Subject: Council Meeting TONIGHT 6/21/2022, Comment on Agenda Item 12, Short-Term Rental Regulations and Enforcement
Gentlemen and ladies:
We have owned and resided in our home at 147 Seacliff Drive for more than 30 years. This is our third year of having had a STR rental permit, and rent our home faithfully and absolutely in compliance with all City STR regulations, and paid every dime of TOT and other taxes. We have now reached retirement age, can no longer work day-to-day as we always had, were largely self-employed our whole working lives and hence have no pensions or large retirement funds to rely on in our senior years, and the modest income from short-term rentals help us make ends meet.
In that entire time we have been renting, we have had absolutely no complaints, from neighbors, the City, or anybody else, about our situation, our guests, parking, noise, trash cans, or anything else.
No notice of any of this agenda item tonight was given to us as an existing STR permit holder. Basically by accident, we learned of it just this afternoon, and upon looking at the agenda, report, and correspondence, are shocked and concerned that the Council and staff have obviously been considering taking, or at least commencing toward taking, potentially very adverse action against our interests.
In reviewing the staff report and Correspondence, we are very concerned that staff and the Council are being unduly swayed by a very vocal, but tiny, number of persons complaining. Out of the 12 items of correspondence currently of record on this agenda item, all 12 are negative. That is clearly because the law-abiding STR permit holders have had no notice of it, nor any significant opportunity to submit the Council anything positive, in support of our interests.
Furthermore, it must be pointed out that 11 of those 12 items of correspondence complain about one single property, 125 Silver Shoals, in that single neighborhood. Clearly, the Council should not be swayed by problems with a single “bad apple” so as to take some action potentially injuring the dozens of “good” apples such as ourselves who are responsible permit holders.
The City’s existing STR regulatory plan was very well considered and deliberately thought out, considered the STR rules of many other communities exactly like are cited in the staff report, and was adopted only after extensive input and consideration. Admittedly, it sounds from the comments like some adjustments to the plan may be appropriate to address the particular ownership situation of 125 Silver Shoals, but the Council must not be swayed by the voices of those complaining about that owner only to make changes of broader application, to the possible injury of other residents, like us.
Thank you for your consideration.
