Meeting Date: January 14, 2025
Subject: PICO RIVERA INNOVATIVE MUNICIPAL ENERGY

POWER CONTENT LABEL AND ATTESTATION FOR THE
YEAR 2023
Recommendation:

1. Approve the attestation endorsing the accuracy of the Annual Report and Power Content Label (PCL) to meet California’s Power Source Disclosure (PSD) Program requirements.

Fiscal Impact:

There is no fiscal impact to the General Fund. The California Energy Commission (CEC) requires PRIME to mail the PCL to all its customers. The costs associated with printing and mailing this document are properly appropriated within the fiscal year (FY) 2024-2025 Adopted Budget.

Background:

Assembly Bill (AB) 162 and Senate Bill (SB) 1305 require all retail electricity suppliers, such as PRIME, to disclose information to consumers about the energy resources used to generate the electricity they sell. The CEC is responsible for enforcing the required communication, termed the “Power Content Label.” Moreover, the California Public Utilities Code requires all retail sellers of electricity, including PRIME, to disclose “accurate, reliable, and simple-to-understand information on the sources of energy” that are delivered to their respective customers via an annual PCL (Public Utilities Code § 398.1 et seq).

The PCL is similar to a nutrition label; it conveys information regarding the various power sources or products that are purchased and delivered to retail electricity customers. California’s retail electricity sellers, including PRIME, will each have unique PCLs based on internally adopted procurement policies and related power purchases that were completed during the reporting year. The PCL format is highly prescriptive, offering little flexibility to retail sellers when presenting such information to customers – the CEC administers these requirements under California’s PSD. Applicable CEC regulations direct retail sellers to provide such communications no later than October 1st 9 CITY COUNCIL AGENDA REPORT – MEETING OF JANUARY 14, 2025

of each year. However, due to technical issues with their online forms, the CEC approved an extension to January 31, 2025.

Discussion:

Information presented in each PCL includes the proportionate share of total energy supply related to specific fuel sources/resource categories, including both renewable and conventional generating technologies. If a retail seller procures a certain percentage of its energy supply from sources of power that cannot be traced back to a specific generator, such as energy purchased through open market transactions, the PCL must identify such purchases as “unspecified sources of power.” It is very common for most retail electricity sellers to utilize “unspecified sources of power.” In accordance with statewide mandates and internally adopted planning targets, PRIME procured a substantial portion of its electric energy supply from generating resources utilizing various renewable fuel sources in 2023. Renewable fuel sources may include biomass and waste, hydroelectricity, solar, geothermal, and wind. For PRIME Power customers, 50.2% of the energy delivered was sourced from renewable energy resources. For PRIME Future customers, 100% of the energy delivered was sourced from renewable energy resources, notably solar and wind.

PSD regulations also require certain renewable energy purchases to be reported on the PCL. More specifically, entities must separately display “unbundled” and “bundled” Renewable Energy Certificates (RECs). Unbundled RECs are sold and purchased separately from associated electric power; conversely, bundled RECs are sold and purchased with associated electric power. Finally, determining the total quantity of renewable energy purchased on behalf of each customer requires the summation of two values: “Eligible Renewables” and “Percentage of Retail Sales Covered by Retired Unbundled RECs.”
While developing PRIME’s PCL, California Choice Energy Authority (CalChoice) and its technical consultants performed a detailed review of all power purchases completed for the 2023 calendar year. The review performed by CalChoice and its technical consultants found no inaccuracies or inconsistencies in such information, which was subsequently entered in PRIME’s annual Power Source Disclosure report(s) and PCL.

To fulfill its PSD Program reporting obligations for 2023, PRIME, as a public agency, must provide the CEC with the City of Pico Rivera City Council’s attestation regarding the accuracy of the information included in each annual Power Source Disclosure Report (Report), which was submitted to the CEC earlier in 2024, in accordance with the applicable reporting deadline and consistent with the following element of PSD Program regulations:

A retail supplier that is a public agency providing electric services is not required to comply with the provisions of subdivision (a)(1) if the board of directors of the CITY COUNCIL AGENDA REPORT – MEETING OF JANUARY 14, 2025

Page 3 of 3 ends

public agency submits to the Energy Commission an attestation of the veracity of each annual report and power content label for the previous year. (20 CCR § 1394.2(a)(2))
In the excerpt above from appliable regulations, subdivision (a)(1) refers to a third-party audit, which is not necessary for public agencies, including the City.

While developing PRIME’s PCL, CalChoice and its technical consultants performed a detailed review of all power purchases completed for the 2023 calendar year. The review performed by CalChoice and its technical consultants found no inaccuracies or inconsistencies in such information, which was subsequently entered in PRIME’s annual PSD Report(s) and PCL. To fulfill its attestation requirements for 2023, the City Council is being asked to provide an attestation covering both the PCL and associated Annual Report(s), as specified in the excerpt above – both elements of the PSD Program reflect information that was consistently and accurately presented for the PRIME program.

Upon approval, a copy of this staff report and related meeting minutes will be forwarded to the CEC, thereby completing PRIME’s attestation requirements under California’s Power Source Disclosure Program for the 2023 calendar year. Consistent with applicable regulations, all customers currently enrolled in the PRIME program will soon receive the PCL via U.S. mail in accordance with the January 31, 2025, deadline.

Conclusion:

Staff recommends that the City Council attest to the accuracy of both the PCL and Annual Reports related to the 2023 operations of the PRIME program. Fulfilling this annual requirement helps support both City and State initiatives related to the transparency of information related to power purchase and fulfills pertinent obligations reflected under applicable PSD Program regulations.

ATTESTATION FORM
For the Year Ending December 31, 2023
Pico Rivera Innovative Municipal Energy
PRIME Future
To: Mayor and City Council
From: City Manager
Meeting Date: January 14, 2025
Subject: DEVELOPMENT IMPACT FEE REPORT AS OF JUNE 30,
2024
Recommendation:

1. Receive and file the Development Impact Fee Report as of June 30, 2024.

Fiscal Impact:

There is no fiscal impact to the General Fund from this item.

Background:

State law requires any local agency that imposes development impact fees to prepare an annual report containing detailed information on the fees. As a result, we are submitting the Development Impact Fee (DIF) Report for the City of Pico Rivera (City) for the fiscal year (FY) ending on June 30, 2024, in accordance with the provisions of the California Government Code Section 66006(b) and 66001(d), as amended by Assembly Bill (AB) 518 and Senate Bill (SB) 1693.

Discussion:

State law requires the City to prepare and make the DIF Report available to the public 180 days after the last day of each fiscal year. The City has fulfilled the mandated requirement for public availability of the report on the City’s website, however, it is important to note that the formal report adoption is being requested by the City Council per this report. The City Council must consider the acceptance of the annual report at a regularly scheduled public meeting. The information must be made available to the public no fewer than 15 days prior to the meeting.

Local governmental agencies charge DIFs in connection with the approval of development projects. The purpose of these fees is to defray all or a portion of the cost of public facilities related to the development projects. The legal requirements for enactment of a DIF program are outlined in Government Code Sections §66000–66025 (the "Mitigation Fee Act").
10 CITY COUNCIL AGENDA REPORT – MEETING OF JANUARY 14, 2025 DEVELOPMENT IMPACT FEE REPORT AS OF JUNE 30, 2024

Page 2 of 2 ends

The Mitigation Fee Act is commonly referred to as "AB 1600" and requires the following information:

A. Brief description of the type of fee in the fund;
B. The amount of the fee;
C. The fund’s beginning and ending balance;
D. The amount of fees collected and the interest earned; E. A description of the improvements on which the funds were expended and the amount expended on each improvement, including the percentage of the improvement funded with development fees;
F. An approximate date by which the construction of a public improvement will begin if the City determines that sufficient funds have been collected to complete financing on the incomplete improvement;
G. A description of each inter-fund transfer or loan made from the fund; and H. The amount of any refunds made pursuant to Code Section 66001.

The City adopted development impact fees for the Public Image Enhancement Fund (Fund 220) in 1996 and the Park Development Fund (Fund 270) in 1994:
• Public Image Enhancement Fund accounts for funds received from all developers to enhance the image of the City of Pico Rivera.
• Park Development Fund accounts for funds received on new residential construction to improve and/or develop the City’s Park system.

Staff compiled the Development Impact Fee Report as of June 30, 2024, based on the requirements pursuant to Government Code 66000 et seq. The City has fulfilled the mandated requirement for public availability of the report on the City’s website. The formal report is enclosed for the City Council’s consideration.

Conclusion:

Staff recommends that the City Council receive and file the Development Impact Fee report as of June 30, 2024.
