COUNCIL AGENDA REPORT
DATE: July 7, 2025
TO: Mayor and Council
FROM: Rosanna Bayon Moore, City Administrator
SUBJECT: Consideration of the Award of a Contract for the 2025 Pavement Rehabilitation Project to McGuire and Hester in the Amount of $1,372,804.50, Approval of an Overall Construction Budget of $1,510,085, and a Finding that the Project is Categorically Exempt Under CEQA Section 15301 (c)
RECOMMENDATION
By a single motion, take the following actions regarding the 2025 Pavement Rehabilitation Project:
1. Approve the award of the Contract for the 2025 Pavement Rehabilitation Project to McGuire and Hester based on their submitted bid of $1,372,804.50.
2. Approve the overall Estimated Construction Budget of $1,510,085, which includes the construction cost and a 10% contingency.
3. Determine the project to be exempt under the California Environmental Quality Act (CEQA) Guideline 15301 Class 1 (c).
4. Authorize the City Administrator to execute project related documents.
BACKGROUND
As part of the City’s ongoing efforts to maintain its roadway network, staff have prepared plans for pavement rehabilitation of several roadways within the City. As part of this project, roadway striping will be refreshed on the roadways where the pavement will be rehabilitated, as well as on 32 additional roadways.
Construction documents were recently completed, and the project was advertised for public bid in May, with bids opening on June 26, 2025.
DISCUSSION
The project consists of rehabilitating the pavement through either grinding and placement of new asphalt, or by placement of a rubberized cape seal on ten roadways within the City. In addition, striping will be placed on streets where the pavement will be rehabilitated, as well as 32 additional roadways. A map showing locations of both the paving and striping locations is shown in the following vicinity map:
Agenda Report Page 2
Specifically, the streets included with this project include:
• Dracena Avenue (from Blair Avenue to Park Way)
• Kingston Avenue (from Linda Avenue to Greenbank Avenue) • Blair Avenue (from Highland Avenue to Bonita Avenue)
• Hillside Avenue (from Oakland Avenue to Blair Avenue) • El Cerrito Avenue (from Oakland Avenue to Blair Avenue) • York Drive (from Arroyo Avenue to Cambridge Way)
• San Carlos Avenue (from Blair Place to Oakland Avenue) • Lower San Carlos Avenue (from Oakland Avenue to Magnolia Avenue) • Moraga Avenue (from Monticello to Estrella Avenue)
• Hampton Road (from La Selle to Lexford Road)
• Corner of Grand Avenue and Rose Avenue
• Striping Locations (Various Streets)
Final construction documents were completed and the project was publicly bid in accordance with City Ordinances and the Public Contract Code. Bids were opened on June 26, 2025. Six bids were received and are presented in the below table:
Bidder Name Bid Amount
McGuire and Hester $ 1,372,804.50
JV Lucas Paving $ 1,507,868.00
Gallagher & Burks Inc. $ 1,525,525.00
Ghilotti Bros., Inc. $ 1,648,710.00
Interstate Paving and Grading $ 1,749,395.50
QA Constructors $ 2,354,018.60
The engineer’s estimate for this project was $1,422,423. The company submitting the low bid is McGuire and Hester. The bid from McGuire and Hester has been checked and found to be mathematically correct, and the majority of all information submitted with the bid is responsive to the requirements of the bid documents. An informality was identified on the bid bond, which on one location shows a date of June 20, 2026, as opposed to 2025. The second lowest bidder, JV Lucas Paving, also submitted a bid protest based solely on this issue. The City Attorney’s office reviewed this issue and determined that it was a non-material typographical error that is waivable by the City and does not render the bid non-responsive. The City has subsequently received a bid bond with the correct dates in all locations. McGuire and Hester has a valid Class A contractor’s license (#95879) and a valid Department of Industrial Relations registration number (required for public works projects).
Based on the bid from McGuire and Hester being both complete and responsive, staff recommend award of the 2025 Pavement Rehabilitation Project to McGuire and Hester.
SCHEDULE OF CONSTRUCTION
If a contract is awarded at this Council meeting, it is anticipated that the work will begin in August. The contract documents allow for ninety (90) working days (18 weeks) to complete the
Agenda Report Page 3
work. Accordingly, the project should be completed at the beginning of December, weather permitting.
ENVIRONMENTAL REVIEW
This project is exempt from the California Environmental Quality Act pursuant to CEQA Guidelines Class 1 15301(c), which applies to the repair and maintenance of existing streets, sidewalks, gutters, bicycle and pedestrian trails. Because the project concerns the repair of existing public facilities, this project is exempt under Section 15301(c).
FISCAL IMPACT
Based on the recommended award amount, staff is proposing the following overall budget:
Construction $ 1,372,804.50
Construction Contingency (10%) $ 137,280.50
Total Estimated Project Construction Budget $ 1,510,085.00 Sources of funding for the project are Measure BB (Local Streets and Roads), Vehicle Registration Fee (VRF), and Senate Bill 1 (SB-1) as follows:
Measure BB Streets/Roads $ 890,085
VRF $ 75,000
SB-1 $ 545,000
TOTAL $ 1,510,085
