COUNCIL AGENDA REPORT
DATE: March 6, 2023
TO: Mayor and Council
FROM: Sara Lillevand, City Administrator
SUBJECT: Consideration of a Resolution Extending the Abandoned Vehicle Abatement Program

RECOMMENDATION
Adopt the following resolution extending the abandoned vehicle abatement program until May 31, 2033.

BACKGROUND
In 1990, the California State Legislature enacted legislation allowing for the creation of countybased vehicle service authorities, pursuant to the provisions of Section 22710 VC. In 1993, the Alameda County Abandoned Vehicle Abatement Authority (ALCO AVA) was formed and imposed a one-dollar annual vehicle registration fee on vehicles registered to an owner with an address in the County of Alameda.

Vehicle registration fees are collected by the Department of Motor Vehicles and allocated to the ALCO AVA by the State Controller’s Office pursuant to Section 9250.7 VC. Fees are then allocated to the ALCO AVA participating agencies based on an adopted formula involving their individual percentage of vehicles abated, population and land area in relation to the totals for these factors in the ALCO AVA as a whole. The current participating agencies are the County of Alameda, and all the Alameda County Cities except Albany and Emeryville. Since the inception of the program almost 20 years ago, the ALCO AVA has received approximately $34.8 million dollars, which has allowed staff in the participating agencies to abate approximately 465,000 abandoned vehicles. The City of Piedmont has been allocated a total of $51,128.59 in the last 12 years. These funds have been used to support the abandoned vehicle job functions of the Community Service Officer positions. The two Community Service Officers perform the majority of abandoned vehicle enforcement.

The current program is set to expire at the end of May 2023. State law authorizes the local service authorities to extend the program every ten years with the approval of the county and a majority of the cities comprising a majority of the population of the incorporated areas. Adoption of this resolution is the first step towards the extension of this important program. If approved, the resolution will be sent to the State of California by Ed Pressnel, the Alameda County representative, and he will advocate for the program extension.
