BACKGROUND:

Every December and January, the City conducts its annual recruitment to fill Advisory Body seats that are currently vacant or will become vacant at the end of February due to routine term expirations. Interviews and appointments by the Council are typically conducted in February for terms beginning March 1.

Staff seeks to fill vacancies within each of the City's Advisory Bodies during the 2022 annual recruitment cycle, including 11 scheduled vacancies and one existing vacancy.

Analysis
Information about current members, term end dates, and eligibility parameters for each body is provided as Attachments 1—6:

• Planning Commission (Attachment 1)
• Conference and Visitors Bureau Board (Attachment 2)
• Parks, Recreation and Beautification Commission (Attachment 3) • Parking Advisory Committee (Attachment 4)
• Special Events Committee (Attachment 5)
• Traffic Safety Committee (Attachment 6)

Conclusion and Appointments
At the conclusion of each meeting day, the City Clerk will tally and announce the voting results for each body for which interviews have concluded. The top overall vote-getters for each body will be appointed to fill the available seats. In the event of a tie among two or more applicants, the Council may choose to conduct a runoff vote among the tied candidates, or the Council may choose another method of resolving the tie.

The Council may opt to appoint individuals appearing for interviews, or opt to appoint individuals not appearing for interviews. The Council may appoint individuals to fill all vacancies, or opt to fill only some of the vacancies. If any vacancies remain following this round of interviews and appointments, staff will continue to recruit for any seats remaining unfilled unless otherwise directed, and the Council may direct that interviews of eligible applicants on file be conducted at any future time.

FISCAL IMPACT:

There is no budget impact associated with the appointment or orientation of Advisory Body members. Member stipends, supplies, training, and orientation are addressed in the existing adopted budget.

Eligibility
Per Pismo Beach Municipal Code Section 12.16.020, "[…] the SEC consists of members from various city departments that support and regulate special events […] and two members, appointed by the city council, who are residents of the city of Pismo Beach." The City Clerk's Office vets the eligibility of SEC applicants based on the above.

Because residency is an eligibility requirement for appointees to the SEC, voter registration will be sought as proof, but not required. If an applicant claiming residency lacks voter registration, other evidence of residency will be requested.

Analysis and Additional Considerations
There is one existing vacancy within the Special Events Committee. The current seated resident member with a term ending this cycle has opted to reapply. Five other candidates have expressed interest in being considered for the Committee.

It is a best practice for the terms of Advisory Body members to have staggered expiration dates, however both SEC resident seats are currently on the same two-year cycle. If the Council wishes to have SEC terms with staggered end dates, staff recommends that one of the two appointments be made for either a one-year or three-year term length.

In addition to those appearing for an interview at this juncture, the Council may choose to appoint other individuals in absentia, or choose to leave this seat unfilled.

Eligibility
The Traffic Safety Committee has no known enacting legislation or other document addressing membership qualification or terms. In July 2003, the Council acted on staff's recommendation to add one "citizen" seat to the Committee. The City Clerk's Office has traditionally interpreted "citizen" to mean a resident of the city, and in light of Senate Bill 998's prohibition on using citizenship to determine eligibility for appointive office, staff will continue to seek evidence of residency only.

Analysis and Additional Considerations
There are no existing vacancies within the Traffic Safety Committee. The current seated resident member with a term ending this cycle has opted to reapply. Three other candidates have expressed interest in being considered for the Committee. The remainder of the Committee comprising staff from various stakeholder departments and divisions including the City Manager's Office, Risk Management, Community Development, Public Works, Police, and Fire.
