COUNCIL AGENDA REPORT
DATE: June 16, 2025
TO: Mayor and Council
FROM: Rosanna Bayon Moore, City Administrator
SUBJECT: Consideration of the Award of a Contract for the Linda Beach Tot Lot Improvement Project to Norgo Engineering in the amount of $123,950, Approval of an Overall Construction Budget of $136,345, and a Finding that the Project is Categorically Exempt Under the California Environmental Quality Act (Section 15301).

RECOMMENDATION
By a single motion, take the following actions regarding the Linda Beach Tot Lot Improvement Project:

1. Approve the award of the Contract for the Linda Beach Tot Lot Improvement Project to Norgo Engineering based on their submitted bid of $123,950.

2. Approve the overall Estimated Construction Budget of $136,345, which includes the construction cost, a 10% contingency.

3. Finding the project to be exempt under the California Environmental Quality Act Guideline 15301(c).

4. Authorize the City Administrator to execute project related documents.

BACKGROUND
The Beach Tot Lot Improvement Project began in earnest with a 2018 neighborhood petition from playground users asking for equipment upgrades for the northern end of Linda Park. In 2019, the Piedmont Beautification Foundation raised $100,000 to support the installation of new play equipment in this space.

The scope of this contract will include ADA access improvements, demolition of the existing equipment, preparing the site for installation of new playground equipment and matting, which will be performed under a separate agreement that will be presented to the City Council in July of 2025.

The Piedmont Beautification Foundation was an early supporter of improvements for Linda Park and the funds they raised will go towards funding the new playground equipment that will be installed once this contract is completed.

DISCUSSION
Bid documents were developed and the project was publicly bid in accordance with City Ordinances and the Public Contract Code. Bids were opened on May 29, 2025. Six bids were received ranging in price from $123,950 to $251,390.50. The engineer’s estimate for this project was $110,000. The company submitting the low bid is Norgo Engineering. The six bids received are presented in the table below:

Bidder Name Bid Amount
Kerex Engineering $ 166,375.00
Zara Construction $ 168,500.00
Norgo Engineering $ 123,950.00
Bosco Construction Services, Inc. $ 174,316.00
Raposo Engineering, Inc. $ 251,390.50
Bay Construction $ 193,424.00
The bid from Norgo Engineering has been checked and found to be mathematically correct and all information submitted with the bid is responsive to the requirements of the bid documents.

Norgo Engineering has a valid Class A contractor’s license (#1053116) and Norgo Engineering has a valid Department of Industrial Relations registration numbers (required for public works projects).

Based on the bid from Norgo Engineering being both complete and responsive, staff is recommending award of the Linda Beach Tot Lot Improvement Project to Norgo Engineering.

SCHEDULE OF CONSTRUCTION
If the contract is awarded at this City Council meeting, it is anticipated that the work will begin in July. The contract documents allow for 30 working days (6 weeks) to complete the work.

Accordingly, the project covered under this scope of work should be completed in early September.

Matting and equipment installation agreements are anticipated to be approved by the City Council in July of 2025. Equipment has a 8 – 10 week lead time and installation is anticipated to commence in September or October, with approximately 6 weeks to complete installation.

ENVIRONMENTAL REVIEW
This project is exempt from the California Environmental Quality Act pursuant to CEQA Guidelines section 15301, which applies to the repair and maintenance of existing public facilities that involve negligible or no expansion of use. Because the project concerns the repair of existing public facilities, this project is exempt under Section 15301.

FISCAL IMPACT
Based on the recommended award amount, staff is proposing the following budget:

Construction $ 123,950
Construction Contingency (10%) $ 12,395
Agenda Report Page 2
Total Estimated Project Construction Budget $ 136,345
Funding for the project is included in the Approved FY 2024-25 budget. The funding breakdown is:

Piedmont Beautification Foundation $ 100,000
Facilities Capital Funds (#112) $ 300,000
Total Estimated Project Construction Budget $ 400,000
Additional costs will be incurred as the playground matting, equipment and equipment installation are bid separately and will be awarded separately. The project remains within the total allocated budget.
