TO: Mayor and Council
FROM: Rosanna Bayon Moore, City Administrator
SUBJECT: Consideration of a Resolution Amending Resolution No. 36-2026 to Cancel the Election to be Held on November 3, 2026 for the Purpose of Electing Two Members of the Piedmont Unified School District Board of Education and Direct that the Qualified Nominees be Appointed and Seated at a Regularly Scheduled Meeting of the Piedmont Unified School District, Prior to November 3, 2026
RECOMMENDATION
It is recommended that the City Council adopt a resolution amending Resolution No. 36-2026 to cancel the election to be held on November 3, 2026 for the purpose of electing two members of the Piedmont Unified School District Board of Education and direct that the qualified nominees be appointed and seated at a regularly scheduled meeting of the Piedmont Unified School District, prior to November 3, 2026.
BACKGROUND
On June 15, 2026, the City Council of the City of Piedmont adopted Resolution No. 36-2026 calling the General Municipal Election on Tuesday, November 3, 2026, for the purpose of, among other things, electing two (2) members of the Piedmont Board of Education for a regular term of four (4) years. The candidate nomination period for the Board of Education officially opened on July 13, 2026, and closed at 5:00 p.m. on Friday, August 7, 2026.
California Education Code Section 5326 identifies specific circumstances in which a person may be appointed to the governing board of education, including but not limited to, if the number of nominees does not exceed the number of offices to be filled. If those circumstances are satisfied, California Education Code Section 5328 mandates the method of appointment and states that if the number of nominees does not exceed the number of offices to be filled, the election shall not be held, and the governing board shall seat the qualified nominees at a regularly scheduled meeting prior to the date set for the election.
At the close of the nomination period for the Board of Education seats, there were only two (2) individuals who successfully filed by the August 7 deadline, establishing that the number of nominees did not exceed the two available vacancies.
FISCAL IMPACT
Without a competitive Board of Education race, the cost of the November election will be borne completely by the City. As previously quoted by the Registrar of Voters, the cost for this election will be between $5 and $7 per registered voter in Piedmont. There are approximately 9,000 registered voters in the City. The proposed FY 2026-2027 Budget includes an appropriation of $63,000 for election expenses.
