PISMO BEACH COUNCIL AGENDA REPORT
Agenda Item #12.G

SUBJECT/TITLE:

INTRODUCTION (FIRST READING) OF AN ORDINANCE ADOPTING A “MILITARY EQUIPMENT” USE POLICY IN ACCORDANCE WITH THE REQUIREMENTS OF ASSEMBLY BILL 481

RECOMMENDATION:

Introduce an Ordinance adding Chapter 9.26 Military Equipment Policy to the Pismo Beach Municipal Code.

BACKGROUND:

Assembly Bill 481 (AB 481), codified at Government Code sections 7070 through 7075, requires a law enforcement agency (LEA) to obtain approval from the applicable governing body, via adoption of a “military equipment” use policy by ordinance, prior to the LEA funding, acquiring, or using military equipment as defined by the bill. Staff recommends that the City Council introduce the attached ordinance (Attachment 1), in order to allow the Pismo Beach Police Department (PBPD) to continue to use the vital equipment specified therein.

Items deemed to be “military equipment” by AB 481 are used as a component of overall best practices for LEAs throughout the country. These tools have been tested in the field and are used by LEAs to enhance citizen safety and officer safety. Loss of these items would jeopardize the welfare of citizens and peace officers within the city of Pismo Beach.

The term “military equipment,” as used in AB 481, is somewhat of a misnomer as it does not necessarily indicate equipment that has been used by the military or acquired from the military. Pursuant to AB 481, items deemed to be “military equipment” include, but are not limited to, unmanned aerial or ground vehicles, armored vehicles, command and control vehicles, pepper balls, less lethal shotguns, less lethal 40mm projectile launchers, long range acoustic devices, and flashbangs. The PBPD is committed to using appropriate law enforcement equipment to safeguard the citizens and officers of Pismo Beach. Many of the items deemed to be “military equipment” by AB 481 are already being used by PBPD and LEAs across the country, in order to specifically reduce risk to community members by using less lethal alternatives. These items provide peace officers with the ability to safely resolve volatile situations which otherwise might rise to the level of a lethal force encounter. To that end, the items at issue in this report, and accompanying Military Equipment Use Policy (Attachment 2), also provide PBPD peace officers with vital tools that facilitate compliance with the Department’s stringent use of force policy.

Other items deemed to be “military equipment” under AB 481 include foundational equipment such as rifles. These rifles allow PBPD officers to address lethal threats from a greater distance and with greater precision.

12.G-1Council Agenda 3-15-2022

In order to approve the policy, the City Council must make the following specific findings, which are included in the ordinance:

(A) The military equipment is necessary because there is no reasonable alternative that can achieve the same objective of officer and civilian safety.

(B) The proposed military equipment use policy will safeguard the public’s welfare, safety, civil rights, and civil liberties.

(C) If purchasing the equipment, the equipment is reasonably cost effective compared to available alternatives that can achieve the same objective of officer and civilian safety.

(D) Prior military equipment use complied with the military equipment use policy that was in effect at the time, or if prior uses did not comply with the accompanying military equipment use policy, corrective action has been taken to remedy nonconforming uses and ensure future compliance.

Conclusion and Recommendation
If the City does not commence a governing body approval process for this ordinance by May 1, 2022, PBPD may be prohibited from using “military equipment” until such time as the City Council adopts such an ordinance. Therefore, staff recommends introducing the ordinance provided as Attachment 1, to ensure the continued availability of the appropriate law enforcement tools on which the PBPD relies to provide law enforcement services to the community.

If the Council acts to introduce the Ordinance at this juncture, it will be returned for second reading and adoption on April 5, 2022 and become effective by statute 30 days thereafter.

Per the requirements of AB 481, staff will return to the Council at least annually with a report on the City’s Military Equipment Policy, and seek approval at that time for any necessary modifications to the Policy. The proposed approving Ordinance will automatically incorporate any such modified versions of the Policy.

FISCAL IMPACT:

There is no direct fiscal impact from this approval of this policy, or adoption of the proposed ordinance.

ALTERNATIVES:

1. Modify, and then introduce, the proposed Ordinance.

2. Do not introduce the Ordinance. This option is not recommended, because absent such an ordinance, PBPD would be prohibited from using the specified “military equipment” in the future.

3. Provide staff with alternative direction.
