PISMO BEACH COUNCIL AGENDA REPORT
Agenda Item #11.A
SUBJECT/TITLE:

APPEAL OF PLANNING COMMISSION APPROVAL OF A COASTAL

DEVELOPMENT PERMIT TO CONSTRUCT A TUNNEL COMPLEX, CABANA, GARAGE, AND POOL, AND CATEGORICAL EXEMPTION (P21-000087); LOCATION:
114 BLUFF DRIVE; THE PROJECT IS LOCATED IN THE COASTAL APPEAL ZONE AND IS APPEALABLE TO THE CALIFORNIA COASTAL COMMISSION; APN 010- 562-010
RECOMMENDATION:

Adopt a Resolution denying the appeal and upholding the April 26, 2022, Planning Commission approval of a Coastal Development Permit and Architectural Review Permit (P21-000087) for the construction of a 2,156-square-foot tunnel complex with a new garage and elevator to access a new 2,040-square-foot cabana and 1,157-square- foot pool deck and pool upslope of an existing single-family residence at 114 Bluff Drive, and adopting Categorical Exemption No. 2022-009.

BACKGROUND:

The subject property is an approximately 1.21-acre lot, located at 114 Bluff Drive within the Ontario Ridge Planning Area in the Planned Residential Zoning District (PR, 1983 Code). The project site is Lot 10 of Tract 1618. The site is developed with an existing single-family residence, three-car garage, driveway, and ornamental landscaping. The subject property is within the Coastal Zone and is appealable to the Coastal Commission.

On April 26, 2022, the Planning Commission approved a request by Thierry and Carol Thaure (Applicant) for a Coastal Development Permit (CDP) and Architectural Review Permit (ARP) to construct a tunnel complex with a new garage and elevator to access a new cabana and pool upslope of an existing single-family residence. The staff report for that meeting can be found in the Access Pismo online public records portal1 or by scanning the QR Code at right.

A timely appeal of the CDP was filed by Nicole Frank (Appellant) on May 10, 2022. An appeal of the ARP was not filed.

Project Description
The proposed CDP and ARP (Project P21-000087) will allow for the construction of a new 2,040-square-foot cabana, 1,157-square-foot pool deck, and pool. Access to the cabana is proposed via a new 638-square-foot bulkhead (entrance) and 2,156 square-foot tunnel complex. An approximately 60-foot elevator shaft will connect the tunnel to the cabana. 1 Full URL:

11.A-1Council Agenda 6-7-2022

The proposed project and improvements will be entirely within the approved building envelope established with the Tract approval, behind and upslope from the existing single-family residence. The Project will result in approximately 3,963 cubic feet of cut and fill. Approximately 2,263 cubic feet of material will be exported from the site via the adjacent vacant property.

Appeal
Basis for the appeal: “In violation of the Local Coastal Plan/General Plan, the Pismo Beach Planning Commission failed to properly evaluate the project’s likely negative impacts on the Coastal bluff and the potential damage to surrounding properties.”

Staff Response and Analysis
The Appeal does not clearly set forth issues related to the CDP itself, except an overly broad and unsubstantiated claim that the project is not consistent with the City’s General Plan/Local Coastal Program (GP/LCP).

Impacts to the Coastal Bluff
A discussion of compliance with the Hazards and Protection Overlay Zone requirements was provided to the Planning Commission as Attachment 3 - Development Standards and Policies of the April 26, 2022, Staff Report (Attachment 5). As a part of the Tract approvals in 1990, development envelopes were established for each specific lot using the blufftop setback limitations identified in Chapter 17.078 of the 1983 Zoning Code and General Plan Policy LU-A-5. Both documents require a minimum 100-year setback from the top of the coastal bluff for new development. LU-A-5 requires an additional 20-foot front setback beyond the 100-year bluff setback.

A Bluff Study was prepared as part of the Environmental Impact Report for the Tract approval and estimated yearly retreat of 0.3 feet per year for the portion of bluff fronting Lot 10. Based on Policy LU-A-5, the 100-year retreat rate plus an additional 20-foot setback would have been approximately 50 feet. The existing residence is approximately 220 feet from edge of bluff, and the proposed project is 320 feet from the edge of the bluff. The proposed project exceeds the minimum requirement for bluff top setbacks and complies with the General Plan and Local Coastal Program requirements.

Potential Damage to Neighboring Properties
As it relates to the potential damage to neighboring properties, the project is subject to General Plan Policy CO-11, which limits the amount of grading for slopes under 30%, such as generally limiting the amount of cut and fill to no more than 15’ in height and creating new slopes at 3:1 or 4:1 slopes. To implement this policy, the project is required to submit a detailed geologic study and preserve the natural topography of the site in lieu of excessive terracing and grading. A Geotechnical Engineering and Geologic Hazards Report was prepared for this project by Earth Systems Pacific, and was included in the Planning Commission Staff Report (Attachment 5). Furthermore, as part of the Tract approvals, defined development envelopes were created using those areas of the lots under a 30% slope, under a 200’ contour elevation, implementing a 10-foot side yard setback, and meeting the blufftop setback requirements noted above. While the boring

11.A-2Council Agenda 6-7-2022

for the tunnel will create cuts at the tunnel entrance facing the existing residence in excess of 15 feet, the Planning Commission determined this tunnel system was less damaging to the hillside than scarring the hillside to create an access driveway with multiple large terraces.

Testimony was provided by the Project Engineer regarding construction methods for the tunnel compared to similar projects within San Luis Obispo, Santa Barbara, and Napa Counties. Based on the Earth Systems Pacific report and testimony, the Planning Commission determined there would be minimal impact to neighboring properties.

As the Planning Commission took into account both the coastal blufftop conditions and impacts to neighboring properties as part of their consideration of the project, staff recommends that the Appeal be denied.

Environmental Determination
In accordance with the California Environmental Quality Act (CEQA), it has been determined that the project is categorically exempt pursuant to Section 15303(e) of the CEQA Guidelines regarding construction of accessory structures based on the above referenced studies and analysis. A copy of the Categorical Exemption has been included as part of the Planning Commission Staff Report (Attachment 5). Adoption of the Resolution provided as Attachment 1 would effectuate the Council’s adoption of this Categorical Exemption.

Public Notification
A notice of public hearing was posted at City Hall, on the City’s website, at the project site, mailed to all property owners within 300 feet of the project site, and published in the New Times on May 26, 2022. The meeting agenda was posted at City Hall and on the City’s website in accordance with Government Code Section 54954.2. As of the writing of this report, no correspondence for the project has been received.

Conclusion and Recommendation
The proposed project would be developed in compliance with the GP/LCP, 1983 Code, and all other applicable development standards. Staff finds no actionable concern in the appeal presented by the Appellant and finds the project consistent with the City’s LCP.

Staff recommends that the City Council adopt the prepared Resolution denying the appeal and upholding the April 26, 2022, Planning Commission approval (PC-R-2022-012) of the CDP associated with Project No. P21-000087, based on the findings set forth in Attachment 1. Adoption of this Resolution will also include approval of the Categorical Exemption associated with this project.

6. The site can be adequately served by all required utilities and public services.

B. FINDINGS FOR APPROVAL OF THE COASTAL DEVELOPMENT PERMIT:

1. The project improvements comply with the public access and public recreation policies of Chapter 3 (commencing with Section 30220) of the California Coastal Act of 1976.

2. The construction of a 2,156-square-foot tunnel complex with a new garage and elevator to access a new 2,040-square foot cabana and 1,157 pool deck upslope of an existing single-family residence is appropriate in size so as to be compatible with the adjacent residences and structures as the proposed development falls within the range of other similar residences and their accessory structures within the Tract and in the immediate vicinity.

3. The architectural and general appearance of the tunnel system, pool cabana, and related improvements is in keeping with the character of the neighborhood and compatible with the architectural style, building materials, and massing with other residences in the neighborhood.

4. The proposed development is consistent with the General Plan/Local Coastal Program and General Plan Land Use Plan category of ‘Low-Density Residential’.

5. The proposed development is compatible with the nearby existing uses and not detrimental to the health, safety, morals, comfort, and general welfare of persons living or working in the surrounding area of the proposed project because the proposed use includes the development of an accessory structure to an existing single-family residence, where other single-family residences with similar improvements exist within the same tract and in the immediate neighborhood.

6. The proposed development will not be detrimental to the orderly development of improvements in the surrounding area and will not be detrimental to the orderly and harmonious development of the city because the proposed use is similar to other residential development in the immediate neighborhood.

Attachment 1

11.A-6Council Agenda 6-7-2022

7. The proposed development will not impair the desirability of investment or occupation in the neighborhood because the proposed use is similar to other residential development in the immediate neighborhood and maintains a similar scale and character to other development in the same Tract and Planned Residential zone.

8. The proposed project will not significantly alter existing natural landforms because the project site does not contain prominent natural landforms.

9. The height, bulk, and scale of the proposed development is compatible with the adjacent area and with the surrounding views and other Local Coastal Program Land Use Plan considerations as designed.

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Pismo Beach hereby denies the appeal and upholds the Planning Commission’s April 26, 2022 approval of a Coastal Development Permit and Architectural Review Permit (Project P21- 000087) for a subject to the conditions as set forth in Exhibit A, attached hereto and incorporated herein by reference.
