City of Piedmont
COUNCIL AGENDA REPORT
DATE: January 17, 2023
TO: Mayor and Council
FROM: Sara Lillevand, City Administrator
SUBJECT: Consideration of the Award of a Contract for the 2022-2023 Annual Sidewalk Repair Program to Rosas Brothers Construction in the amount of $185,060, Approval of an Overall Construction Budget of $234,866, and a Determination that the Project is Exempt from the Requirements of the California Environmental Quality Act
RECOMMENDATION
By a single motion, take the following actions regarding the 2022-2023 Annual Sidewalk Repair Program:
1. Approve the award of the Contract for the 2022-2023 Annual Sidewalk Repair Program to Rosas Brothers Construction based on their submitted bid of $185,060.
2. Approve the overall Estimated Construction Budget of $234,866, which includes the construction cost, a 10% contingency and monies for construction management, and inspection.
3. Determine the project to be exempt from the requirements of the California Environmental Quality Act (CEQA).
BACKGROUND
In an ongoing effort to improve sidewalks in the City by correcting deficiencies, staff identified over 1,350 linear feet of sidewalk to be included with this year’s sidewalk repair program. These locations came to the City’s attention through sidewalk inspections and input from residents, among other methods. The sidewalk slated for repair is on several streets throughout the City.
Locations of the repairs are shown on the list attached to this staff report.
DISCUSSION
Bid documents were developed and the project was publicly bid in accordance with City Ordinances and the Public Contract Code. Bids were opened on December 7, 2022. Eleven bids were received ranging in price from $185,060 to $345,045. The engineer’s estimate for this project was $263,350.
Based on the low bid from Rosas Brothers Construction of $185,060 being both complete and responsive, staff is recommending award of the 2022-2023 Annual Sidewalk Repair program to Rosas Brothers Construction. This firm has done work for the City of Piedmont before and the City has had positive experiences in the past.
SCHEDULE OF CONSTRUCTION
If this contract is awarded at this Council meeting, it is anticipated that the work will begin in February, weather dependent. The contract documents allow for 100 working days (20 weeks) to complete the work. Subject to adjustments due to weather, the project should be completed by the middle of summer.
ENVIRONMENTAL REVIEW
This project is exempt from the California Environmental Quality Act pursuant to CEQA Guidelines section 15301(c), in that the project concerns the repair of existing sidewalks.
FISCAL CONSIDERATIONS
Based on the recommended award amount, staff is proposing the following overall budget:
Construction $ 185,060
Construction Contingency (10%) $ 18,506
Estimated Construction Management & Inspection $ 31,300* Total Estimated Project Construction Budget $ 234,866
Funding for the project will come from the Gas Tax Fund.
CITY ATTORNEY REVIEW
The City Attorney has reviewed and approved the Agreement as to form.
