Mayor and Council
Rosanna Bayon Moore, City Administrator
SUBJECT: Consideration of a Resolution Authorizing the City Administrator to Represent the City of Piedmont for the Phase 7 Sanitary Sewer Rehabilitation Project
RECOMMENDATION
Adopt the attached resolution authorizing the City Administrator to serve as the City’s authorized representative for the City of Piedmont’s Phase 7 Sanitary Sewer Rehabilitation Project and allowing the City to submit an application to the State Water Resources Control Board for financial assistance through the State Revolving Fund program for Phase 7.
BACKGROUND
The City of Piedmont is one of seven cities in the East Bay that is subject to a Consent Decree with the U.S. Environmental Protection Agency. The Consent Decree requires the City to rehabilitate its sewer system to reduce contributory flows into East Bay Municipal Utility District's wastewater treatment facility. Prior to 2014, the City had already begun replacing aging sewer collection system infrastructure and had completed three phases of major projects, all of which were funded through California's State Revolving Fund (SRF) program.
Since 2014, the City has completed Phases 4 and 5 of its sewer rehabilitation program. To comply with the replacement schedule included in the Consent Decree, the City has continued to pursue Phases 6 and 7. Design and environmental work have been completed for Phase 6, and City staff have been working with State staff to execute the required agreement prior to commencing construction.
In February 2025, the City awarded the design contract for Phase 7. The design and environmental documents are approximately 90 percent complete, allowing the City to submit an application to the State Water Resources Control Board for financial assistance through the SRF program for Phase 7.
DISCUSSION
One of the required documents at this stage of the SRF process is a City Council resolution appointing an Authorized Representative to represent the City in signing various documents related to the project and financing application. In prior phases of the City's sewer rehabilitation program, this authorization typically came before the City Council with the overall loan documents from the State. Under the State's current procedures, however, the City must adopt an authorizing resolution earlier in the process in order to proceed with certain requirements associated with the SRF application and preparation of the loan documents.
Based on this requirement, a resolution has been prepared for Council's consideration appointing the City Administrator as the City's Authorized Representative.
FISCAL IMPACT
There is no direct fiscal impact associated with appointing the City Administrator as the City's Authorized Representative at this stage of the SRF process.
The execution of the actual loan documents will require formal consideration and action by the City Council and is currently anticipated in early 2027.
