountability Act of 2017, to address basic road maintenance, rehabilitation and critical safety needs on both the state highway and local street road system. The State Controller will apportion, by formula, a percentage of Road Maintenance and Rehabilitation Account (RMRA) funds to eligible cities and countries in accordance with Streets and Highways Code Section 2032.
3 CITY COUNCIL AGENDA REPORT – MEETING OF MAY 28, 2024
RESOLUTION ADOPTING PROJECTS FOR ROAD REPAIR AND ACCOUNTABILITY ACT OF 2017 (FISCAL YEAR 2024-25)
Prior to receiving an apportionment of RMRA funds from the Controller each fiscal year, the City must submit to the City Council a list of projects proposed to be funded with these funds. Pursuant to Streets and Highways Code Section 2034, all projects must be adopted via resolution by the applicable legislative body at a regularly scheduled public meeting. The projects must include a description of the type of improvement, the location of each proposed project, a proposed schedule for completion and the estimated useful life.
Conclusion:
Staff recommends approval of the proposed resolution allocating the estimated $1,590,565 in FY 2024-25 SB1 funds (Fund 202) to the Residential Resurfacing Program – Overlay and Reconstruction Project FY2023-24, CIP 50106 in the amount of $1,390,565. These funds will be accounted for in the Preliminary Budget for FY 24-25 that will be presented to the City Council on June 11, 2024 as a public hearing and presented for adoption on June 25, 2024. The remaining balance of $200,000 would be allocated to Public Works operational needs, such as engineering staff time overseeing resurfacing projects, in accordance with SB1 fund guidelines.

Subject: PICO PARK PREFABRICATED RESTROOM PROJECT
(CIP NO. 50085) – REJECT ALL BIDS AND
AUTHORIZATION TO RE-BID PROJECT
Recommendation:
1. Reject all bids for the Pico Park Prefabricated Restroom Project, CIP No. 50085; and
2. Authorize the Director of Public Works to re-advertise for construction bids.
Fiscal Impact:
The fiscal year (FY) 2023-24 Adopted Budget includes funds for CIP No. 50085 in the amount of $750,000. No additional appropriation is needed at this time.
Background:
The current Pico Park field restroom facility, constructed mostly of metal, was built in the late 1970’s and is located on the northwest corner of Pico Park. The restroom facility includes a men’s restroom, women’s restroom, a small storage area, and a janitorial closet, which houses the water heater, field light timer control switch, and access to the plumbing chase. Pico Park has a joint-use agreement with its neighboring school, North Park Academy for the Arts, a junior high school who utilizes Pico Park’s grounds daily.
Pico Park’s fields are also home to many youth and adult sports organizations throughout the year. While the park is subject to recurring use by community sports organizations, the restroom facility is also heavily used by general park patrons.
Discussion:
In June of 2023, City Council approved the procurement of a prefabricated restroom structure from Public Restroom Company to replace the existing restroom building and provide adequate support to service the park. On March 13, 2024, the Notice Inviting Bids (NIB) was advertised in the Los Cerritos Newspaper and posted on Planet Bids, through the City’s website. On March 28, 2024, two (2) bids were received through PlanetBids.
4 CITY COUNCIL AGENDA REPORT – MEETING OF MAY 28, 2024
PICO PARK PREFABRICATED RESTROOM PROJECT (CIP NO. 50085) – REJECT
ALL BIDS AND AUTHORIZATION TO RE-BID PROJECT
The following table summarizes the bids received:
Upon evaluation of the bids, it was discovered that the bids amounts were substantially above the engineer’s estimate by over 240%. Because of the significant variance between the budget and the bids, staff recommends that the City Council reject all bids and authorize staff to re-advertise. In accordance with the Pico Rivera Municipal Code, Section 3.20.150, “In its discretion, the City Council may reject all bids presented and re-advertise for bids.”
Staff is working with the project design team to evaluate the scope of work and identify cost-saving measures, with the aim of delivering a project that closely aligns with the budget.
Conclusion:
Staff recommends rejecting all bids received for the Pico Park Prefabricated Restroom Project, CIP 50085, and authorizing the Director of Public Works to re-advertise for construction bids.

Subject: VEHICLE REPLACEMENT – PURCHASE OF SIX (6)
VEHICLES FOR THE PUBLIC WORKS DEPARTMENT
Recommendation:
1. Ratify the purchase of six (6) vehicles in the aggregate amount of $483,530 from Rush Truck Center by way of National Cooperative Purchasing Alliance (NCPA) Contract No. 05-47 for heavy equipment, diesel trucks, bus parts, and related services; and
2. Authorize the City Manager to execute all documents related to the purchase of the recommended vehicles.
Fiscal Impact:
The fiscal year (FY) 2023-24 Adopted Budget under the Equipment Replacement Fund (Fund 170), Account No. 170.40.4030-57300 and Account No. 170.40.4033-57300 includes an available budget balance of approximately $902,470 for the purchase of necessary vehicles and equipment for the Public Works Department, Maintenance Division. The fully electric 2023 Ford F150 Lightning will be partially purchased using $34,600 in AQMD funding, from Account No. 200.40.4033-57300. The total purchase price of the requested vehicles is $483,530. No additional appropriations are required at this time.
Discussion:
On April 9, 2024, the City Council approved an appropriation of $1,239,702 into Fund 170 (Equipment Replacement) for the purchase of vehicles and equipment to replace existing units. Public Works staff have been identifying and replacing vehicles and equipment that need extensive repairs and pose safety concerns to staff and the public.
The six (6) vehicles proposed for replacement have been in operation between 20-25 years. They require extensive and frequent mechanical repairs and exceed their useful service life.

Three (3) of the six (6) vehicles proposed for replacement are utility vans – Unit Nos. 259, 262, and 271, with mileage ranging from 76,000 to 146,000. The Facilities Maintenance staff use these vehicles to repair and inspect park equipment, basketball courts, playground equipment, plumbing repairs at park restrooms and facilities, and the Golf Course. The Facilities staff also complete electrical maintenance and repairs at all city facilities and water facilities. These aged vehicles have exceeded their useful life; therefore, a Ford Transit 350 HD is the suggested replacement vehicle.
The remaining three (3) vehicles set to be replaced are Unit Nos. 200, 203, and 261.
These vehicles are used by the Street and Parks Maintenance staff and the use for these vehicles range from providing park maintenance, street maintenance, pothole repair, sidewalk repair, and traffic control. Two (2) of these vehicles are over 20 years old, have over 120,000 miles, and need extensive repairs. The proposed vehicle replacements are the 2023 Ford F150 lighting, 2023 Ford F-250, and 2023 Ford F-350.
The recommended purchase of the six (6) vehicles will utilize a cooperative purchasing contract as authorized by Section 3.20.030 of the Pico Rivera Municipal Code (PRMC).
Utilizing the NCPA Cooperative agreement meets the requirements of Section 3.20.030 of the PRMC and allows staff to secure the most appropriate vehicle. In addition, purchasing through vetted Cooperative agreement(s) assures that the procurement of goods and services comply with public purchasing regulations, are competitively solicited, and the City receives the most advantageous pricing while expediting the procurement.
CITY COUNCIL AGENDA REPORT – MEETING OF MAY 28, 2024
VEHICLE REPLACEMENT- PURCHASE OF SIX (6) VEHICLES FOR THE PUBLIC
WORKS DEPARTMENT
In recent months, cities have been facing challenges in acquiring necessary vehicles and equipment due to supply chain issues, inflation, and competition in the purchasing market.
The acquisition of these vehicles has been deemed necessary by the Public Works Director and City Manager by the method of a cooperative agreement and it shall not require the City Council’s approval prior to the purchase of the vehicle(s). To secure these essential vehicles, staff proceeded to purchase all six (6) vehicles from Rush Truck Centers. Per the PRMC 3.20.025, the City shall report the vehicle purchase(s), exceeding the City Manager’s approval threshold, at the following City Council meeting for ratification.
These recommended vehicle purchases will ensure that the Public Works staff is properly equipped with reliable and safe vehicles to continue providing efficient and effective services for the community.
Conclusion:
Staff recommends that the City Council ratify the purchase of six (6) vehicles through Rush Truck Centers by way of NCPA for the amount not-to-exceed $483,530 and authorize the City Manager to execute all related documents for the purchases of the vehicles.
