Infrastructure
• Corporate Yard Remodel:
o IT installed patch panels at the Yard Warehouse in preparation for the installation of the new network drops in the building.
o IT installed the IT rack in the remodeled section of the Yard Warehouse, where there is now a temperature-controlled room for the network and server equipment. • Parking E-Citations: IT assisted Parking with configuring new E-Citation equipment for testing and training.

Staff
• Recruitment: The ASD Director and the IT Manager selected a candidate for the Information Technology Technician. This candidate is working with Human Resources to complete the pre- employment process.

After considering these one-time costs and carrying forward these project budgets to the next fiscal year, the projected available fund balance is $798,048.

Parking Management Implementation
To continue assisting restaurants during the period of pandemic recovery and transition, on February 1, 2022, the City Council determined to allow outdoor parklet operations to remain for dine-in service through September 30, 2022. All remaining parklets utilized throughout the city were removed and underlying parking has been returned to its previous state.

As part of the upcoming paving project, parking meters will be installed on Price Street between Pomeroy and San Luis Avenues and the adjacent stub streets. On May 3, 2022, the City Council authorized an agreement with Walker Consultants for an update to the City’s Parking Management Plan (PMP). The PMP will incorporate the updated parking meters but will also address alternate topics such as electric bike infrastructure to help ensure the public can enjoy the downtown and the coast. Walker Consultants have completed data collection and provided a presentation to the Parking Advisory Committee (PAC) at their meeting on August 24, 2022. An additional meeting with the PAC is anticipated in November 2022.

As the City finds itself in the beginning of the offseason months, parking rates have been reduced to help accommodate the reduced number of vehicles impacting downtown. Staff will continue to monitor and adjust parking rates to encourage parking in appropriate areas Downtown.

FISCAL IMPACT:

No fiscal impact is anticipated by receipt of this update.

The North Shell Beach Road Storm Drain Repair project will address the storm drain failure on the City’s outfall located adjacent to the Dolphin Bay Resort that was sustained during the January 2017 winter storms. Those storms triggered a state of emergency via Resolution R-2017-012 and caused damage to multiple sites throughout the City. Staff took immediate cleanup and protective measures of the sites where possible and has been working with FEMA through the California Governor's Office of Emergency Services (CalOES) for reimbursement for work and funds required to cleanup and secure the various sites.

In January 2022, a professional services agreement was executed with Eikhof Design Group, Inc. for the design of the North Shell Beach Road Storm Drain Repair project. This contract was executed under the City Manager’s authority in line with the City’s Purchasing Policy. Design documents are nearing completion, and a bid package is being prepared.

Conclusion and Recommendation
Staff recommends that the Council authorize advertising for construction bids for the North Shell Beach Road Storm Drain Repair project. If the City receives favorable bids, staff will return to the City Council to award a contract to the low bidder.

FISCAL IMPACT:

There is no immediate fiscal impact to Council authorizing staff to advertise for construction bids for this project. However, staff estimates that the project could cost $238,500. The Fiscal Year (FY) 2023 General Fund budget includes $218,390 for the North Shell Beach Road Storm Drain Repair project. The table below summarizes the budget and the estimated construction costs for this project.

AUTHORIZATION TO BID THE TOUCAN TERRACE SEWER TRESTLE REPAIR

PROJECT

RECOMMENDATION:

Authorize staff to advertise for bids for the Toucan Terrace Sewer Trestle Repair Project.

BACKGROUND:

In February 2022, a professional services agreement was executed with Advantage Technical Services, Inc. for inspection and engineering services to assess the existing conditions, review feasibility of various coating options, and develop technical specifications of treatment for the City’s existing sewer trestle located across the Toucan Terrace HOA open space property. This contract was executed under the City Manager’s authority in line with the City’s Purchasing Policy. Procedural documents are nearing completion and a construction bid package is being prepared. The project will rehabilitate the existing coatings of the aboveground portion of the City’s existing sewer trestle.

Conclusion and Recommendation
Staff recommends that the Council authorize advertising for construction bids for the Toucan Terrace Sewer Trestle Repair project. If the City receives favorable bids, staff will return to the City Council to award a contract to the low bidder.

FISCAL IMPACT:

There is no immediate fiscal impact to Council authorizing staff to advertise for construction bids for this project. However, staff estimates that the project could cost $298,754. The Fiscal Year (FY) 2023 Wastewater Capital Projects Fund budget includes $271,246 for the Toucan Terrace Sewer Trestle Repair project. Agenda Item #9.G

SUBJECT/TITLE:

AUTHORIZATION TO PURCHASE PROTECTIVE VEHICLE BARRIERS FOR

SPECIAL EVENTS

RECOMMENDATION:

Adopt a Resolution authorizing the sole-source purchase of eight Archer 1200 Anti- Vehicle Barriers from Meridian Rapid Defense Group in the amount of $160,531.49 in FY 2023.

BACKGROUND:

The City of Pismo Beach hosts many special events throughout the year that take place within the street, the largest of which is the annual Pismo Beach Car Show. After tragic incidents of vehicles entering pedestrian areas at similar events across the nation, the City is taking the proactive approach of enhancing visitor safety at these events.

In the past, the City has used water-filled K-rails to stop vehicular traffic, however each K-rail requires approximately 150 gallons of water to be effective. In the current drought environment, such excessive use of water would be an unnecessary waste, and set a poor public example of water-wise practices. Further, the K-rails are bulky and difficult to move, even when empty, and require hours of staff time to deploy.

As part of the Fiscal Year (FY) 2023 Mid-Cycle Budget Adjustments, a request was approved to fund the purchase of vehicle barriers. The Police Department researched effective temporary vehicle barriers and eventually contacted Meridian Rapid Defense Group to request a demonstration of their patented Anti-Vehicle Barriers. A company representative visited Pismo Beach to demonstrate the product, allowing staff to evaluate the barriers by deploying them during the last Car Show. After evaluating the product, staff determined that the Meridian Anti-Vehicle Barriers would be the best method to protect the public during large events for the following reasons:

1. Ease of moving the barriers from the City’s Corporation Yard to event sites

2. Ability to use the barriers at any location throughout the city

3. The barriers do not require field assembly/disassembly, saving staff time for deployment and retrieval

4. The barriers do not rely on water for mass to stop vehicles

5. The barriers do not impede pedestrian traffic when deployed

6. The barriers can be configured to allow vehicles to pass, but only at low rates of speed

7. The barriers can be decorated for different seasons and themes providing a welcoming feeling, while still stopping vehicular traffic

Section IV of the City’s Purchasing Policy and Procedures states, “a contract may be awarded without competition when the City Manager determines in writing, after

9.G-1Council Agenda 10-18-2022

conducting a good faith review of available sources, that there is only one source for the required supply, service, or construction item. The City Manager shall conduct negotiations, as appropriate, as to price, delivery, and terms.” Meridian Rapid Defense Group has provided a quote (Attachment 1.A) for eight Archer 1200 Anti-Vehicle Barriers and all related accessories needed for deployment.

Conclusion and Recommendation
Due to the specialty nature of this product, it is currently only available from one manufacturer. There are similar products on the market; however, staff has identified deployment timing, ADA and pedestrian access, and liability concerns with the other available products. Therefore, this procurement is being recommended as a “sole-source” purchase. Staff recommends Council adopt a Resolution (Attachment 1) authorizing the sole source purchase of eight Archer 1200 Anti-Vehicle Barriers from Meridian Rapid Defense Group in the amount of $160,531.49.

FISCAL IMPACT:

The FY 2023 Capital Projects Fund budget includes $162,142 to purchase anti-vehicle barriers. The following table details the current budget and actual costs for purchasing the selected barriers from Meridian Rapid Defense Group.

FY 2023 Capital Projects Fund Budget $162,142.00

8 Archer 1200 Anti-Vehicle Barriers & Accessories $148,985.14 Sales Tax $11,546.35
Total $160,531.49

Remaining Budget $1,610.51

ALTERNATIVES:

1. Do not approve the sole source purchase; provide staff with direction on how to proceed.

PISMO BEACH COUNCIL AGENDA REPORT

SUBJECT/TITLE:

ADOPTION OF FINDINGS RELATING TO AB 361 (VIRTUAL MEETINGS)

RECOMMENDATION:

Adopt the following findings with respect to the City of Pismo Beach’s utilization of the provisions of Assembly Bill 361, relating to Brown Act teleconferences:

1. The City Council has reconsidered the circumstances of the state of emergency created by the coronavirus pandemic.

2. The following circumstances exist:
• The state of emergency continues to directly impact the ability of the Council Members to meet safely in person.

BACKGROUND:

Assembly Bill 361 (Rivas, 2021) amends and codifies the relaxed Brown Act provisions that were originally implemented by Executive Orders of the Governor in response to the coronavirus pandemic. Among the provisions of the Brown Act that were relaxed by the Governor’s Orders were provisions for participation in legislative meetings by teleconference (phone, or virtual platform such as Zoom). Prior Brown Act provisions required that, in the event any legislative body member(s) wished to participate in a meeting remotely, the exact address of the remote location(s) be published in advance on the meeting agenda, the remote location(s) be disabled-accessible, and the public be provided the opportunity to observe the meeting and make public comment at the remote location(s).

Governor’s Orders N-29-20 and N-08-21 effectively suspended all of these provisions for health and safety reasons, making it possible for legislative body members to join a meeting virtually without the need for conducting advance noticing or providing direct public access to the location. AB 361, effective October 1, 2021, functionally codifies these provisions through January 2024, allowing agencies to avail themselves of the continued teleconferencing option if desired, provided that the legislative body makes certain findings as outlined below (Government Code Section 54953(e)(3)):

(3) If a state of emergency remains active, or state or local officials have imposed or recommended measures to promote social distancing, in order to continue to teleconference without compliance with paragraph (3) of subdivision (b), the legislative body shall, not later than 30 days after teleconferencing for the first time pursuant to subparagraph (A), (B), or (C) of paragraph (1), and every 30 days thereafter, make the following findings by majority vote:
(A) The legislative body has reconsidered the circumstances of the state of emergency.
(B) Any of the following circumstances exist:
(i) The state of emergency continues to directly impact the ability of the members to meet safely in person.

Council Agenda 10-18-2022 9.H-1
Packet Page 74

(ii) State or local officials continue to impose or recommend measures to promote social distancing.

The City Council inaugurated its use of AB 361 provisions by holding a totally teleconferenced meeting via Zoom on October 5, 2021, and then adopted the recommended findings at each of its regular meetings since October 19, 2021. Following the state’s removal of the indoor mask mandate for vaccinated individuals on February 16, 2022, the City Council transitioned to fully hybrid meetings where the legislative body members, staff, and the public may attend the meeting either in person, or virtually.

Procedural Flexibility
The circumstances surrounding the impact of the coronavirus pandemic are continually evolving, and the progression of the pandemic, along with accompanying governmental health and safety directives, are difficult to foresee. While the Council has determined to transition to hybrid City Council meetings with a certain level of in-person participation, staff recommends that the adoption of these findings, as recommended, remain on the Council’s consent agenda for the foreseeable future, until such time that the Council determines that it can no longer make the findings due to a change in circumstance.

Adoption of the recommended findings at each meeting will provide continued flexibility should the Council need or desire to make a change to its meeting practices at any point in the future. Adoption of the findings in no way commits the City to holding virtual or hybrid meeting proceedings, providing full flexibility under uncertain circumstances.

Other Provisions of AB 361
AB 361 also requires that the public be given the opportunity to address the legislative body with their comments in real time, which the City has provided continuously since the start of the pandemic, and will continue to. In addition, the bill requires that meeting proceedings be stopped in the event that the public’s virtual access to a meeting is disrupted, for example due to an internet outage. When holding a hybrid meeting with some or all members participating in person, and some or all of the public participating virtually, staff will monitor the virtual meeting to component to assure that public access is not interrupted, and pause meeting proceedings in the event of a disruption.

Conclusion and Recommendation
In order to provide both legal compliance and practical flexibility during ongoing uncertain circumstances, staff recommends that, by minute order, the City Council make the following findings with respect to the City of Pismo Beach’s utilization of the provisions of Assembly Bill 361, relating to Brown Act teleconferences:

1. The City Council has reconsidered the circumstances of the state of emergency created by the coronavirus pandemic.

2. The following circumstances exist:
• The state of emergency continues to directly impact the ability of the Council Members to meet safely in person.

REVIEW AND RATIFICATION OF A COASTAL DEVELOPMENT PERMIT TO CONSTRUCT A NEW SINGLE-FAMILY RESIDENCE AT 171 NAOMI AVENUE; THE

PROJECT IS WITHIN THE COASTAL ZONE AND IS APPEALABLE TO THE COASTAL COMMISSION; APN 010-501-005

RECOMMENDATION:

Adopt a Resolution ratifying the City Council’s April 19, 2022, approval of a Coastal Development Permit (P21-000015) to demolish an existing single-family residence and construct a new 3,648-square-foot single-family residence at 171 Naomi Avenue, and approval of a Negative Declaration.

BACKGROUND:

On April 19, 2022, the City Council adopted Resolution R-2022-028, approving a Coastal Development Permit (CDP) to construct a new single-family residence at 171 Naomi Avenue (P21-000015). This action was preceded by the adoption of Resolution R-2022- 027 adopting a General Plan/Local Coastal Program Amendment to the City of Pismo Beach Land Use Element Planning Area ‘E’ (St. Andrews Tract) to eliminate development restrictions imposed by Policies LU-E-1 ‘a’ and ‘b’, and based on the anticipated certification of the Local Coastal Program Amendment (LCPA) by the California Coastal Commission (CCC). Under Resolution R-2022-027, the City Council also adopted a CEQA Negative Declaration for the collective actions. The staff reports for the General Plan/Local Coastal Program Amendment1 and the CDP2 items from that meeting can be found in the Access Pismo3 online public records portal.

On September 9, 2022, the CCC certified the LCPA as submitted, eliminating the development restrictions previously imposed. Through the processing of the LCPA, CCC staff informed the City that the previously-discussed approval process, in which the City would not submit a Notice of Final Action (NOFA) for the CDP until after CCC certification of the LCPA, was no longer supported. According to CCC staff, this process would not allow the CDP to be found consistent with the LCP, regardless of the final action on the LCPA, as action was taken on the CDP under the previous LCP. CCC staff indicated that the City would therefore need to amend its prior CDP action, or take a new CDP action to be consistent with the current (amended) LCP.

The ratification of the Council’s prior approval of the CDP is appropriate, as the Council’s prior action anticipated the approval by the CCC of the GP/LCP amendment to eliminate the development restrictions imposed by Policies LU-E-1 ‘a’ and ‘b’, and the finding of

consistency with the GP/LCP for this project was based on the GP/LCP as revised to remove those restrictions. Upon ratification of the prior approval, staff can then transmit the NOFA to CCC.

Environmental Determination
In accordance with the California Environmental Quality Act (CEQA), staff prepared an Initial Study for the project because it involved an amendment to the GP/LCP in addition to the single-family residence project. After completion of the Initial Study, staff found that there is no substantial evidence, in light of the whole record, that the project may have a significant effect on the environment, that the preparation of an Environmental Impact Report is not necessary, and no mitigation is required. Therefore, a Negative Declaration (pursuant to Public Resources Code Section 21000 et seq., and CA Code of Regulations Title 14 Section 15000 et seq.) for the project was prepared (Attachment 2). Ratification of the Council’s previous approval, by adoption of the Resolution provided as Attachment 1, would also effect the Council’s approval of this Negative Declaration.

It should also be noted that with the General Plan/Local Coastal Program Amendment certified, the CDP would qualify for categorical exemption from CEQA pursuant to Section 15303(a) of the CEQA Guidelines regarding construction of a new single-family residence.

Conclusion and Recommendation
The Council previously approved the proposed CDP on the basis of the General Plan/Local Coastal Program being modified to ensure consistency. Since that action, the CCC certified the LCPA as submitted. No other changes have occurred that should affect the Council’s previous action. Therefore, staff recommends that the Council adopt a Resolution (Attachment 1) ratifying its prior approval of the CDP for the construction of a new single-family residence.

There is no direct fiscal impact as a result of staff’s recommended action.

RESOLUTION NO. R-2022-XXX

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PISMO BEACH, CALIFORNIA RATIFYING THE CITY COUNCIL’S APRIL 19, 2022 APPROVAL OF A COASTAL DEVELOPMENT PERMIT (P21-000015) TO DEMOLISH AN EXISTING SINGLE-FAMILY RESIDENCE AND CONSTRUCT A NEW 3,648-SQUARE-FOOT SINGLE-FAMILY RESIDENCE AT 171 NAOMI AVENUE, AND APPROVAL OF A

NEGATIVE DECLARATION

WHEREAS, on April 19, 2022, the City Council adopted Resolution R-2022-028, approving a Coastal Development Permit (CDP) to construct a new single-family residence at 171 Naomi Avenue (P21-000015); and

WHEREAS, this action was preceded by the adoption of Resolution R-2022-027 adopting a General Plan/Local Coastal Program Amendment to the City of Pismo Beach Land Use Element Planning Area ‘E’ (St. Andrews Tract) to eliminate development restrictions imposed by Policies LU-E-1 ‘a’ and ‘b’, making the CDP consistent with the Local Coastal Program (LCP); and

WHEREAS, under Resolution R-2022-027, the City Council also adopted a Negative Declaration for the collective actions; and

WHEREAS, on September 9, 2022, the California Coastal Commission certified the Local Coastal Program Amendment (LCPA) as submitted; and

WHEREAS, Coastal Commission staff informed the City that the City would need to amend the prior CDP action or take a new CDP action to be consistent with the current LCP; and

WHEREAS, outside of the certification of the LCPA, no other changes in the facts have occurred related to the CDP; and

WHEREAS, it has been determined that ratification of the City Council’s prior approval is the appropriate course of action; and

WHEREAS, the City Council held a duly-noticed public hearing on October 18, 2022, at which all interested persons were given the opportunity to be heard; and

WHEREAS, the City Council finds, after due study, deliberation, and public hearing that the following circumstances exist:

Council Agenda 10-18-2022 11.A-3
Attachment 1

A. FINDINGS REQUIRED BY THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA):

1. The City Council has considered the Initial Study and Negative Declaration dated December 8, 2021 (State Clearinghouse No. 2021120183) and all comments received during the public review period and finds in its independent judgement that there is no substantial evidence that the project may have a significant effect on the environment, and the preparation of an Environmental Impact Report is not necessary. Therefore, the City Council finds the Project will not have a significant environmental effect.

2. The project is consistent with the applicable General Plan designation and all applicable General Plan policies, as well as with applicable zoning designation and regulations because the project is in the low-density residential land use category within the R-1 zoning designation, which allows for construction of single-family residences consistent with the density factor of the General Plan.

3. The proposed development occurs within city limits on a project site of no more than five acres and is surrounded by similar or comparable residential uses.

4. The project site has no value as habitat for endangered, rare, or threatened species because the site is currently developed with an existing single-family residence and ornamental landscaping.

5. Approval of the project would not result in any significant effects relating to traffic, noise, air quality, or water quality because the project, as conditioned, is consistent with all applicable Zoning Code and California Building Code standards.

6. The site can be adequately served by all required utilities and public services.

B. FINDINGS FOR APPROVAL OF THE COASTAL DEVELOPMENT PERMIT:

1. The project improvements comply with the public access and public recreation policies of Chapter 3 (commencing with Section 30220) of the California Coastal Act of 1976.

2. The demolition of an existing 1,340-square-foot-residence and construction of a 3,648-square-foot single-family residence is appropriate in size so as to be compatible with the adjacent residences and structures as the proposed development falls within the range of other similar residences in the surrounding neighborhood.

3. The architecture and general appearance of the two-story single-family residence is in keeping with the character of the neighborhood as the architectural style, building materials, and massing are similar to and compatible with other residences in the neighborhood.

Council Agenda 10-18-2022 11.A-4
Attachment 1
Packet Page 80

4. The proposed development is consistent with the General Plan, Local Coastal Program, and General Plan Land Use Plan category of Low-Density Residential (R-1).

5. The proposed development is compatible with the nearby existing uses and not detrimental to the health, safety, morals, comfort, and general welfare of persons living or working in the surrounding area of the proposed project because the proposed use includes the development of a new single-family residence where other single-family residences exist in the immediate neighborhood.

6. The proposed development will not be detrimental to the orderly development of improvements in the surrounding area and will not be detrimental to the orderly and harmonious development of the city because the proposed use is similar to other residential development in the immediate neighborhood.

7. The proposed development will not impair the desirability of investment or occupation in the neighborhood because the proposed use is similar to other residential development in the immediate neighborhood and maintains a similar scale and character to other development in the same R-1 zone.

8. The proposed project will not significantly alter existing natural landforms because the project site does not contain prominent natural landforms.

9. The height, bulk, and scape of the proposed development is compatible with the adjacent area and with the surrounding views and other Local Coastal Program Land Use Plan considerations as designed.

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Pismo Beach hereby ratifies its April 19, 2022, approval of Coastal Development Permit P21-000015, with the above findings and subject to the conditions as set forth in Exhibit A, attached hereto and incorporated herein by this reference.

BE IT FURTHER RESOLVED that the City Council of the City of Pismo Beach hereby ratifies the adoption of the Negative Declaration with the above findings, which is incorporated herein by this reference.

Council Goal – Water Supply, Conservation and Central Coast Blue

Central Coast Blue

Financing
 The City was awarded a Round 1 Prop 1 Groundwater Grant Program (GWGP) planning grant for the funding amount of $2,000,000. The grant agreement was executed in April 2019 and grant activities were completed in January 2022. These activities included construction of a test injection well, construction of a monitoring well, aerial geophysics investigations, completion of a leaching study, developing an updated groundwater monitoring plan, and completion of an anti-degradation analysis, all of which will assist in advancing the Central Coast Blue project.

 Following review of the City’s concept proposal, State Water Resources Control Board (SWRCB) Department of Financial Assistance invited the City to submit a full proposal for Round 3 Prop 1 GWGP Implementation Grant funding. On July 15, 2022, the City submitted a full proposal which included a request for $35.7 million in grant funding for the project, the largest single opportunity for the project, representing almost 40% of implementation costs. The SWRCB anticipates completing its review of the Round 3 proposals by December 2022.

 The City applied for a Title XVI planning grant from the United States Bureau of Reclamation and was notified in February 2019 of an award of $796,094 to fund program management, permitting, and final design. The City then applied for a Title XVI implementation grant and was notified in August 2021 of an award of $1,700,000. Then on March 15, 2022, the City submitted another Title XVI implementation grant request and was notified in August 2022 of an additional award bringing total funding from the program to $14,124,000. The City anticipates applying in early 2023 for the remainder of funding available to the project from this program. The project is eligible to receive up to 25% of total project costs, or approximately an additional $9.1 million.

12.A-5Council Agenda 10-18-2022
Packet Page 97

 San Luis Obispo County plans to submit a State Integrated Regional Water Management (IRWM) Grant Program, Prop 1 Round 2 Implementation Grant request in early 2023 that includes multiple projects from around the County. The City submitted a request and was recommended by the Regional Water Management Group Working Group to receive $1M of the $3.7M that is available for this final round of funding. The Board of Supervisors currently plans to vote on the authorization of the application in November.

 The City submitted applications to the SWRCB for Clean Water State Revolving Fund (CWSRF) financing for construction of the project in December 2021. The project was not placed on the Fundable List for the FY 2023 CWSRF Intended Use Plan because the Joint Powers Authority (JPA) had not been created yet, and the project did not score high enough. With the JPA now in place (see Governance below), the project can submit an updated application in December 2022.

Technical
 The City kicked off the Program Management, Permitting, and Final Design stage of the project in March 2022. An architectural visioning workshop was held in May 2022 which informed the development of architectural renderings for the Advanced Water Purification Facility.

 Final design and permitting efforts are currently underway to advance the project to the point where it is ready for construction.

Governance
 A cost-sharing agreement was developed and approved by the Arroyo Grande City Council on January 25, 2022, by the Grover Beach City Council on February 15, 2022 and by the Pismo Beach City Council on March 1, 2022.

 A Management Team made up of staff from the three cities was formed in early 2022 and meets monthly to evaluate pre-construction and construction costs, provide input into formation and operations of the JPA, and present reports at the joint City Council meetings.

 An inaugural joint meeting of the three City Councils was held on September 14, 2022. Joint meetings of the three City Councils will occur at least once annually until the Project is constructed to provide a venue for discussion and transparency for the public on the project’s progress, to receive project updates, and discuss policy issues as needed (e.g., unexpected timeline extensions, approvals of expenditures beyond the Project budget, etc.).

 A Joint Exercise of Powers Agreement to establish the Central Coast Blue Joint Powers Authority (Authority) was developed and approved by the Grover Beach City Council on September 26, 2022, by the Arroyo Grande City Council on September 27, 2022, and by the Pismo Beach City Council on October 4, 2022.

The JPA Agreement contains provisions relating to:

12.A-6Council Agenda 10-18-2022
Packet Page 98

o The powers of the Authority (e.g., to make contracts, employ staff and consultants, acquire and dispose of property, issue bonds and incur debts and liabilities, apply for grants, etc.).
o The governance of the Authority. There will be a Board of Directors, which will have a Chair and Vice-Chair, will meet at least quarterly, and will consist of one representative of each city, as well as one alternate. Except for reimbursement for actual costs and expenses, the Board will serve without compensation from the Authority.
o An annual budget process. In March of each year, the Board will adopt a preliminary budget and an allocation of contributions from the Member Agencies for presentation to each of the Member Agencies’ governing bodies. The governing body of each Member Agency will then review and comment on the preliminary budget and allocation of contributions. The Board will adopt a final budget prior to July 1of each year and adopt an allocation of contributions from the Member Agencies to be consistent with the percentages agreed to for pre-construction and construction costs for Phase 1 of the project (i.e., Pismo Beach 39%, Arroyo Grande 25%, and Grover Beach 36%). Each annual budget will be adopted by an affirmative unanimous vote of the Directors, except the first annual budget may be adopted by a majority vote.
o Construction financing, operations and maintenance costs, capital improvement costs, and debt service. In connection with the issuance of debt, each party will enter into a financing agreement with the Authority securing the obligation of such party to make payments on its share of debt service. The financing agreements will stipulate that payment to the Authority is a special limited obligation payable solely from system net revenues of each party’s Enterprise Fund.
o Termination, indemnification, and withdrawal of Member Agencies and the effect of withdrawal, including continuing liability; the Agreement makes it clear that the debts, liabilities, and obligations of the Authority are not the debts, liabilities and obligations of any of the Member Agencies.

Council Goal - Community Character and Quality of Life for Residents

James Way Beautification Project
In addition to the installation of additional trash cans, benches, and new mutt mitt stations, on February 15, 2022, the City Council directed staff to move forward with a streetscape project that would significantly enhance the corridor with the installation of planters and trees on the ocean side of James Way. On May 17, 2022, a contract was awarded to BEK Collective to prepare plans and specifications for the removal of the concrete between the sidewalk and fence line and replacing it with drought-tolerant landscaping on the west side of the street. The project will also update ADA ramps, install new irrigation, repair raised planter beds on the east side of the street, and look at street furniture relocations to optimize the streetscape. The current timeline for the project anticipates construction to begin in May of 2023.

Ventana Tennis Courts Project
On May 17, 2022 a contract was awarded to Callander Associates Landscape Architecture Inc. to prepare plans and specifications for the new tennis and pickleball courts on Ventana Drive (Ventana Courts). These courts will consist of two pickleball courts, one tennis court, and a parking lot. The current timeline for the project anticipates construction to begin in April 2023.

Toucan Terrace Sewer Trestle Rehabilitation
The consultant has prepared plans and specs for recoating the sewer trestle support bridge. The City Council will consider authorizing staff to bid on this project at the October 18, 2022 City Council meeting.

Chumash Park and Palisades Park
Initial budgeting cost estimates for both park improvements were $450,000. Current estimates for park improvements are $1.3 million. The increased costs are a result of moving the playground further up the hill and cost increases for material procurement, installation services, softfall installation and the amount of accessibility improvements that must be constructed in both parks. The current estimated playground equipment vendor’s manufacture lead-time from the date of authorized purchase is four to six months.

Price Historical Park Event Green
This project will create an event green area per the Master Plan. The consultant has submitted preliminary landscape improvement plans for a grassy event area between the Price House and the Meherin House.

Pier Avenue Stairs Closure
The consultant has begun the evaluation of the stairs. Repairs, alternative options, and cost estimates are being developed as part of the assessment and will be presented to the City Council on November 15, 2022.

North Shell Beach Road Storm Drain Repair
The North Shell Beach Road Storm Drain Repair project will address the storm drain failure on the City’s outfall located adjacent to the Dolphin Bay Resort that was sustained during the January 2017 winter storms. Initial cost estimate $250,000. It is estimated that construction will start in spring 2023, with completion in summer 2023.

FY 2023 Projects
The projects in this section have not yet been developed to a point where staff is able to provide an anticipated completion date. Staff will continue to develop these projects.

Dog Park at Spyglass
This project consists of installing a dog park at a portion of Spyglass Park, including chain link fencing to keep the dogs contained in the “dog park,” benches, trash cans, and mutt mitt stations.

Hinds/Oceanview Pedestrian Path
This project will construct a sidewalk between Price Canyon Road/Hinds Street to Ocean View Avenue adjacent to Highway 101.

Shell Beach Parking Lot
This project includes adding a parking lot on Shell Beach Road to the north of the Shell Beach Road tennis courts and pickleball courts. The current zoning code limits the parking lot to 5,000 square feet.

New Production Well
This project will construct a new production well, which will add redundancy to the system and eventually replace Well 5, which has been rebuilt twice in the last twenty years and is not expected to be rebuilt again in the future.

PISMO BEACH COUNCIL AGENDA REPORT
Agenda Item #12.B

SUBJECT/TITLE:

RESIDENTIAL WATER CONSERVATION INCENTIVE PROGRAMS

RECOMMENDATION:

Provide staff with direction on how to proceed with residential water conservation incentive programs.

BACKGROUND:

On September 20, 2022 staff provided an update to the City Council on the City’s water supply and information on current water conservation incentive programs that the City offers Pismo Beach water customers.

The staff report for that meeting can be found in the Access Pismo online public records portal1 or by scanning the QR Code at the right.

At this meeting, the City Council requested City staff explore additional water conservation incentive programs (rebates) in response to the worsening drought. These rebates would be in addition to the Cash for Grass and High-Efficiency Toilet Rebates that are currently offered. If Council wishes to enact any of the proposed rebate programs, staff will produce terms and conditions for these programs and return with a Resolution to the next City Council meeting. Several potential programs the Council could initiate, along with an estimate of the cost to the City per acre-foot (AF) of water saved, are detailed below. Some of these programs have been offered by the City in the past, including the washing machine rebate, the rain barrel rebate, the smart irrigation controller rebate, and the free mulch program. Below is a table of the rebates offered during the 2014 program and the number of customers who took advantage of those programs.

Hot Water Recirculation Pump Rebate
This program would reimburse residents for the purchase and installation of a hot water recirculation pump. Hot water recirculation pumps reduce wait times for hot water to arrive at showerheads and taps, saving water and money. It is estimated that the average household could save up to 12,000 gallons of water per year by installing a hot water recirculation pump. This program could provide $100/per household for a hot water recirculation pump, for a cost of $2,715.43/AF of water conserved.

Washing Machine Rebate
This program would reimburse residents for the purchase and installation of Consortium for Energy Efficiency (CEE) Tier 3 washing machines that have a water factor of 4.0 or less. Typical rebates are between $150 to $200. City staff would perform inspections before and after the purchase to verify both units before a rebate would be issued. The average household could save 5,000 gallons of water per year by switching to a Tier 3 washing machine, for a cost of $9,775.54/AF of water conserved based on a rebate of $150/washing machine.

Rain Barrel Rebate
This program would reimburse residents for the purchase and direct connection of a rain barrel(s) to their down spout. Typical rebates are between $50-$100 per rain barrel. Even through non-drought times, rain barrels save water by cutting back on potable water used for irrigation. 312 gallons of water can be captured for every half-inch that falls on a 1,000- square-foot roof. The average annual rainfall in Pismo Beach is 17.79 inches of rain. The City received 12.09 inches in 2020 and 19.25 inches in 2021. This would mean that a house with a 1,000-square-foot roof could have a savings of approximately 1,300 gallons of water, even in a very dry year. With a $50/barrel rebate (two-barrel minimum), the cost would be $25,065/AF of water conserved.

Smart Irrigation Controller Program
This program would pay for all or part of the cost of a new irrigation controller. The program would only cover specific brands and models of irrigation controllers that have features such as automatic irrigation adjustments for rain or wet weather. It is estimated that a household could save up to 6,000 gallons of water annually with a smart irrigation controller. If a rebate of $100 was offered, the cost to the City would be $5,430/AF of water conserved.

Mulch Program
This program would provide free mulch to residents. Organic mulch on the surface of a planted area can not only minimize weeds but reduce evaporation and save water. The City has already taken steps to implement a mulch program in order to comply with the State’s SB 1383 requirements to reduce the disposal of organic waste. The City’s Franchise Agreement with South County Sanitary Service, Inc. (South County Sanitary) includes a provision for two public compost give-away events. The date of these events will be determined by the City and South County Sanitary will provide the mulch. Once a date has been set for an event, the City would notify all residents of the date, time, and location the mulch will be available for pick up.

Conclusion and Recommendation
Staff recommends that the City Council discuss the current residential water conservation incentive programs and provide staff with direction on how to proceed.

FISCAL IMPACT:

The fiscal year 2023 Water Enterprise Fund water conservation program budget is currently $42,125, not including rebates in progress to support these efforts. The fiscal impact of providing staff with direction to add more water conservation rebate programs could result in using these funds at a faster rate and a corresponding reduction in water consumption could result in less revenue to the Water Enterprise Fund, the extent of which is unknown at this time.

ALTERNATIVES:

1. Direct staff to explore alternate water conservation incentive programs.
