SUBJECT/TITLE:
AWARD OF CONTRACT TO INDUSTRIAL DESIGN RESEARCH, INC. FOR THE
PURCHASE OF A LIFEGUARD TOWER
RECOMMENDATION:
Adopt a Resolution awarding a contract for the purchase of a Surveyor SR Lifeguard Tower to Industrial Design Research, Inc. in the amount of $57,916.78 and appropriating related budget adjustments in Fiscal Year 2023.
BACKGROUND:
Pismo Beach Lifeguards currently protect the Beach Safety Zone with five lifeguard observation towers. The City seeks to replace its oldest tower in service as it is at the end of its lifespan. It was originally purchased in 2003 and has a useful life of 20 years.
Staff has identified Industrial Design Research, Inc. (IDR) as the only manufacturer of fiberglass observation towers in the United States, making this a sole vendor purchase.
IDR has been constructing lifeguard towers since 1989. The City of Pismo Beach has purchased its last seven lifeguard towers from IDR. IDR uses galvanized steel, stainless steel, and fiberglass in its construction. These components have proven to be very durable in harsh environments. The buildout of lifeguard towers is a 6- to 8-month process. In order to have the new tower available for the 2023 season, the City needs to purchase the Tower now.
Because there is only one source of procurement for the lifeguard tower, in conformity with the City’s purchasing policy, the City Manager recommends a sole source purchase.
Staff recommends that the City Council adopt a Resolution (Attachment 1) authorizing the purchase of a Surveyor SR model lifeguard tower and appropriating related budget adjustments in Fiscal Year (FY) 2023. A quote from IDR is provided as Attachment 2.
FISCAL IMPACT:
The fiscal impact of approving the attached Resolution is $51,918.78. The FY 2023 Motor Vehicle Replacement Fund budget includes $46,000 for the replacement of a Lifeguard Tower. Staff recommends that Council appropriate the remaining $11,920 in the Motor Vehicle Replacement Fund for the Lifeguard Tower from the Motor Vehicle Replacement Fund available fund balance in FY 2023.
ALTERNATIVES:
1. Decline to adopt the resolution; defer purchasing Lifeguard Tower.
2. Provide direction to staff.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PISMO BEACH,
CALIFORNIA AWARDING A CONTRACT FOR THE PURCHASE OF A SURVEYOR SR LIFEGUARD TOWER TO INDUSTRIAL DESIGN RESEARCH, INC. IN THE AMOUNT OF $57,916.78 AND APPROPRIATING RELATED BUDGET
ADJUSTMENTS IN FISCAL YEAR 2023
WHEREAS, the City owns and maintains towers and equipment for the Fire Department, including the Lifeguard program; and
WHEREAS, the Fiscal Year 2023 Motor Vehicle Replacement Fund budget includes $46,000 for the replacement of a Lifeguard Tower; and
WHEREAS, Industrial Design Research, Inc. is the only manufacturer of fiberglass observation towers in the United States and the procurement of a new tower is therefore a sole source purchase; and
WHEREAS, the City has purchased its last seven lifeguard towers from Industrial Design Research, Inc. and they have met all specifications.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Pismo Beach hereby awards a contract for the purchase of a lifeguard tower from Industrial Design Research, Inc. in the amount of $57,916.78 (quote provided as Exhibit A).
BE IT FURTHER RESOLVED that the City Council of the City of Pismo Beach hereby appropriates an additional $11,920 in the Motor Vehicle Replacement Fund to purchase a Lifeguard Tower from the Motor Vehicle Replacement Fund available fund balance.

Buyer shall properly operate and maintain each tower per IDR’s guidelines, as updated from time to time.
Buyer shall be solely responsible for denying access to each tower to the public. Only persons authorized by Buyer shall be allowed access to each tower. The towers are not designed for public use.
Buyer shall indemnify and hold IDR harmless for any and all damages, claims, causes of action and injuries by any person who is not an authorized agent of Buyer as a result of any contact with a tower, excluding any patent defects in a tower.
Buyer is solely responsible for the deployment of and securing the towers against environmental and weather conditions.
