Consideration of a Resolution Authorizing the City Administrator to Represent the City of Piedmont for the Phase 6 Sanitary Sewer Rehabilitation Project
RECOMMENDATION
Adopt the attached resolution authorizing the City Administrator as representative for the City of Piedmont Phase 6 Sanitary Sewer Rehabilitation Project.
BACKGROUND
The City of Piedmont is one of seven cities in the East Bay that is part of a Consent Decree with the U. S. Environmental Protection Agency. The Consent Decree requires the City to rehabilitate its sewer system to reduce contributary flows into East Bay Municipal Utility District’s Wastewater Treatment facility. Prior to 2014, the City had already begun replacing aging sewer collection system infrastructure and had completed three phases of major projects, all of which had been funded through California’s State Revolving Loan Fund (SRF program).
Since 2014, the City completed Phases 4 and 5 of its sewer rehabilitation projects. To comply with the replacement schedule included in the Consent Decree, the City has continued to pursue Phases 6 and 7. In March 2023, the City awarded the design contract for the Phase 6. The design and environmental documents were completed in December 2024, allowing the City to file an application with the State Water Resources Control Board for financial assistance through the SRF program for Phase 6. In June 2025, the City was notified that the Phase 6 application made the list of projects that will be moving forward with the loan process.
Since July 2025, staff have been working with State staff to provide required information to complete the loan documents.
DISCUSSION
One of the required documents at this stage of the SRF process is a City Council resolution to appoint an Authorized Representative to represent the City in signing various documents. In the past phases of sewer projects, this authorization typically comes to Council with the overall loan documents from the State. However, in the last year, the State has changed their procedures and in order for the City to move forward with some of the information needed with the loan documents, the State needs an authorizing resolution prior to preparing the full loan package.
Based on this requirement, a resolution has been prepared for Council’s consideration appointing the City Administrator as the City’s Authorized Representative.
FISCAL IMPACT
There is no direct fiscal impact associated with appointing the City Administrator as the Authorized Representative at this stage. The execution of actual loan documents requires formal consideration and action by the City Council which is anticipated in early 2026.
