A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PISMO BEACH,
CALIFORNIA AUTHORIZING THE CITY MANAGER TO ENTER INTO A
PROFESSIONAL SERVICES AGREEMENT WITH CLEANSTREET, LLC IN THE AMOUNT OF $164,982.60 ANNUALLY TO PROVIDE STREET SWEEPING SERVICES THROUGH JULY 2026 AND APPROPRIATING RELATED BUDGET
ADJUSTMENTS
WHEREAS, street sweeping prevents pollutants and litter from entering the City's storm drains and is a mandatory requirement for the City's "MS4" Stormwater Permit; and WHEREAS, a bid was advertised April 18, 2022 and one bid was received in the amount of $164,982.60; and
WHEREAS, the bid from CleanStreet, LLC has been selected as the lowest responsible bid; and
WHEREAS, the new contract will be effective from July 1, 2022 to June 30, 2026, with the possibility of two additional, two-year extensions; and WHEREAS, the City's Fiscal Year 2023 budget allocates $104,494.56 for street sweeping and parking lot sweeping services.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Pismo Beach hereby authorizes the City Manager to enter into an agreement with CleanStreet, LLC to provide street sweeping for the contract amount of $164,982.60 annually from July 1, 2022 to June 30, 2026; with the possibility of two additional, two-year extensions (bid schedule provided as Exhibit A).
BE IT FURTHER RESOLVED that the City Council of the City of Pismo Beach hereby shifts the parking lot sweeping services budget and contract of $56,265.00 from the General Fund to the Parking Enterprise Fund contract services account, including appropriating $56,265 in the Parking Enterprise Fund contract services account using available Parking Enterprise Fund net position (available fund balance) in FY 2023.
BE IT FINALLY RESOLVED that the City Council of the City of Pismo Beach hereby transfers $60,488.04 from the General Fund contingency budget to the Public Works Streets Activity contract services account to support the street sweeping contract in FY 2023.
UPON MOTION OF Mayor Pro Tem Reiss, seconded by Council Member Blake, the foregoing resolution was adopted by the City Council of the City of Pismo Beach this 7th day of June 2022, by the following vote:

The undersigned further agrees that in case of default in executing the required contract, with necessary bonds, within seven (7) days, not including Sundays and legal holidays, after having received notice that the contract has been awarded and is ready for signature, this proposal and the acceptance thereof may be considered null and void.
It is further understood and agreed that:
A. All bid items are to be calculated on the basis of the given estimated quantities of work, as indicated in this proposal, times the unit price as submitted by the bidder. In case of a discrepancy between words and figures, the words shall prevail.
B. The estimated quantities of work indicated in the proposal are approximate only, being used solely as a basis for comparison of proposals.
C. No verbal agreement or conversation with any officer, agent or employee of the City, before, during or after the execution of the agreement shall affect or modify any of the terms of obligations of this proposal.
D. The City of Pismo Beach will not be responsible for any errors or omissions on the part of the undersigned in making up his bid, nor will bidders be released on account of errors.
E. The contract proposal shall be completed in every detail, showing the prices written legibly in words as well as in figures.
