Response to Bid Advisory
Dear Mr. Gonzales,
I am writing in response to the bid advisory letter submitted by the Foundation for Fair Contracting (FFC) regarding Giant Construction’s bid for the project in question. It is imperative to clarify certain misconceptions and inaccuracies presented in the FFC's advisory letter.

Firstly, it is crucial to highlight that the bid submit by Giant Construction has been deemed responsive by the city staff, meeting all the requirements outlined in the bidding documents - including the Bidders Representations 2.2, Bidding Procedure 6.7, and Labor Law Section 15.3. As per the specifications provided by the city, our company is duly registered with the California Department of Industrial Relations (DIR No. 1001019062), ensuring compliance with prevailing wage laws and regulations. Our bid form, signed under penalty of perjury, affirms our company’s eligibility under Labor Code Sections 1777.1 or 1777.7. Any insinuation that we are not in adherence to these requirements is unfounded.

Secondly, it is important to underscore that Giant Construction, the FFC, and the City of Piedmont all share a common objective - ensuring that tradespeople working on this project are paid fair and legal wages. We are fully committed to upholding prevailing wage laws and have demonstrated our dedication to compliance. The FFC's recommendation to reject our bid lacks any substantiating information, and unfairly targets our company based solely on our status as a newer contractor. It is unreasonable to presume wrongdoing without evidence, proper investigation, or communication with our company.

Furthermore, it is essential to emphasize that the selection of a contractor for this project should be based on adherence to the requirements outlined in the bidding documents furnished by the City of Piedmont, not on arbitrary judgments from external parties. Giant Construction has a clean record and intends to operate in full accordance with the Public Contract Code and business ethics standards mandated by the state.

In conclusion, I respectfully urge the City Council to consider the facts presented and uphold the integrity of the bidding process by awarding this contract to the responsible bidder submitting the lowest responsive bid: Giant Construction. We are fully prepared and committed to delivering quality work while ensuring fair treatment of all tradespeople involved in this project.

Thank you for your attention to this matter.

Sincerely,
Daniel Wood
Owner
Giant Construction
