City of Pismo Beach
City Clerk's Office
June 14, 2022 JUN 2 0, 2022
To the City Council regarding the STIR agenda item on June 21, 2022 Received I am requesting that the City Council revoke or suspend the STIR permit that was granted to 125 N. Silver Shoals Dr. last month.

The owner of this property is not in compliance with Section 5.22.100.0 of the City Code which states:

C. "Primary residence" shall mean the dwelling owned and occupied as the property owner's principal place of residence, where the owner lives more than fifty percent of the year, defined herein as one hundred eighty-three days or more per year. For purposes of short-term rental or homestay licensing, a person can only have one primary residence at any time.

City staff is ignoring this requirement when granting permits, and this permit was granted incorrectly.

The individual who applied for the permit inherited the property from her parents who were full-time residents. The entire neighborhood watches over each other for safety reasons, so we are very aware of who lives on the street and who doesn't. This individual is only in the home 3-4 days per month, usually right before or after she rents to Airbnb.

I am asking the City Council to direct their staff to follow the City Code. Anybody can change a driver's license or voter registration in a few minutes, and that is what City staff is accepting as proof of residency. This is wrong and is not fair to the residents of a residential neighborhood.

Our street is being turned into a hotel zone. The owners still need to comply with Section

5.22.100.C.

Please do the right thing, revoke this permit for 125 N. Silver Shoals Dr. and conduct an independent, thorough investigation of how this permit was ever issued in the first place, especially since this owner had multiple violations in October, November, December, and January and was fined by the City. Our neighborhood has documentary evidence that proves that the owner is not in compliance with City Code.

Sincerely,
