FROM: Sara Lillevand, City Administrator
SUBJECT: Rejection of All Bids for the FY2021-2022 Street Tree Pruning Project RECOMMENDATION:
Approve the attached resolution rejecting all bids for the FY2021-2022 Street Tree Pruning Project.
BACKGROUND:
The annual assessment of street trees to verify the next cycle of pruning was performed by the City’s certified arborist Nick Millosovich. Based on previous cycles of pruning, observations since the last street tree pruning project, input from residents, and his professional judgement, this year’s list of trees was developed. The Base Bid is for the pruning of a total of 1,038 street trees and the removal of 3 street trees. The list of streets, species of trees, and quantity to be pruned are listed below.

BIDDING
Bids were advertised on December 17, 2021 and due on January 20, 2022. Several companies were notified by phone and a public notice was also published in the East Bay Times, the Piedmonter and the Piedmont Post. The following bids were received:
BIDDER BASE BID
Hercules Tree Service and Landscape
Construction $168,494.34
Julian Tree Care, Inc. $192,399.99
The Professional Tree Care Co. $344,850.00
West Coast Arborists, Inc. $551,650.00
Staff examined the bids submitted by Hercules Tree Service and Landscape Construction and Julian Tree Care, Inc. and they were found to not be in conformance with the requirements of the bid documents. Hercules’ bid did not include a bid bond or other bid security; Julian’s bid identified several different entities as the holders of the various required licenses and registrations, whereas to be responsive all must be from a single entity. The remaining two bids far exceeded the engineer’s estimate for the completion of this scope of work. Based on findings from the review of all the bids received, Staff is recommending that the Council reject all bids.
Staff will prepare the project documents and re-bid the project in February 2022.

FISCAL CONSIDERATIONS
When awarded, this project will be funded through the Public Works Operating Budget for FY21-22 - Street Tree Pruning Account # 101-0402-058-001 with a current balance of $235,000.
While there are no assurances, City staff is optimistic that a re-bid will result in a conforming bid for an amount less than the current low conforming bid.
CITY ATTORNEY REVIEW
The City Attorney has reviewed these matters and agrees with staff’s recommendation from a legal perspective
