Re: 171 Naomi Avenue
Dear Mayor and City Council,
I wanted to reach out to you and express some of my concerns regarding my property and permit submittal for 171 Naomi. I have recently has some serious health issues that have limited my ability to be present at the Planning Commission meetings, however I do plan to attend the City Council meeting if I am physically able to.

My personal trust, the Mittry Family Trust, owns the property at 171 Naomi and is the applicant for the new home. I wanted to clarify this since some seem to believe that my son owns it, and therefore they oppose it. I served for 28 years on a school board and never witnessed behavior that is so disgusting. It is sad to see someone take advantage of our no fee appeal process and abuse it simply because they take issue with the election results. And while it may not cost the appellant anything to file a frivolous appeal, I am sure there is a substantial cost for the city staff to process and thus the taxpayers of our city.

My son Scott Newton does NOT own the property at 171 Naomi, however he does have the "first right of refusal". The recording of this agreement is not available to the public and is only public record because Scott was overly transparent about his involvement. He could have simply and legally not said a word and let the application work its way through the city process. The fact that he listed it on his Form 700 should be praised and not criticized.

Mr. Warner would prefer that city council members not be allowed to build a home for themselves, or at least those that he opposes. He believes that if a council person took part in the selection process of the Planning Commission, then they should not be allowed to have their application processed. This would mean that none of you could submit an application since all of you selected them.

I highly commend the Planning Commission for seeing through Mr. Warner's personal issues. They made the right decision on approving the home, and had the wisdom to understand why the General Plan should be corrected for the entire St. Andrews tract. Our Planning Commission did the research and spent the time to understand how the General Plan placed undue hardships on many properties and would lead to more permit problems down the road. It is very welcoming to see this level of leadership from a Planning Commission.

In closing I would ask that you support the Planning Commission's approval and recommendations for 171 Naomi. Let us remember that this is about personal property rights and not politics.

Sincerely,
Richard Mittry
