7 HISTORY OF LU-E-1 A. & B.
•1-25-11: Planning Commission Workshop on General Plan Update •7-26-11: Planning Commission review the proposed changes for the St Andrews tract and five other zones that evening. The Planning Manager (Carolyn Johnson) states that she inserted the language included in LU-E-I a. & b. at the request of "an" email from a resident. No public comment or deliberation occurred. No analysis of the language was provided to determine that nearly every two-story home in the tract would become “legal non-conforming. •3-20-12: City Council adopted the changes (along with the updates to five other zones) and no City Council member or member of the public mentions the changes to the St. Andrews tract. •There was no notice to the St. Andrews Tract owners of a departure from standard City setbacks & the creation of a “step back” requirement.
8 ELIMINATE LU-E-I A. FOR STANDREWS TRACT
LU-E-1 a. Limiting the front yard setback for additions and reconstruction of existing homes or construction of a new home to the front yard setback in place on the existing home as of January 1, 2012.
•This language is not normally found in a General Plan
•This text places an undo burden on 171 Naomi due to its shape, location, & surroundings •This text has a negative impact on other homes in the St Andrews Tract •This text is already destined for removal from the General Plan 9 10

11 20’ FRONT YARD SETBACK
12 ELIMINATE LU-E-1 B. FOR ALL STRUCTURES IN THE

STANDREWS TRACT
LU-E-1 b. For additions or reconstruction of existing homes and the construction of new homes. A front elevation minimum 10’ building stepback from the first floor to the second floor.
•25 of 29 two-story homes are “legal non-conforming” along with all the existing apartment complexes & City Fire Station
•This requirement is found nowhere else in the City

17 WHY NOT WAIT FOR THE GENERAL PLAN UPDATE?
•Costs continue to rise 40.5% from 2019 to 2021
•Projected adoption of the General Plan is sometime in 2025 & it may not happen then •The City allows General Plan Amendments
•This General Plan Amendment clearly addresses bad planning for an entire neighborhood, not just one lot
•The current General Plan Update removes the requirements 18 CLOSING REMARKS
Follow the Staff Recommendation to:

Adopt a Resolution adopting a General Plan/Local Coastal Program Amendment to the City of Pismo Beach Land Use Element Planning Area “E” (St. Andrews Tract) to eliminate development restrictions imposed by Policies LU-E-1 ‘a’ and ‘b’; and adopting a Negative Declaration.
