SUBJECT: Consideration of a Resolution Terminating the Local Emergency with Regard to Winter Storms Proclaimed by the Director of Emergency Services on January 4, 2023 and Ratified by the City Council on January 9, 2023
RECOMMENDATION
Approve a resolution terminating the Local Emergency with regard to winter storms proclaimed by the Director of Emergency Services on January 4, 2023 and ratified by the City Council on January 9, 2023.
BACKGROUND
Beginning on December 30, 2023, the City of Piedmont was impacted by a series of winter storms along with the majority of the state of California. The impacts of the severe storms included flooding, clogged drains, landslides, falling trees and utility poles. On January 4, 2023, the City Administrator, acting in her capacity as Director of Emergency Services, proclaimed the existence of a local emergency. That proclamation was ratified by the City Council on January 9, 2023.
Government Code section 8604 provides that “[T]he governing body shall proclaim the termination of the local emergency at the earliest possible date that conditions warrant.” Because the succession of storms have passed, and the damage has been assessed, Staff recommends that the City Council terminate the local emergency.

A RESOLUTION TERMINATING THE LOCAL EMERGENCY DUE TO WINTER
STORMS PROCLAIMED BY THE DIRECTOR OF EMERGENCY SERVICES ON JANUARY 4, 2023 AND RATIFIED BY THE CITY COUNCIL ON JANUARY 9, 2023 WHEREAS, pursuant to Government Code section 8630 and Chapter 5 et seq. of the Piedmont City Code, the Director of Emergency Services proclaimed the existence of a local emergency due to winter storms on January 4, 2023; and
WHEREAS, at its regular meeting on January 9, 2023, the City Council ratified the proclamation of local emergency through the passage of Resolution 01-2023; and WHEREAS, the winter storms have passed and an assessment of the damage has been completed, there is no need at this time for the existence of a local emergency; NOW, THEREFORE, BE IT RESOLVED, that the City Council hereby terminates the local emergency due to winter storms which was proclaimed by the Director of Emergency Services on January 4, 2023 and ratified by the City Council on January 9, 2023.
