COUNCIL AGENDA REPORT
DATE: August 19, 2024
TO: Mayor and Council
FROM: Rosanna Bayon Moore, City Administrator
SUBJECT: Consideration of the Award of Contract for the Linda Beach Courts Renovation Project to Vintage Contractors, Inc. in the Amount of $188,000; Approval of an Overall Construction Budget of $206,800; and a Finding that the Project is Categorically Exempt Under CEQA Section 15301

RECOMMENDATION
By a single motion, take the following actions regarding the Linda Beach Courts Renovation Project:

1. Approve the award of the Contract for the Linda Beach Courts Renovation Project to Vintage Contractors, Inc. based on their submitted bid of $188,000.

2. Approve the Overall Estimated Construction Budget of $206,800, which includes the construction cost and a 10% contingency.

3. Find the project exempt under the California Environmental Quality Act (CEQA) Guideline 15301(c).

4. Authorize the City Administrator to execute project related documents.

BACKGROUND
At the September 5, 2023, meeting, Council directed staff to prepare plans for the repair and restriping of dedicated pickleball courts at Linda Beach Park. Construction bid documents were finalized in accordance with both City and State requirements and the project was circulated for the solicitation of bids in late September 2023. Bids for the project were opened on November 1, 2023. Three bids were received ranging in price from $296,150 to $407,558. All three bids significantly exceeded the engineer’s construction cost estimate of $227, 929. Due to the cost substantially exceeding the project estimate, staff recommended, and the City Council acted to reject the bids on January 16, 2024. At that time, staff were also authorized to modify the bid documents and re-bid the project.

Bid documents were modified to increase the court repair area and remove bid alternates. In accordance with both City and State requirements, the project was again circulated for bids in April 2024. Bids for the project were opened on May 2, 2024, and one responsive bid at a cost of $188,000 was received.

DISCUSSION
Revised construction documents were prepared and in April 2024 the project was publicly re-bid in accordance with City Ordinances and the Public Contract Code. Bids were opened on May 2, 2024. One bid was received and is presented in the below table:

Bidder Name Bid Amount
Vintage Contractors,
Inc. $ 188,000
The updated engineer’s estimate for this project is $189,010. The company submitting the low bid is Vintage Contractors, Inc. The bid from Vintage Contractors, Inc. has been checked and found to be mathematically correct. All information submitted with the bid is responsive to the requirements of the bid documents. Vintage Contractors, Inc. has a valid Class A contractor’s license and a valid Department of Industrial Relations registration number (required for public works projects), as do the proposed subcontractors for the project.

Based on the bid from Vintage Contractors, Inc. being both complete and responsive, staff is recommending award of the Linda Beach Courts Renovation Project to Vintage Contractors, Inc.

SCHEDULE OF CONSTRUCTION
If this contract is awarded on August 19th, it is anticipated that a preconstruction meeting will be held with the contractor in late September and the contract documents allow for 50 working days (10 weeks) to complete the work.

ENVIRONMENTAL REVIEW
The project at issue for California Environmental Quality Act (“CEQA”) purposes is comprised of only the following actions (“Project”):

1. Approve the award of the Contract for the Linda-Beach Courts Renovation Project to Vintage Contractors, Inc. based on their submitted bid of $188,000.

2. Approve the Overall Estimated Construction Budget of $206,800, which includes the construction cost and a 10% contingency.

3. Authorize the City Administrator to execute project related documents.

The City previously approved the dedication and restriping of the Linda Beach Tennis Courts for pickleball play through resolution 57-2023 on September 5, 2023. A Notice of Exemption was filed on September 8, 2023. The Council is not being asked to reconsider its prior decision here.

Only the Project is at issue. The Project is exempt from CEQA for the following reasons:

CEQA Guidelines Section 15301
The project is exempt from CEQA pursuant to CEQA Guidelines Section 15301, which applies to the “operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of existing or former use,”. Because the Project involves the repair and minor alteration of an existing facility, and involves no expansion of existing or former use, Section 15301 applies.

CEQA Guidelines Section 15302
Agenda Report Page 2
The Project is exempt from CEQA pursuant to CEQA Guidelines Section 15302, which applies to the “replacement or reconstruction of existing structures and facilities where the new structure will be located on the same site as the structure replaced and will have substantially the same purpose and capacity as the structure replaced.” Here, the Project involves awarding a contract for restriping facilities that, while currently striped for tennis, are already used for pickleball play subject to a previously determined schedule. Accordingly, the restriped facilities will be used for substantially the same purpose and capacity as the facilities as currently striped.

CEQA Guidelines Section 15061(b)(3)
The Project is exempt from CEQA pursuant to CEQA Guidelines Section 15061(b)(3), which provides that a lead agency may find a project exempt from CEQA if “it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment.” This exemption is applicable here. Pickleball play and related restriping has already been approved by the City Council, and is the subject of an earlier exemption determination. There is no possibility that the Project will have any significant effect on the environment.

No Unusual Circumstances
The Project does not present any unusual circumstances, and there is no reasonable possibility of a significant impact on the environment.

FISCAL IMPACT
Based on the recommended award amount, staff is proposing the following budget:

Construction $ 188,000
Construction Contingency (10%) $ 18,800
Total Estimated Project Construction Budget $ 206,800
$200,000 in funding for the project is included in the Proposed FY 2024-25 budget. Available funding exists in the Facilities Capital Fund to cover the additionally requested $6,800. The funding breakdown is:

Facilities Capital Funds (#112) $ 206,800
Total Estimated Project Construction Budget $ 206,800
